OF
HICKORY CREEK SUBDIVISION - PHASE VI
PULASKI COUNTY, ARKANSAS
HICKORY CREEK JOINT VENTURE TO THE PUBLIC:
KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, Hickory Creek Joint Venture, an Arkansas Venture
("Grantor") as the owner of the following described lands lying in
Pulaski County, Arkansas, to wit:
A tract of land situated in the East 800 feet of the SE a,
SW k, Section 19, Township 2 North, Range 13 West, City of Little
Rock, Pulaski County, Arkansas, being more particularly described
as follows:
Commencing at a concrete monument at the Southeast corner of the
said SE 4, SW a; thence S86°1915911W, along the South boundary line
of Hickory Creek Subdivision - Phase V, as recorded in Plat Book D,
Page 621, Circuit Clerk Office, Pulaski County, Arkansas, 45.61
feet to the Southwest corner of said Hickory Creek Subdivision -
Phase V, also being the point of beginning; thence continuing
S86 ° 19' 59 "W, along the South line of the said East 800 feet, 754.19
feet to a 2" iron pipe at the Southwest corner of said East 800
feet; thence N01°4813211W, along the West line of said East 800
feet, 1316.36 feet to a 2" iron pipe at the Northwest corner of
said East 800 feet; thence N86°09153"E, along the North line of
said East 800 feet, 310.00 feet to the Northwest corner of Hickory
Creek Subdivision - Phase I, as recorded in Plat Book C, Page 112,
Circuit Clerk Office, Pulaski County, Arkansas; thence along the
boundary line of said Hickory Creek Subdivision - Phase I the
following courses and distances:
S34°24148"W, 28.86 feet; S27°2814111E, 228.46 feet; along a
non -tangent curve to the right, having a 261.48 foot radius,
a chord bearing and distance of N65°38113"E, 28.42 feet, for
a distance of 28.43 feet; S2101415411E, 149.61 feet;
S53°4914011W, 70.75 feet; S12°0813711W, 94.85 feet; S36°52147E",
213.28 feet to the common corner of Lot 72 of said Hickory
Creek Subdivision - Phase I and Lot 80 of Hickory Creek
Subdivision - Phase IV, as recorded in Plat Book D, Page 557,
Circuit Clerk Office, Pulaski County, Arkansas; thence leaving
said boundary line of Hickory Creek Subdivision - Phase I,
S3503210011W, along the boundary line of Hickory Creek
Subdivision - Phase IV, 81.12 feet; thence continuing along
said boundary line of Hickory Creek Subdivision - Phase IV,
the following courses and distances: S38°2115511E, 330.00 feet;
N39"44139"E, 64.84 feet;

N63"32142"E, 64.47 feet to the Northwest corner of said
Hickory Creek Subdivision - Phase V; thence leaving said
boundary line of Hickory Creek Subdivision - Phase IV,
SO101015511E, along the West line of said Hickory Creek
Subdivision - Phase V, 382.81 feet to the point of beginning;
said tract of land containing 15.873 acres (691,424 S.F.) more
or less.
which is now hereafter designated and and forever known as Hickory
Creek Subdivision - Phase VI, Little Rock, Pulaski County, Arkansas
("Hickory Creek Subdivision - Phase VI" or "Phase VI", as shown on
the plat attached hereto as Exhibit "A" and made a part of this
instrument (the "plat").
WHEREAS, the Grantor owns other land adjacent to Phase VI, a
portion of which other land is platted as Hickory Creek Subdivision
- Phase I ( "Hickory Creek Subdivision - Phase I" or "Phase I") ,
with the plat prepared by Garver and Garver Engineers, P.A.,
recorded as Document Number 87-11552, filed of record on February
18, 1987, in Plat Book C, Page 112, in the Pulaski County Circuit
Clerk's Office, and a portion of which other land is platted as
Hickory Creek Subdivision, Lot 1 ("Hickory Creek Subdivision, Lot
1" or "Lot 111), with the plat prepared by Garver and Garver
Engineers, P.A., recorded as Document Number 88-08330, filed for
record on February 24, 1988 in Plat Book C,- Page 387, in the
Pulaski County Circuit Clerk's Office, and a portion of which other
land is platted as Lots 4, 5, 6, 85, 86 and 87, Hickory Creek
Subdivision ("Lots 4, 5, 6, 85, 86 and 87, Hickory Creek
Subdivision" or "Lots 4, 5, 6, 85, 86 and 8711) with the plat
prepared by Garver and Garver Engineers, P.A. recorded as Document
Number 88-19070 filed for record on April 20, 1988, in Plat Book C,

Page 423, in the Pulaski County Circuit Clerk's Office; and a
portion of which other land is platted as Hickory Creek Subdivision
- Phase IV with the plat prepared by Garver and Garver Engineers,
P.A., recorded as Document Number 92-60352, as amended Document
Number 92-72419, filed of record on November 12, 1992 in Plat Book
D, Page 557 in the Pulaski County Circuit Clerk's Office, and a
portion of which land is platted at Hickory Creek Subdivison -
Phase V with the plat prepared by Garver and Garver Engineers,
P.A., recorded as Document Number 93-1124 filed of record on
January 6, 1993, in Plat Book D, Page 621, in the Pulaski County
Circuit Clerk's Office and as well as other land not yet platted
but all of the said Phase 1; Lot 1, Lots 4, 5, 5, 85, 86 and 87;
Phase III; Phase IV; Phase V; and the adjacent unplatted land of
the Grantor) is being developed for high -quality residential use
and is, pursuant to the hereinafter described Amended and Restated
Bill of Assurance filed February 24, 1988, as Instrument Number 88-
08282, in the Pulaski County Circuit Clerk's Office, designated and
known as Hickory Creek Subdivision, Little Rock, Pulaski County,
Arkansas, "Hickory Creek Subdivision" ("Hickory Creek
Subdivision").
WHEREAS, simultaneously with the filing of the plat for
Hickory Creek Subdivision - Phase I, the Grantor caused to be filed
a Bill of Assurance for Hickory Creek Subdivision - Phase I, also
recorded on February 19, 1987, as Instrument Number 87-11552, in
the Pulaski County Circuit Clerk's Office; and
THEREAFTER, the Grantor amended the Bill of Assurance for

Hickory Creek Subdivision - Phase I by filing an "Amended and
Restated Bill of Assurance for Hickory Creek Subdivision" on
February 24, 1988, as Instrument Number 88-08282 in the Pulaski
County Circuit Clerk's Office; and
THEREAFTER, and simultaneously with the filing of the plat for
Hickory Creek Subdivision, Lot 1, Grantor caused to be filed a Bill
of Assurance for Hickory Creek Subdivision, Lot 1, also recorded on
February 24, 1988, as Instrument Number 88-08330, in the Pulaski
County Circuit Clerk's Office; and
THEREAFTER, and simultaneously with the filing of the plat for
Lots 4, 5, 6, 85, 86 and 87 of Hickory Creek Subdivision, the
Grantor caused to be filed a Bill of Assurance for 4, 5, 6, 85, 86
and 87, Hickory Creek Subdivision, recorded on April 20, 1988, as
Instrument Number 88-19070, in the Pulaski County Circuit Clerk's
Office.
WHEREAS, it is the intent and purpose of this Bill of
Assurance to incorporate by reference and cause Hickory Creek
Subdivision - Phase VI to be bound by and subject to the Amended
and Restated Bill of Assurance of Hickory Creek Subdivision
(Pulaski County Instrument Number 88-08282) as hereafter provided.
NOW, THEREFORE, the Grantor incorporates by reference the
Amended and Restated Bill of Assurance of Hickory Creek Subdivision
(Pulaski County Instrument Number 88-08282) as the Bill of
Assurance to which Hickory Creek Subdivision - Phase VI is bound by
and subject to, the same as (a) the lots of Hickory Creek
Subdivision - Phase I, (b) Hickory Creek Subdivision, Lot 1, (c)

Lots 4, 5, 6, 85, 86 and 87, Hickory Creek Subdivision, (d) Hickory
Creek Subdivision Phase III, (e) Hickory Creek Subdivision Phase
IV, and (f) any future phases in Hickory Creek Subdivision,
including this Phase VI.
FURTHERMORE, with regard to the easements for drainage and
utilities shown on the plat filed herein with regard to Hickory
Creek Subdivision, Phase VI, the Grantor hereby donates and
dedicates the easements to, and for use by the public utilities,
the same being, without limiting the generality of the foregoing,
electric power, gas, telephone, water and sewer, with the right
hereby granted to the persons, firms, or corporations, engaged in
the supply of such utility services to use and occupy such
easements and to have free ingress and egress therefrom for the
installation, maintenance, repair and placement of such utility
service and for storm water drainage systems as the case may be;
and in addition, the plat also shows "access and utility easements"
which are for the use and benefit of public utilities as herein
above -described, and also for the use and benefit of the owners of
the lots of Hickory Creek Subdivision, and all other future phases
of Hickory Creek Subdivision to be used for ingress, egress and
regress only by said owners, their agents, licensees, tenants,
family and invitees and for drainage.
FURTHER, Hickory Creek Subdivision - Phase VI, platted by the
attached plat and any interest therein, shall be held and owned
subject to and in conformity with, the dedication, covenants,
restrictions, uses and limitations set forth in the Amended

Restated Bill of Assurance of Hickory Creek Subdivision (Pulaski
County Instrument Number 88-08282), which shall be construed to be
covenants running with the land as provided therein and shall be
binding upon the owner(s) of Hickory Creek Subdivision, Phase VI,
and his or her heirs and assigns.
