2 AN ORDINANCE TO EXPAND THE BOARD OF COMMISSIONERS FOR
3 THE YORKWOOD RECREATIONAL IMPROVEMENT DISTRICT NO. 3
4 OF PULASKI COUNTY, ARKANSAS FROM THREE (3) TO SEVEN (7)
5 MEMBERS; TO PROVIDE FOR THE APPOINTMENT OF FOUR (4)
6 ADDITIONAL COMMISSIONERS;AND FOR OTHER PURPOSES.

9 WHEREAS,the Yorkwood Recreational Improvement District No. 3 ("the District")was created
10 originally as a Pulaski County Improvement District;however,it is now located within the corporate limits
11 of the City of Little Rock,Arkansas("the City"), and legislative actions must be taken by the Little Rock
12 Board of Directors;and,
13 WHEREAS, Arkansas Code § 14-88-301(aX1XA)(iiXa)(1) provides that the number of
14 commissioners for an improvement district may be increased from three(3)to five(5)or seven(7)members
15 by ordinance of the city or town council;and,
16 WHEREAS, the District currently operates with only two (2) commissioners following recent
17 resignations, creating potential governance challenges and limiting the District's ability to conduct official
18 business and achieve proper quorum;and,
19 WHEREAS, the District encompasses approximately 158 properties with 155 unique ownership
20 names, representing a substantial residential community that requires adequate representation in District
21 governance;and,
22 WHEREAS, the current two-member board structure provides inadequate representation for the
23 District's 158 properties, with each commissioner representing approximately 79 properties, which limits
24 meaningful community input into District decisions;and,
25 WHEREAS, expanding the Board of Commissioners to seven (7) members will provide the
26 residents of the Yorkwood community with significantly enhanced representation, reducing the ratio to
27 approximately 23 properties per commissioner and ensuring more robust community participation in
28 District governance;and,
29 WHEREAS, a larger board will enhance the democratic process by allowing for more diverse
30 perspectives from property owners within the District and will better serve the interests of the community;
31 and,

1 WHEREAS, expanding the board will ensure the District can effectively address ongoing
2 community concerns, including the management and maintenance of recreational facilities and
3 infrastructure within the District; and,
4 WHEREAS,pursuant to Arkansas Code§ 14-88-301(a)(1)(AXiv)(a),the city council shall appoint
5 owners of real property in the district as commissioners.
6 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
7 CITY OF LITTLE ROCK,ARKANSAS:
8 Section 1. Board Expansion. The Board of Commissioners for the Yorkwood Recreational
9 Improvement District No. 3 is hereby expanded from three (3) members to seven (7) members, effective
10 upon passage of this ordinance.
11 Section 2.Additional Appointments.Four(4)additional commissioners shall be appointed by the
12 Little Rock Board of Directors to serve on the expanded Board of Commissioners.All appointees must be
13 owners of real property within the District as required by Arkansas Code § 14-88-301(a)(1)(A)(i).
14 Section 3.Terms of Office.The terms of office for the four(4)additional commissioners shall be
15 staggered as follows:
16 a)Two(2)commissioners shall serve initial terms of three(3)years;
17 b)Two(2)commissioners shall serve initial terms of six(6)years;
18 c)All subsequent terms shall be six(6)years as provided by Arkansas law.
19 Section 4.Board Operations.All actions by the Board of Commissioners shall require a majority
20 vote of the membership of the board as required by Arkansas Code § 14-88-301(b)(1), meaning that four
21 (4)affirmative votes shall be required for any official action.
22 Section 5. Appointment Process. The Little Rock Board of Directors shall make the four (4)
23 additional appointments within sixty(60) days of the effective date of this ordinance to ensure continuity
24 of District operations and governance.
25 Section 6. Statutory Authority. This ordinance is enacted pursuant to the authority granted to
26 municipalities under Arkansas Code § 14-88-301(a)(1)(A)(ii)(a)(1) and other applicable provisions of
27 Arkansas law governing municipal improvement districts.
28 Section 7.Severability. In the event any title, section,paragraph, item, sentence,clause,phrase,or
29 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
30 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
31 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
32 ordinance.
33 Section 8. Repealer.All laws, ordinances, resolutions, or parts of the same, that are inconsistent
34 with the provisions of this ordinance, are hereby repealed to the extent of such inconsistency.

1 Section 9. Emergency Clause. It appearing that the District currently operates with insufficient
2 commissioners to conduct regular business and that the expansion of the board is necessary for proper
3 governance and to address ongoing community concerns,an emergency is hereby declared to exist,and this
4 ordinance shall be in full force and effect from and after its passage and approval.
