Tracy,
I have attached a proposed landscape easement for Freddy's Custard. Please look over it a few minutes and see if it is in
the ballpark of your expectations. There is no problem meeting the landscape planting requirements in the easements.
■ The west easement is 10 feet wide. The curb line will be adjusted to abut the easement.
Perimeter landscape strip is acceptable. The minimum perimeter width would be 9 feet.
• The North easement is 14 feet wide and abuts the Walmart sign. I do not think Walmart will agree to put their
sign in a landscape easement. Is 14 feet okay?

* The east and west sides have significant mature trees. Can I use them in my tree calculations or do you want
more trees?
Existing trees can be used to meet the minimum requirements as long they are located on the property or in the
proposed landscape easement. Trees selected for preservation shall be fenced with protective fencing and
protected from development activities in accordance with Landscape Ordinance Sec. 1S-S2. Preservation,
protection and planting.
• The applicant cannot meet the Building Landscape requirement. I have proposed transferring the required 270
sf to the south end of the building. Will this be okay?
Yes, building landscape can be transferred to this area. The remainder of the green space in this area can be
transferred to meet the 8% interior landscape requirement.
Am I asking for a variance of the following section of the landscape ordinance:
o Chapter 15, Sec. 15-96. Perimeter Planting Strips
Yes, all other landscape requirements (building, parking interior, and plant material quantities) can be met.
Are there other sections I need to ask for a variance on?
No, the minimum width of the perimeter planting strips is the only requirement that cannot be met. Specifically
your variance request will be, "To allow the north and west perimeter planting strips to be less than the nine (9)
foot minimum width as required by Sec. 15-96. Perimeter Planting Strips."
In order for Staff to support this request I will need documentation that the adjoining property owner will provide the
landscape easements and that the plant material as required by the city ordinance will remain as prescribed for these
planting areas.
Thank you for helping me with this application. I have a very short time to prepare and I want to be accurate.

I was able to run down a copy of the site plan for Freddy's Custard and it looks like the variance you will be requesting
would be to allow the removal of a portion of the required perimeter planting strips between the vehicular use area and
the north, east, and west property lines.
The ordinance requirements of Chapter 15, Sec. 15-96. Perimeter planting strips, state that:
(a) A perimeter planting strip is required along any side of a vehicular use area that abuts adjoining property or the
right-of-way of any street, highway or freeway. This strip shall be at least nine (9) feet wide. The perimeter planting
strip adjacent to freeways or expressways shall be at least thirty (30) feet wide except within mature areas.

In order for Staff to be supportive of this request an agreement with the neighboring property owner to provide a
landscape easement will need to be obtained. The land outside of the Freddy's property line is available in the width
that would be required for a perimeter planting strip and the required plant material can be installed on the adjacent
property if an agreement is reached. However, this would still require the CBC variance. The plant material
requirements for the east and west property line would include one (1) tree and three (3) shrubs for every thirty (30)
linear feet. Since the vehicular use area is adjacent to the right-of-way on the north property line a screen will need to
be provided. This can be accomplished by providing shrubs at 3'-0" on center, trees will also need to be provided on this
north perimeter at the rate of one (1) tree for every thirty (30) linear feet.
