PRnPnSAL:
This request is in reference to a plat which was approved by the
Planning Commissin on October 13, 1981, and signed on
March 24, 1982. During Commission review, the applicant's
representative agreed, after being asked, to widen University
Avenue in excess of Ordinance requirements, from "J" Street on
the north to "H" Street. The owner was unaware of this agreement
and is now requesting that the Commission waive this condition,
since it is not mandatory by Ordinance standards. Based on past
policy, staff does not feel that the applicant should be forced
to make improvements beyond the boundaries of his property if he
does not wish to.
STAFF RECOMMENDATION:
Approval, as filed.
SUBDIVISION COMMITTEE ACTION:
Mr. Boyd Bond represented the applicant. A motion was made and
passed for approval by a vote of: 4 ayes, 0 noes and 1 absent.
PLANNING COMMISSION ACTION: (6-29-82)
The Commission failed to gain a quorum. Therefore, this matter
was deferred to a later date.
PLANNING COMMISSION ACTION: (7-13-82)
This case was set for this meeting to retire the issue inasmuch
as all research and conversation by City staff and the owner's
engineer reflect no basis for requirements as set.

The Planning staff recommends deletion of the add -on improvements
and allow only construction of additional lane in front of
subject lots, plus transition to existing pavement.
The Planning Commission accepted staff report and amended the
off -site improvements accordingly by a vote of 8 ayes, 0 noes and
3 absent.

SPECIAL REQUIREMENTS
1. Commercial/office subdivisions abutting residential
subdivisions or areas zoned for residential use shall
protect such areas from potential nuisance by providing
a minimum 40' buffer strip and a 6' fence. This plan
has requested to vary from the requirements.
2. The Planning Commercial shall require the subdivider to
file a propose subdivision phasing plan providing for
continuity of development and individual phases of
reasonable proportions. Single lot, final plats and
plats which create discontinuity within the development
may be prohibited.
3. For Commercial/Office subdivisions not greater than 20
acres in size all boundary street improvements shall be
completed in conjunction with the initial phase of the
staging plan.
4. Parking requirements for Commercial/Office uses is one
space per 300 feet of gross floor area up to 10,000
square feet.
ENGINEERING CONSIDERATIONS
(a) Concur with street waiver on Garfield Street.
(b) University Avenue should be widened for the full length
of the property.
STAFF ANALYSIS
As indicated earlier, the applicant has asked for the
following variances: (1) 25' rear yard in lieu of 45'
buffer; (2) 6' privacy fence along north 100' ; and (3)
street improvements to Garfield Street. Justification
offered is that additional land will be added to the west
prior to submission of the final plat and a street closure
will be petitioned prior to final plat. Staff is basically
in agreement with the plan as submitted. No adverse effects
from the approval of the variances requested are
anticipated. The applicant will be expected, however, to
widen University Avenue in conjunction with the first phase
and to construct the internal access easement with 24'
pavement/curb and gutter.
STAFF RECOMMENDATION
Approval, subject to Staff's and Engineering's comments.

SUBDIVISION COMMITTEE ACTION
The applicant decided to change his proposal for a site plan
to that of a two -lot preliminary plat. Thus, only one
issue, a request to reduce the rear -yard setback to 12',
contingent upon the closure of Garfield Street, remained for
discussion. City Engineering reported that the street
improvements along University would still be required, and
that a guardrail should be built along the sidewalk on
University. It was decided that the guardrail should be
built at the public's expense.
A motion was made to approve the application as modified,
subject to the required improvements. The motion passed by
a vote of 3 ayes, 0 noes and 2 absent.
PLANNING COMMISSION ACTION
The applicant was present. There were no objectors. A
motion in agreement with the Subdivision Committee's
recommendation of approval as modified subject to the
required improvements was made and passed by a vote of
7 ayes, 0 noes and 4 absent.
