HomeMy WebLinkAboutZ-7164 Map 4Extraterritorial Zoning Area .: Intent to Zone EXTRATERRITORIAL ZONING CITY OF LITTLE ROCK LITTLE ROCK, ARKANSAS Department of Planning and Development 723 West Markham Little Rock, Arkansas 72201 501-371-4790 EXTRATERRITORIAL ZONING AUTHORITY • Established by Arkansas Code Annotated 14-56-413, 415-421 • Gives the City of Little Rock a 3 mile jurisdiction from its city limits JURISDICTION Extraterritorial subdivision authority used since 1957 Extraterritorial zoning used since 1978 * Boundaries drawn in western and southeastern Pulaski County in 1988 Currently exercising extraterritorial zoning in a 12.5 mile area outside the City of Little Rock Most Recent uses of extraterritorial authority in: 1984 East River Area 1986 Chenal Valley 1988 Highway 10 Area 1994 Added Garrison Road Area (subdivision regulations only) Extraterritorial Zoning: 1990 Northwest Area (north of Denny Road) 1991 Southwest Area (south of Denny Road) 1999 College Station RESULTS * Prevented an industrial use from going into a residential area No apparent problems from land owners * City has received numerous requests from property owners to zone in their area to protect their property rights ZONING PROCESS The city will rezone the land R-2 (Single Family) and other zoning districts based upon the adopted land use plan. Landowners will have an opportunity to request zoning other than R-2. EXTRATERRITORIAL ZONING DOES NOT ANNEX YOUR PROPERTY TO THE CITY OF LITTLE ROCK OR TAKE AWAY YOUR PROPERTY. ADVANTAGES • Protects residential property values Gives prospective land purchaser an idea of what will be built in the vicinity Prevents non -single family uses from being located in a predominantly single family area Security of knowing a junkyard will not spring up next to your house overnight Gives landowners a voice in what happens in their area through zoning public hearings * Requires reasonable development standards for non -single family uses such as lot sizes, building height, buffers, setback, and parking WHAT IS INVOLVED BEFORE YOU BUILD • Zoning clearance is required prior to construction of any new structure. Staff will review placement of any structure and use for compliance with zoning ordinance requirements. • Building permits are not required outside the city limits. Plumbing Codes, HVAC Codes and Natural Gas Codes are enforced if you are connected to Central Arkansas Water. HOW TO GET YOUR LAND ZONED (OTHER THAN R-2 SINGLE FAMILY) If you want to zone your existing business or vacant land to some other category other than R-2, file an application with the City and proceed through the Planning Commission and Board of Directors. Existing businesses that do not rezone will be classified non -conforming structures and will be permitted to continue in operation as is as long as they do not expand their buildings or change their use.
