Z-6096-C BY: DANA CARNEY, ZONING AND SUBDIVISION MANAGER�C�`�'� DATE: DECEMBER 22, 2005 On this date the Subdivision Committee of the Little Rock Planning Commission reviewed a modification to the approved site plan fro the Chenal Valley Montessori School located at 15717 Taylor Loop Road. Engineer Joe White was present representing the school. Staff presented the plan which shows removing any development out of the "Nettles' tract." Mr. White explained that although the school still has a long-term lease on the tract and will likely pursue legal action to obtain possession of the tract, it was desirous to remove the driveway out of the tract. Public Works staff stated they had approved the proposed new location for the driveway. Dear Ms. Wood: Please accept this letter as our request under Ark. Code Ann. Sec. 14-56-425 and Arkansas Inferior Court Rule 9 for you to prepare and certify the record of the captioned case. With this letter and the simultaneous filing of an appeal of the captioned to Circuit Court, it was not practical to make this request earlier. The Little Rock Planning Commission's approval of the Conditional Use Permit occurred on March 17, 2005. The subsequent appeal to the Little Rock Board of Directors, whereby the Board upheld the approval decision of the Planning Commission, was heard on June 7, 2005. Please advise as to the charges for this preparation and we will deliver to the city a check in that amount. I will only be able to certify to the transcribed and approved minutes of the Little Rock Board of Directors Meeting held on June 7, 2005 at 6:00 PM. I am in the process of transcribing those minutes, and hope to have them completed in the next several days. They will be on the August 1, 2005 Board of Directors Meeting for approval. Once they are approved by the Board of Directors, I will be able to copy and certify the transcribed minute record of that meeting. There is not a charge for this service. This small section of land is legally referred to as Tract 2. A current search of the Pulaski County tax records shows that Mr. Nettles does not own any property on Taylor Loop Road. This includes the house at 15808 Taylor Loop Road in which he lives with a Mrs. Shirley Dyer who is listed as the owner on the tax records. On the enclosed documents dated December 12, 1998, the Tract 2 section of land was leased to the school for a period of twenty years for a payment of $250.00. In addition the lease states that if the land transfers ownership during this period it is to be sold to the school for a payment of $25,00. (note- Tract two is part of a larger parcel of land on the other side of Taylor Loop Road on which the residence of the owner was located — a Mr. Paul McGuire.) On Oct 13, 1998, and recorded on November 6, 2000, Mr. McGuire sold the land to a Ms. Monica Mayo. The house is located at 15706 Taylor Loop Road. No attempt has been made by Ms. Mayo to sell Tract 2 to the school as specified by the lease document signed by Mr. McGuire and the school. This agreement was signed by both parties, notarized and recorded at the Pulaski County Court House. It may be that we will have to seek legal remedy to force Ms. Mayo to sell the property to the school. This is an option that we have tried to avoid. Be that as it may, we feel that Mr. Nettles has been untruthful to the Little Rock Zoning Committee in claiming that he owns Tract 2 and lieu of his deception we feel that the school should be allowed a building permit without further delay. At this time, he is not represented by an attorney. I have reviewed the file you sent me and compared it with the allegations in the complaint. His allegations of wrongdoing are as follows: 1. The City/Commission failed to require that the school fully comply with LRC § 36-103, which sets out the submission requirements for a CUP application. Specifically, he alleges that this is due to the fact that the City did not demand that the school furnish 18 recent surveys "with a site plan revealing how structures would sit on a proposed site." Para. 26; 2. The approval of the amended CUP "was based on factors not in keeping with those of legitimate health, safety and welfare concerns." Para. 22; 3. The approval of the CUP was "based on blatant non-factual and erroneous information in which Plaintiff's were not given an opportunity to correct." Para. 23; 4. When the Board met on June 7 to consider a resolution overturning the Planning Commission's decision to grant the amended CUP, the Board deviated from its normal procedure by limiting opponents to 10 minutes to present their opposition rather than the customary 20 minutes. Para. 24; 5. The Pennwyck subdivision bill of assurance had not been permitted to allow a commercial business on Lot 1. Para. 25; 6. The City/ Commission had full knowledge that the school did not own certain perimeter parcels of property which would have been required to complete the necessary dedication requirements. I None Approval of the Conditional Use Permit; Denial of the Resolution The Planning Commission reviewed this issue at its March 17, 2005 meeting. There were three objectors and one supporter present. The Commission voted to approve the application by a vote of 6 ayes, 2 noes, 2 absent and 1 abstaining (Floyd). All owners of property located within 200 feet of the site, all residents within 300 feet who could be identified and the Westerchester-Heatherbrae, Westbury and Secluded Hills Neighborhood Associations were notified of this request. The Chenal Valley Montessori School is located on the R-2 zoned property at 15717 Taylor Loop Road. On March 14, 1996, a conditional use permit was approved to allow for construction of a 1,620 square foot, residential -style building and a 13-space parking lot. The school was to have an enrollment of 30 students. BACKGROUND CONTINUED On April 30, 1998, a revision to the C.U.P. was approved to allow for expansion of the student enrollment to 48 students. The second floor of the existing building was finished -out to accommodate an office and two classrooms. No other changes were proposed. On June 22, 2000, the Commission denied a revised C.U.P. to allow for construction of a two-story building on the site, which was to contain a gymnasium and 4 classrooms. Also included was the addition of 4 parking spaces and expanding the enrollment to 98 children. The applicant appealed the denial to the Board of Directors. Prior to the Board hearing, the proposal was modified slightly in that the building was reduced in scale. On August 15, 2000, the Board voted to return the item to the Planning Commission. On September 14, 2000, the Commission approved the modified C.U.P. The opponents then appealed the decision to the Board. On November 8, 2000, the Board passed Resolution No. 10,925 which rescinded the Commission's approval, at the applicant's request. On October 3, 2002, the Commission denied a C.U.P. which would have allowed for the development of a new Montessori School on nearby Forest Lane to replace this campus. The new, 5-acre campus was to include 3 buildings, 31 parking spaces and an enrollment of 110 students. The applicant appealed the denial to the Board. Again, the proposal was modified prior to the Board meeting. On January 21, 2003, the Board voted to return the item to the Planning Commission. On February 20, 2003, the Commission approved the C.U.P. There was no appeal. The applicant subsequently determined it was too expensive to build the Forest Lane School. The applicant now proposes to construct a second building on this Taylor Loop Road site. The proposed building will be one- story in height and will be built in a residential style with brick and vinyl siding and a pitched, shingled roof. The building will contain two classrooms, an activity room and a school office. The building will be 3,000 square feet in area. Associated with the new building is an expanded parking lot and drop-off area. The school currently has an enrollment of 80 children. Forty- five are located at this site and 35 are located in rooms at the nearby Central Baptist Church. The applicant proposes to consolidate the school to this site and to cease using the church. No increase in the school's enrollment above 80 children is proposed. 2 BACKGROUND CONTINUED On March 17, 2005, the Commission voted to approve the revised C.U.P. MOORE, CITY MANAGE SUBJECT: CHENAL VALLEY MONTESSORI SCHOOL DATE: JUNE 3, 2005 The request was made at the May 31, 2005, Board of Directors Agenda Meeting for staff to provide documents of past Board presentations regarding the Chenal Valley Montessori School, 15717 Taylor Loop Road, which is presently zoned R- 2 Single Family. On March 14, 1996, a Conditional Use Permit (C.U.P.) was approved to allow for the construction of a 1,620 square foot, residential -style building and a thirteen (13)-space parking lot. At the time of approval, the school was to have an enrollment of thirty (30) students. On April 30, 1998, a revision to the C.U.P. was approved to allow for the expansion of student enrollment to forty-eight (48) students. The second floor of the existing building was finished -out to accommodate an office and two (2) classrooms; however, no other changes were proposed at that time. On June 22, 2000, the Little Rock Planning Commission denied a revised C.U.P. to allow for the construction of a two (2)-story building on the site, which was to contain a gymnasium and four (4) classrooms. Also included was the addition of four (4) parking spaces and the expansion of the school's enrollment to ninety- eight (98) children. The applicant appealed the Planning Commission's denial to the Little Rock City Board of Directors; however, prior to the Board hearing, the proposal was modified slightly reducing the building in scale, and on August 15, 2000, the Board voted to return the item to the Planning Commission. On September 14, 2000, the Commission approved the modified C.U.P.; however, opponents of the project appealed the decision to the Board of Directors. On November 8, 2000, at the applicant's request, the Board passed Resolution No. 10,925, which rescinded the Planning Commission's approval. On October 3, 2002, the Planning Commission denied a C.U.P., which would have allowed for the development of a new Montessori School on nearby Forest Lane to replace the existing campus. The new, five (5)-acre campus was to City Of Little Rock, Arkansas include three (3) buildings, thirty-one (31) parking spaces and an enrollment of 110 students. The applicant appealed the denial to the Board of Directors, and again, the proposal was modified prior to the Board Meeting. On January 21, 2003, the Board voted to return the item to the Planning Commission. The Planning Commission approved the C.U.P. on February 20, 2003, and there was no appeal at that time; however, the applicant subsequently determined that it was too expensive to build the Forest Lane School. The present proposal is for the construction of a second building, which will be one (1)-story in height and will be built in a residential style with brick and vinyl siding and a pitched, shingled roof, on the Taylor Loop Road site. The proposed building, which will be 3,000 square feet in area, is to contain two (2) classrooms, an activity room and a school office. In addition, an expanded parking lot and drop-off area is to be included with the building. The school currently has an enrollment of eighty (80) children, with forty-five (45) located at this site and an additional thirty-five (35) located at nearby Central Baptist Church. The applicant proposes to consolidate the school to the Taylor Loop site and cease utilizing the church; however, no increase in the school's enrollment above eighty (80) children is proposed at this time.
