3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK. REV. CODE
4 CHAPTER 2 ARTICLE VI, DIVISION 4, SECTION 2-242(e)(1) OF THE
5 LITTLE ROCK CODE OF ORDINANCES (1988) TO EXPEDITE THE
6 COMPLETION OF SMALL PROFESSIONAL SERVICE CONTRACTS;
7 AND FOR OTHER PURPOSES.

9 WHEREAS, the Board of Directors ("Board") of the City of Little Rock "(City') passed Little Rock
10 City,Ark. Ordinance No. 22,206 (December 6, 2022)to amend Little Rock,Ark. Rev. Code § 2-242(e)(1)
11 (1988) to authorize the Board to approve Professional Services Contracts under Fifty Thousand Dollars
12 ($50,000.00); and,
13 WHEREAS, Little Rock,Ark. Rev. Code § 2-242(e)(l) (1988) requires the City Manager to provide
14 the Mayor and Members of the Board "a list of the Professional Services Contracts that are anticipated to
15 be under Fifty Thousand Dollars($50,000.00)"each week; and,
16 WHEREAS, Little Rock, Ark. Rev. Code § 2-242(e)(1) (1988) mandates no minimum amount for
17 Professional Services Contracts that are subject to this process; and,
18 WHEREAS, Little Rock, Ark. Rev. Code § 2-243(i) (1988) waives the requirement for a review
19 committee to review statements of qualifications and delegates such duty "to the responsible department
20 head for recommendation to the city manager who shall review and approve or disapprove all professional
21 services contracts in an amount of five thousand dollars($5,000.00)or less"; and,
22 WHEREAS, in order to promote efficiency, the Board wishes to exempt Professional Services
23 Contracts in an amount of Five Thousand dollars ($5,000.00)or less from the Board review mandated by
24 Little Rock,Ark. Rev. Code § 2-243(e)(1988)as the City Manager is authorized to approve or disapprove
25 such contracts;and,
26 WHEREAS, the elimination of mandatory Board review for these small Professional Services
27 Contracts will enhance the efficiency and streamline the administration of the City's contracting procedures.
28 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
29 OF LITTLE ROCK,ARKANSAS:
30 Section 1. Little Rock,Ark. Rev. Code § 2-242(e)(1)(1988)shall be amended as follows:
31 The city manager shall provide the mayor and members of the board of directors each
32 Monday, or the first day of business if city hall is closed on a Monday for any reason,
33 fourteen (14) days before the issuance of a formal request for proposals, a list of the

1 professional services contracts that are anticipated to be over five thousand dollars
2 ($5,000.00)but under fifty thousand dollars($50,000.00)during the course of any budget
3 year
4 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
5 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
6 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
7 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
8 ordinance.
9 Section 3. Repealed All laws, ordinances,resolutions,or parts of the same that are inconsistent with
10 the provisions of this ordinance, including but not limited to Little Rock,Ark. Rev.Code § 2-242(e)(1),are
11 hereby repealed to the extent of such inconsistency.
