(1) Waiver of 40' setback from I-430.
A. EXISTING CONDITIONS
The land involved can mainly be described as wooded,
with gentle slopes. It is bounded by I-430 on the
west and Natural Resources Drive (State Highway #k846)
on the east. The latter currently serves as access to
the site.
B.- DEVELOPMENT PROPOSAL
This plan involves the division of 3.2931 acres into
five lots for office use. The applicant is requesting
that two variances be granted. One, a waiver of a 40'
setback from Interstate 430 in favor of a 25' setback
is requested because there is presently about 100' from
the roadway to the existing R/W line. The owner feels
that there will not be any change in the Interstate.
The other involves a waiver of a 45' setback on the
proposed cul-de-sac and on Natal Resources --Dr ive.
This is requested because of the developer's intent to
have a landscaped green area bordering the streets.

2. Conformance to Ordinance
The proposal does not conform to the requirement
of a 40' setback from I-430.
C. ENGINEERING CONSIDERATIONS
(1) Drainage Plan not received as part of preliminary
plat review.
(2) Provide sidewalks on both sides of street.
D. ANALYSIS
Staff has no major concerns regarding the design of
this proposal. We. are suggesting; however, that (1)
40' landscaped buffers be provided on the north and
south; (2) all lots within this development be included
on one final plat; (3) the applicant provide Staff with
evidence of permission to tie a street onto a State
Highway. As for variances, Staff views the
justification submitted for a waiver of a 40' setback
along the Interstate as inadequate and a waiver of the
second mentioned is not needed because the requirement
is only 25'.
E. STAFF RECOMMENDATION
Approval, subject to comments made.
SUBDIVISION COMMITTEE RECOMMENDATION:
Approval of the plat and variance as requested, the
following information to be added to the plat:
The 40' buffers on the north and south property lines to be
reflected on the plat and noted as permitting only 15' usage
as drives or parking. All other building lines to be 25
fee.t. The 25' buffer on the north, west and south is to be '
protected in its natural ground cover state. In such
instances as sparse cover, additional plantings may be
required.
The vote: 4 ayes, 0 noes and 1 absent.
