3 A RESOLUTION TO FILL A VACANCY ON THE BOARD OF
4 COMMISSIONERS FOR THE PECAN LAKE MUNICIPAL
5 RECREATIONAL DISTRICT NO. 4; AND FOR OTHER PURPOSES.

7 WHEREAS, the Pecan Lake Municipal Recreational Improvement District No. 4 ("Improvement
8 District")was created by Little Rock, Ark., Ordinance No. 17,310(November 7, 1996); and,
9 WHEREAS,by Little Rock,Ark.,Ordinance No.22,035 (September 7,2021)the size of the Board of
10 Commissioners of the Improvement District was increased from three(3)to five(5)and two(2)additional
11 commissioners were appointed, one(1)for an initial four(4)year term to serve as a Commissioner for the
12 Improvement District with such term expiring on September 7,2025; and,
13 WHEREAS,there is a vacancy on the Board of Commissioners of the Improvement District, and it is
14 now necessary to appoint a commissioner to fill the vacant position; and,
15 WHEREAS, pursuant to Arkansas Code § 14-88-301(a)(1)(A)(iv)(a), the city council shall appoint
16 owners of real property in the district as commissioners; and,
17 WHEREAS,by signed petitions of owners representing ten(10%)percent or more of the properties in
18 the Improvement District, it is recommended that the City appoint Mrs. Kim Collier, a property owner
19 within the boundaries of the Improvement District,who is qualified and willing to fill the vacancy and serve
20 on the Board of Commissioners.
21 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
22 OF LITTLE ROCK, ARKANSAS.
23 Section 1. The Board of Directors hereby appoints Mrs.Kim Collier as a Commissioner on the Board
24 of Commissioners of the Pecan Lake Municipal Recreational Improvement District No. 4 of the City of
25 Little Rock and shall perform the duties as set out in Arkansas Code §14-48-131.
26 Section 2. Term. The term for Kim Collier shall begin upon the effective date of this Ordinance and
27 shall be for a period of three (3) years, unless earlier removed or replaced in accordance with applicable
28 law.
29 Section 3. Severability. The various parts,sections and clauses of this ordinance are hereby declared
30 to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid
31 by court of competent jurisdiction,the remainder of this ordinance shall not be affected thereby.
32 Section 4. Repealer. All laws, ordinances, resolutions, or parts thereof in conflict with the provision
33 of this ordinance are hereby repealed to the extent of such conflict.
