The Little Rock Board of Direc- tors, which has final authority on zoning issues, was set to vote on the new zoning rules next week. The action was delayed .Wednes- day after the Downtown Partner- ship requested additional time to review the zoning rules and an ac- companying set of vision plans. The Downtown Partnership is a business group which receives city funding to support downtown de- velopment. A new date for a vote has not yet been set. The Planning Commission unanimously approved the zoning regulations Sept. 16, but after Moses and other developers voiced concerns about the height regulations, Planning Department staff worked out the alternative. "It appeared as a result of com- ments from developers that we needed to retook at height re- quirements, and we are trying to be sensitive to that," Planning Di- rector Jim Lawson said. "We are trying to encourage redevelop- ment in downtown Little Rock." The Planning Commission will comment on the compromise height tonight, but not vote on it. Planning Commissioners Craig Berry and Mizan Rahman, the com- missioners who sat on the Down- town Zoning Committee that devel- oped the proposed regulations, said Wednesday they don't have a problem with the compromise. The Downtown Zoning Commit- tee, a 10-member group of plan- ning commissioners, property owners and neighborhood repre- sentatives, began meeting in Au- gust 1998 to create the zoning plans. The plans are an attempt to impose a uniform, urban look'on downtown Little Rock, with the creation of a new zoning classifi- cation, "urban use." The area affected stretches from the Arkansas River on the north to Interstate 630 on the south and from Cross Street on the west to a few blocks past Interstate 30 on the east. Presently there's a grab-bag of different zoning classi- fications in the area. The "urban use" height limits would not apply to a central sky- scraper district, where buildings could rise to about 200 feet, or 15 stories. The proposed skyscraper district is a rectangle from Second Street on the north to Ninth Street on the south and from Broadway on the west to Scott Street on the east, with an extension west to Gaines Street between Fourth and Sixth streets. Under current zon- ing, the area where skyscrapers can be built stretches to River - front Park, instead of stopping at Second Street. Besides the proposed height, rules, the "urban use" classifica- tion includes a host of new regula- tions designed to extend some of the charming characteristics of the River Market District throughout downtown. Among the new re- quirements are a mandate that all buildings start five feet from the right of way and a requirement that one-third of the ground -floor wall space on commercial build- ings be made of'glass. The regulations would take ef- fect six months after approval by the city board and would not apply to existing or already approved structures. Lawson noted that just as they can now, developers will be able to apply for variances from the zoning rules. Flake offered cautious praise of the new zoning rules as a whole, but said financial incentives would be a more effective way to encourage developments. "I think it's a good -faith effort to get a mix of uses in the center city," he said. "But I don't think we can be fooled that we're creating demand through this ordinance." The new zoning rules would go hand -in -hand with a package of four downtown -vision plans: Downtown Little Rock -Framework for the Future; the Downtown Cor- ridors Plan; the Six Bridges Framework Plan; and the Capitol Area Framework Master Plan. The Capitol Are& plan was de- veloped by the Capitol District Zoning Commission, the state agency that controls development around the Capitol and the Gover- nor's Mansion. The Downtown Cor- ridors and Six Bridges plan were developed with assistance from the University of Arkansas at Little Rock Urban Studies and Design Project. Framework for the Future was conducted by city staff, and de- veloped out of a recommendation from Future -Little Rock, the city's early'90s goals -setting project. The plans have different focus- es but a common goal: to revitalize Little Rock's urban core. - According to Urban Studies and Design Project Director - George Wittenberg, planners and Down- town Partnership members will meet in coming weeks to go over the vision plans and make sure they correspond appropriately with the proposed zoning rules. The Six Bridges Plan, the Corridor Study, and the Downtown Framework Plan, all address general guidelines for development and present an outline of the optimum way for the city to develop. After studying these three vision plans for the last sixty days, The Partnership in its regularly scheduled board meeting last week, voted unanimously to approve these conceptual plans and recommend adoption by the City of Little Rock. We believe the next step in implementing these vision plans, is the adoption of zoning ordinances and regulations which reflect the direction of these plans with specific zoning requirements to accomplish these objectives. The Partnership Executive Committee in Joint session with the Physical Planning Committee has met twice to discuss the zoning ordinance presented by the City of Little Rock planning staff. After our meeting this past Monday, I was hopeful I could send you a list of changes we recommend for the zoning ordinance, and then recommend approval of the ordinance with these changes. However, after much in-depth discussion with representatives of the City, the Donaghey Project for Urban Studies, and The Downtown Partnership, it has become clear there are few areas of concern in the zoning ordinance that we would like to discuss in more detail. 101 South Main, Little Rock, Arkansas 72201 PHONE (501) 375-0121 FAX (501) 375-1377 To this end The Downtown Partnership Executive Committee and Physical Planning committee made several recommendations today which they are asking you to consider. We would like to divide the work effort into two phases: l . An immediate phase to solve the remaining differences in the current zoning ordinance. 2. A future phase to consider issues of urban design which may require further considerations of changes to the zoning ordnance or be resolved through new design overlay districts for key areas of the Downtown. In the first phase, we will to address only the following issues from the proposed zoning ordinance in the immediate phase within a tight schedule to meet your goal of adoption soon: • Street trees • The 5 foot build -to line • Parking • Percentage of transparency in a wall • Maximum height requirements • Coordination of corridor street designations • Architecturally significant and historic structures In the second phase, we will address the following issues as future recommendations: ■ Minimum height requirements • Overhead skywalks ■ Underground utilities and street lights • Financial incentives (i.e. tax abatement) I know you and the Planning Commission have spent a great amount of time on the zoning ordinance, and you would like to bring this to a resolution as soon as possible. We will commit to you to have a series of four meetings in December and early January, to include the Planning Commission and Hugh Earnest in the discussions, or make a special presentation to the Planning Commission if you think necessary. By the last week of January we will have a final copy of our proposed changes incorporated into the ordinance ready for Board adoption. I understand your feelings concerning major changes in the ordinance and the possible necessity of these changes needing to be discussed again by citizen groups. We feel as though we are expanding on the input you have already received, and hopefully you will feel comfortable that new citizen discussions are not necessary. We will, however, do whatever you believe is the best way to proceed in this area. It is not our goal to make substantive changes in the ordinance. The Downtown Partnership respectively requests you do two things regarding these vision plans and zoning documents. First, we would like you to proceed with a resolution for adoption of the Vision Plans at the December 7th City Board meeting. Build -to -line — means the line where the exterior facade of a building is to be located. SECTION—. URBAN USE DISTRICT (a) General Purpose and Intent. The Urban Use district established by this chapter is designed to assure the continuation of development consistent with a traditional urban form. The Urban Use district is designed to help create a compact, dense, distinguishable core area. The district is established in order to provide for an urban form allowing mid -rise and high rise structures. This District is to provide for the office, civic and business core of the City. Structures within the Urban Use district are encouraged to provide multiple uses within the same structure. The ground or street level of structures should include street oriented activity and pedestrian amenities. The resulting area is to be pedestrian `urban' oriented. (b) Application of Regulations. The regulations of this District shall apply to new development, redevelopment, expansion of existing development or exterior modifications. Routine repairs and maintenance shall not require compliance with this section. Except for construction of improvements in the public right of way required by the City, and redevelopment or expansion of existing development, all uses, structures or lots which existed on the effective date of this section which do not conform to the standards and guidelines established in this section, shall be treated as nonconforming according to the provisions of Article III of this chapter. (c) Development Criteria. (1) Any lighting shall be placed so as to reflect light away from adjacent residential structures. No excessive or unusual noise, odor or vibration shall be emitted so that it constitutes a nuisance which substantially exceeds that general level of noise, odor or vibration emitted by uses adjacent to or immediately surrounding the site. Such comparisons shall be made at the boundary of the site. (2) All trash receptacles and pickup shall be oriented away from the street side of the property and screened from the public right-of-way. Trash receptacles shall be placed in alleys if alleys are available. (3) No drive-in, drive -through facilities may be visible from the public right-of- way or take direct access from the street. (4) Curb cuts. No more than one curb cut per block face is permitted. (5) Intersection radii. Primary building materials shall be wood, masonry, or glass. (7) Landscaping a. All vehicular use areas and public right-of-way shall be in compliance with chapter 15, article IV. b. Street trees shall be a minimum 3" caliper trees. The trees shall be located 2'-0" off back of curb end shall be 30' - 0" on center with a water source provided. The "ree canopy shall be maintained at least 8 feet above the sidewalk. c. Unless otherwise approved, the planter well shall have placed at its base a six (6) inch thick section of approximately one (1) inch gravel with filter fabric laid on top to assist with drainage. (8) Sidewalks. a. Sidewalks shall consist of a minimum 5 foot concrete walk and 2 to 4 foot strip along the road (between the curb and sidewalk). Entrances shall be designed so that the door will not swing beyond the property line. (10)Street-level floor. The ground -level (street fronting) floor of non- residential structures shall have a minimum of 60 percent and a maximum of 85 percent transparent or window display. If at least 50 percent of the street -level office and retail space has direct access to the street, the total building square footage may be increased with additional floor(s) at a rate of 2 square feet for each one square foot of leasable space directly accessible to the street. Objects shall not project from the building facade over the public right of way except for awnings and balconies. b. Awnings shall not project more than 5'-0" from the building facade and have a minimum clearance of 9'-0" above the sidewalk. c. Balconies over the public right of way shall have a minimum clearance of 9'-0" above the sidewalk. The maximum projection shall be 4'0". (12) Parking requirements. No off-street parking shall be required. a. Parking structures. The ground or street -level of a parking structure shall have at least 50 percent of the street -level structure frontage (exclusive of entrance driveways, stairways and pedestrian entryways) for active use other than parking, such as offices, light retail, personal services and entertainment. The structure may be constructed without these alternative uses as long as the first level of the structure has a height of 12 feet to allow for a retrofit adding them in the future. If the parking structure includes the alternative uses at the time of initial construction, then the related structure may add one story in height. In addition, the maximum area devoted to signage may be doubled. b. Parking lots. Surface parking is to be located behind or adjacent to a structure, never in the front yard. Commercial surface parking lots shall not exceed eleven percent of the land area within this District. (13) Signs. Off -premise, pole, and monument signs are not allowed; otherwise, permitted signs shall be as in Section 36-553 "Signs permitted in institutional and office zones" of the Zoning Ordinance. (d) Use Regulations (1) Permitted Uses. Uses permitted shall include all those allowed in the Residential Districts, Office Districts and Commercial Districts as 'permitted uses', Chapter 36 code -of Ord+rakes. Except that, all uses must be inside or enclosed. Within the front setback where an integral accessory use is provided, the accessory use area need not be totally enclosed. (2) Conditional uses. Conditional uses shall include those allowed in the Light Industrial `1-2' District as 'permitted uses', Chapter 36 cede-ef &_ vrdkvaff@es. Except that all uses must be inside or enclosed. (e) Height regulations. No building hereafter erected or structurally altered shall exceed a height of three (3) stories or 45 feet, whichever is less. Developments which provide a minimum 20 percent of the gross floor area for residential uses are entitled to a maximum height of five (5) stories or 75 feet, whichever is less. Any structure which is certified by CATA (Central Arkansas Transit Authority) as providing a portion of the structure for mass transit (such as a bus stop, etc.) is entitled to one bonus floor. All building height bonuses are cumulative. For those structures in the area bounded by Markham Street on the north, 8th street on the south, Scott Street on the east, and Broadway Street on the west, building height shall be controlled by the Airport Building Height Ordinance (Ordinance No. 14613) — Code of Ordinances 7-57. (t) Area regulations. (1) Front yard. Five foot build to line. If there is an adjacent structure which is closer than five feet, then the new structure may be built using the line of the pre-existing structure. A development with an integral accessory outdoor activity to an interior use may increase the setback (build -to line) to 20 feet. Along Capitol Avenue, west of Broadway Street and east of Scott Street, the front building line shall be 25 feet. Along Chester Street from 1-630 to La Harpe Boulevard the front building line shall be 10 feet. In no case is the storage or parking of vehicles allowed in the front setback. (2)' Rear yard. No setback required except adjacent to single family detached structures which will have rear yards of not less than twenty- five (25) feet. (3) Side yard. It is intended for single family use with conversions to two family units or the addition of accessory residential units. The R-4A district should be located in developed areas of the city where an environment suitable for moderate -density residential (use) and in an established medium -density residential areas where densification may facilitate their continuation as desirable residential areas. Accessory uses, conditional uses and home occupations are permitted as long as they do not have objectionable characteristics and are not unduly concentrated in the area. These uses must otherwise conform to the provisions of this chapter and be compatible with the character of the neighborhood. The district is intended to be an urban low to moderate -density residential area, where an occasional nonresidential use adds to the overall character of the neighborhood. (b) Use Regulations. (1) Permitted uses. Permitted uses are single-family and two-family residences. (2) Other uses. Accessory, home occupation, temporary, special and conditional uses allowed within the R-4A low -density residential district shall be the same as those in the R-1, R-2, R-3 single-family districts. In addition any by -right uses within the C-1 neighborhood commercial district may be allowed as conditional uses in R-4A as specifically approved by the Planning Commission. These uses must follow the development criteria listed under C-1 neighborhood commercial and have a traditional design consistent with the neighborhood. (3) Within the area bounded by Capitol Avenue on the north, 9th street on the south, 1-30 on the east, and Scott Street on the west, Multi -family use, as defined by R-5 urban residential district shall be a permitted use. MIXED USE DISTRICTS Sec. . General Purpose. The mixed use districts established by this chapter are designed to assure the continuation of development consistent with traditional urban form to help create a compact, dense, distinguishable core area with appropriate uses. Structures within the mixed use district are encouraged to provide multiple uses within the same structure. Sec. . Districts. The "MX" mixed use district is hereby subdivided into two (2) subordinate districts which are known as: (1) MX-L mixed use low intensity (2) MX-H mixed use high intensity Sec. . General District Restrictions. (1) Any lighting shall be placed so as to reflect light away from adjacent residential structures. No excessive or unusual noise, odor or vibration shall be emitted so that it constitutes a nuisance which substantially exceeds that general level of noise, odor or vibration emitted by uses adjacent to or immediately surrounding the site. Such comparisons shall be made at the boundary of the site. (2) All trash receptacles and pickup shall be oriented away from the street side of the property and adequately screened from residential uses. Trash receptacles shall be placed in alleys if alleys are available. (3) Landscaping. (a) Landscaping of all on site vehicular use areas and public right-of-way shall be in compliance with chapter 15, article IV. (b) Street trees shall be a minimum 3" caliper trees. The trees shall be located 2'-0" off back of curb and shall be 30' - 0" on center. (c) A water source shall be provided every fifty feet. (d) Unless otherwise provided for, the planter well shall have placed at its base a six (6) inch thick section of approximately one (1) inch gravel with filter fabric laid on top to assist with drainage. (4) Sidewalks. (a) Sidewalks shall consist of 7'-6" concrete walk and 4'-0" paving -planting strip. Sidewalks shall provide a minimum 6 foot clearance for ease of pedestrian traffic and movement. (b) Sidewalk sales and daily display that is stored inside the principal business building during non -business hours, shall be allowed. However, these activities shall not obstruct pedestrian movement, fire lanes or areas designated for access by the physically impaired. (5) Building orientation. Buildings must be oriented to the street. The Main entrance shall be on the Street, not an alley, etc. (6) Street -level floor. The street -level floor on non-residential structures shall have a minimum of 60 percent and a maximum of 85 percent transparent or window display. (7) Area regulations. (a) Front yard. All non-residential buildings must be constructed to the property line unless a public plaza or greenspace is included in the design of the site in which case the building line must begin at the edge of the public plaza or greenspace. Residential buildings may have a maximum front yard setback of 25 feet. No parking or wheeled vehicles shall be allowed within this front yard setback. (b) Rear yard. No setback required except for residential uses which will have a rear yard of not less than 25 feet. (c) Side yard. No setback required except for residential uses which will have interior side yards of not less than four (4) feet for walls having a window(s). (8) The construction of additional motor vehicle service structures, drive-in, dirvie-thru buildings in this district is prohibited. (9) Parking structures and lots. The street -level of a parking structure must have leaseable store fronts or an appropriate activity use. Parking lots must have a false facade at any property line abutting a street. (10) Signs. Off -premise pole and monument signs are not allowed. Permitted signs shall be as in Section 36-553 "Signs permitted in institutional and office zones" of the Zoning Ordinance. (11) Building materials. Facades of structures must be wood, masonry, or glass. (12) Curb cuts. No more than one curb cut per block face is permitted. (13) Intersection radii. All curb and gutters at street intersections shall be 25 feet measured at the back of curb and shall align with the outside dimensions required for traffic lanes as recommended by the City Engineer. (14) Projections. (a) Objects shall not project from the building facade over the public right of way except for awnings and balconies. (b) Awnings shall not project more than 5'-0" from the building facade and have a minimum clearance of 9'-0" above the sidewalk. (c) Balconies over the public right of way shall have a minimum clearance of 9'-0" above the sidewalk. One inch of projection is permitted for each additional inch of clearance above 8'-0", provided that no such projection shall exceed a distance of 4'-0". Sec. . MX-L Mixed Use Low Intensity. (a) Purpose and intent. The MX-L district is established in order to provide for an urban form with structures of a moderate height (3 to 6 stories). This District is to provide an area where dissimilar uses may exist and support the vitality of the area. The resulting area is more pedestrian `urban' oriented. (b) Use regulations. none (c) Height regulations. No building hereafter erected or structurally altered shall exceed a height of three (3) stories or 45 feet, whichever is less. Developments which qualify as a Planned Zoning Development (PZD) and provide a minimum 20 percent of the gross floor area for residential uses are entitled to a maximum height of five (5) stories or 75 feet, whichever is less. Any structure which incorporates mass transit is entitled to one bonus floor. (d) Parking requirements. The maximum allowed off-street parking shall be 0.5 of the amount required by Sec. 36-502. The parking requirements of two or more uses in the same or adjacent structures may be combined in one adjacent shared parking facility. Sec. . MX-H Mixed Use High Intensity. (a) Purpose and intent. Modify language related to the "no new drive-in/drive-through facility", so as not to allow them on `Primary Streets' (but allow other places). 3. Clarify that street trees are a requirement. 4. Change the transparency requirement back to 60 percent. 5. Require activities other than parking or a building fagade on the first floor of parking decks along `Primary Streets'. (No requirements on other streets) 6. Change the base building height from 3 to 5 stories, with the "skyscraper zone" from 2nd to 91h/Scott to Broadway. v 7. Change the front build -to line from 5 feet to zero feet, and remove the "Integral Accessory Use" option.
