COMMISSION
The City Beautiful Commission held its regular meeting at 11:30 a.m. on Thursday, June
04, 2015, at Curran Hall, 615 E. Capitol Avenue. Chairman Ed Peek called the meeting to order.

APPROVAL OF THE MAY MINUTES:
Motion: Chairman Peek entertained a motion to approve the May 07, 2015 Minutes.
Commissioner Loveless made a motion to approve.
Second: Commissioner Homeyer seconded the motion and it passed unanimously.
Variance Request: CBC Case # 639, 11610 Pleasant Ridge Road
Staff opened the public hearing for the variance request located at 11610 Pleasant Ridge Road. In
May of 1998 the Planning Commission approved the site plan for this 5.63 acre site zoned C-2 and
located within the Highway 10 Scenic Corridor Design Overlay District. There are two existing
buildings on this property which total 33,900 square feet. In addition there are 263 parking spaces
that serve these facilities. The larger building located within the west half of property is a retail
space and the smaller building to the east is currently being used as the Market Place Grill
restaurant. The property to the south located across Pleasant Ridge Road includes a former US
Post office, an office building at the northwest corner of Fairview and Pleasant Ridge Roads, and
the Pleasant Ridge Town Center Shopping Center. West of the site is a multifamily development.
North of the site across Cantrell Road is a property zoned POD which has developed as a bank,
and west of this bank the property is zoned PD-R which was approved for a multi -family
development which has not occurred.
The property was developed in accordance with the approved site and landscape plans. The
original landscape plan dated August 1998 indicated that a portion of the existing tree masses were
to be preserved on the north and west property lines. The required forty (40) foot street buffer
adjacent to the north property line is steeply sloped from the back of the parking lot curb to the
existing sidewalk located in the Cantrell Road right-of-way. Starting at Pleasant Ridge Road and
progressing northward approximately the first 1/3 of the property is traditionally landscaped with
lawn, trees, shrubs and groundcover. The remainder of this street buffer was left undisturbed and
the existing trees and vegetation were protected, preserved and allowed to continue in their natural
state to meet the landscape requirements.
In December of 2014 the owner of the property begin clearing the underbrush, pruning tree limbs,
and removing a portion of the trees from this undisturbed street buffer. A residential neighbor
concerned that this activity may be in violation of the city code alerted the City of Little Rock's
Planning Department and Public Works Department. Upon investigation it was determined that
along with the understory vegetation eight -eight (88) trees had been removed from the Cantrell
Road buffer area. The trees that have been removed ranged in size from four (4) inches in caliper
to twenty-five (25) inches in caliper. In accordance with the tree replacement chart found in Sec.
15-52. - Preservation, protection and planting. The replacement of these trees would require
two hundred and fifty-eight (258) three (3) inch caliper trees to be planted in the area where
existing trees were removed.
The preserved plant material in this Cantrell Road buffer was not completely removed. With the
exception of the understory vegetation a large stand of mature trees remains at the north end as
well as the center of the buffer area. These areas are specifically indicated on the approved
landscape plan to remain and still exist. However, in part the trees and vegetation that have matured
over the past seventeen years have been removed. In addition mature trees within specific areas
noted as "Existing Tree Mass to Remain" on the approved landscape plan have been removed.
White-Daters and Associates has prepared a landscape plan which adds plant material back to this
buffer area. The proposed plan shows the addition of thirteen (13) two (2) inch caliper trees and
forty-two (42) five (5) gallon shrubs. If this were a new development the proposed and existing
landscape shown in this area would meet or exceed the landscape requirements.
STAFF RECOMMENDATION:
Staff is supportive of the White-Daters plan adding plant material back to this buffer area.
Presentation:
Owner representatives Mr. Joe White and Ms. Sally Horsey of White-Daters and Associates
provided photo copies of the existing conditions of the site. In addition the proposed landscape
plan and the original 1998 landscape plan were also presented.
Mr. White stated that his client Mr. Lou Schickel intentions were to enhance his property and
clean-up the hillside between Cantrell Road and the back of the shopping center's parking lot curb.
It was stated that the understory vegetation was eradicated and the existing trees were limbed -up
or removed to provide a more park like sitting to an area that Mr. Schickel felt was overgrown.
Mr. White also noted that his client had not obtained a permit before engaging this work.
Mr. White stated that White-Daters had located the remaining existing trees and he felt the intent
of the original landscape plan was still in existence today. In addition the plant material has
continued to grow this spring and the groundcover is again thriving.
Chairman Peek inquired if there had been any mature trees taken from the preserved tree areas
indicated on the plan.
Mr. White stated that he believed Mr. Schickel's tenants in the retail space felt that the trees had
matured to a point that their storefronts could not be seen from Cantrell Road. The removal of
some of the existing trees was an effort to open this space to provide a clear view from the road.
Commissioner Homeyer inquired if there was a green strip adjacent to the south side of the parking
lot. Ms. Horsey explained that there was not a strip in this area and the original plan included a
sidewalk.
Chairman Peek inquired about the types of trees that are being proposed. Ms. Horsey stated these
would be smaller native trees, such as dogwood, buckeye, and redbud that would provide greenery
against the retaining wall located in this area but would not block the site lines to the storefronts.
Ms. Horsey also stated that the intent is to make this area look more natural. Furthermore, Ms.
Horsey added that shrubs are being added adjacent to the parking lot to meet the ordinance
requirements.
Chairman Peek inquired about the shrub species. Ms. Horsey stated that these would be evergreen;
Bufford hollies and Chinese hollies which would grow large and need to be trimmed on occasion.
Chairman Peek stated that he believes that there is not much difference between the original plan
and the proposed plan and that the tree masses are still intact.
The commissioners discussed the various items associated with this request including a donation
to the T.R.E.E Fund. City Attorney Carpenter clarified the T.R.E.E. Fund section of the ordinance
and noted that the number trees remaining on site exceeds the minimum number required and
therefore the property owner shall not be penalized.
Motion: Chairman Peek entertained a motion to approve the proposed landscape plan prepared
by White-Daters and Associates be accepted and implemented to replace the vegetation that has
been removed from the street buffer with the condition that no additional trees greater than four
(4) inches in caliper be removed from the property.
Second: Commissioner Homeyer seconded the motion and it passed unanimously.

Commissioner Homeyer stated:
• He had spoken with Mark Webre with the City Parks and Recreation Department who has
requested a letter of implementation stating the timeframe in which the project will take
place, what will be removed, and what will be installed. Commissioner Homeyer stated
that he would present this letter at the next meeting.
Public Relations
Website:
• Commissioner Morgan stated that the CBC now has a Facebook page and would forward
the approval letter from City Manager Bruce Moore to the other commissioners.
• Commissioner Hancock stated that a link to the CBC webform has been placed on this
Facebook page
• Commissioners Morgan and Hancock discussed with the other commissioners the
possibilities that will be presented by using this social media outlet.

Commissioner Loveless stated:
• That the Adopt -A- Street program will be celebrating its 20 year anniversary on June 10.
There will be a celebration at Center at University Park from 2:00pm — 4:00pm.
• City Attorney Carpenter stated that a contract had been signed between the City of Little
Rock and the Landscape Architect concerning the first schematic design phase for the
Kavanaugh round -a -bout.
Adopt -A -Street:
• The commissioners discuss dates for a cleanup. It was decided that the next cleanup would
be Saturday June 13, 2015 at 8:00 am.
Eye of the Beholder:
• Chairman Peek requested that a pdf or a link to the presentation card be sent to the
commissioners so cards can be printed when needed.
• The commissioners discuss the administrative process of nominating and presenting an
award.

I talked to Lou yesterday. I have attached a quote from Good Earth for replanting the slope.
I think Lou would like to go back to the CBC with the idea of giving this amount of money to the tree fund. The slope
has healed well and with spring here, it is about to look really nice.
His lease with Newk's requires that he keep visibility to their store front. Rather than plant trees that he will continually
prune to keep his lease with Newk's, why don't we let the CBC spend the money elsewhere.
He'd like to submit to the CBC. Between now and the meeting, we can get some good pictures of the slope and how it
has covered again.

(c) Continuous maintenance. Once a landscape plan has been approved, a digital and hard copy of the
approved plan shall be provided to the city and also kept on file with the owner/management company.
The plan shall remain on file with the city, and the site shall be maintained in conformance with the
landscape plan. Any landscaping materials or preserved or required trees that die within one year of
planting shall be replaced one (1) for one (1) by the responsible party unless additional trees are
required to be planted to meet the spacing requirements of this chapter in effect on the date of the
most recent approved landscape plan.
After one (1) year of planting, any trees that die shall be replaced in accordance with the tree credits set
forth in this section. Trees that are destroyed or removed by act or consent of the responsible party
shall be replaced in accordance with the tree credits set forth in this section. Replacement shall occur as
soon as reasonably possible in accordance with the approved landscape plan and good horticultural
practices and in compliance with this chapter.
Sec. 15-7. - Enforcement.
(b) [Approved landscape plan required.] All property subject to the requirements of this chapter shall be
developed in conformance with an approved landscape plan. The removal or improper preservation of each
required tree shall be considered a separate violation. Each violation shall be considered a separate offense.
Sec. 15-83. - Maintenance.
(c) The neglect or refusal to maintain as described in this section, after ten (10) days' written notice by
the city, shall be considered a violation.

No, the approved plan says "Existing Tree Mass to Remain" So the intention of the plan was for all of the trees to
remain. When I visited the site I took an inventory of everything above 3" that was cut.
My findings are on the attached two documents. In summary (259) 3" caliper trees will need to be replaced based on the
caliper inches of trees removed from the site. If this quantity is not able to be placed on the site this will then go to the
CBC to determine what action will be required.
Please give me a call if you would like me to go over this in further detail.

Good morning. Wanted to drop you a note and let you know we are working on a plan to mitigate the removal of trees
on the Pleasant Ridge West property.
I met with Tracy Spillman and Vince Floriani last week to determine the developer's options. They were both very
helpful in explaining not only the violation but options going forward.

FINDINGS -
In May of 1998 the Planning Commission approved the site plan for 11610 Pleasant Ridge Road. This
5.63 acre site is zoned C-2 and located within the Highway 10 Sre C=idor-De_-4gn Overlay District.
There are two existing buildings on this property wb.ieh41@t,1I-3-3;90E)'sgLtare feet. In addition there are
263 parking spaces that serve these facilities. The larger building located within the west half of property
is a retail space and the smaller building to the east is currently being used as the Market Place Grill
restaurant. The property to the south located across Pleasant Ridge Road includes a former US Post
office, an office building at the northwest corner of Fairview and Pleasant Ridge Roads, and the Pleasant
Ridge Town Center Shopping Center. West of the site is a multifamily development. North of the site
across Cantrell Road is a property zoned POD which has developed as a bank, and west of this bank the
property is zoned PD-R which was approved for a multi -family development which has not occurred.
The property was developed in accordance with the approved site and landscape plans. The original
landscape plan dated August 1998 indicated that a portion of the existing tree masses were to be
preserved on the north and west property lines. The required forty (40) foot street buffer adjacent to
the north property line is steeply sloped from the back of the parking lot curb to the existing sidewalk
located in the Cantrell Road right-of-way. Starting at Pleasant Ridge Road and progressing northward
approximately the first 1/3 of the property is traditionally landscaped with lawn, trees, shrubs and
groundcover. The remainder of this street buffer was left undisturbed and the existing trees and
vegetation were protected, preserved and allowed to continue in their natural state to meet the
landscape requirements.
In December of 2014 the owner of the property begin clearing the underbrush, pruning tree limbs, and
removing a portion of the trees from this undisturbed street buffer. A residential neighbor concerned
that this activity may be in violation of the city code alerted the City of Little Rock's Planning
Department and Public Works Department. Upon investigation it was determined that along with the
understory vegetation eight -eight (88) trees had been removed from the Cantrell Road buffer area. The
trees that have been removed ranged in size from four (4) inches in caliper to twenty-five (25) inches in
caliper. In accordance with the tree replacement chart found in Sec. 15-52. - Preservation -protection
and planting. The replacement of these trees would require two hundred and fifty-eight (258) three (3)
inch caliper trees to be planted in the area where existing trees were removed.
The preserved plant material in this Cantrell Road buffer was not completely removed. With the
exception of the understory vegetation a large stand of mature trees remains at the north end as well as
the center of the buffer area. These areas are specifically indicated on the approved landscape plan to
remain and still exist. However, in part the trees and vegetation that have matured over the past
seventeen years have been removed. In addition mature trees within specific areas noted as "Existing
Tree Mass to Remain" on the approved landscape plan have been removed.
White-Daters and Associates has prepared a landscape plan which adds plant material back to this
buffer area. The proposed plan shows the addition of thirteen (13) two (2) inch caliper trees and forty-
two (42) five (5) gallon shrubs. If this were a new development the proposed and existing landscape
shown in this area would meet or exceed the landscape requirements.
STAFF RECOMMENDATION:
Staff is supportive of the White-Daters plan adding plant material back to this buffer area.

Request a Landscape Variance be granted from Sec 15-52, replacement of trees "in accordance with
the tree credits set forth in this section" and provide a revised landscape plan of the street buffer
along Hwy 10 with trees located eve 20' per Section 36-343 of the Highway 10 Overlay District.
