PULASKI COUNTY, ARKANSAS
HICKORY CREEK JOINT VENTURE TO THE PUBLIC:
KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, Hickory Creek Joint Venture, an Arkansas venture
("Grantor") as the owner of the following described lying in
Pulaski County, Arkansas, to wit:
A tract of land situated in the SW J, SE 1, Section 19,
Township 2 North, Range 13 West, City of Little Rock, Pulaski
County, Arkansas, being more particularly described as follows:
Commencing at a concrete monument at the Southeast corner of
the SW 11, SE 4', said Section 19; thence S 88 49'05" W along the
South line of said SW $ , SE A, 565.27 feet; thence N 01 10' 55" W
along the West line of lots 37 and 63 of Hickory Creek Subdivision
- Phase I, Little Rock, Arkansas, 395.00 feet; thence S 88 49'05"
W along South line of lots 64 and 49 of said Hickory Creek Sub-
division - Phase I, 343.8.0 feet to the point of beginning, also
being the Southwest corner of said lot 49; thence continuing S 88
49-05" W, 436.20 feet; thence S 63 32142" W, 97.65 feet; thence S

which is now and hereafter designated and forever known as Hickory
Creek Subdivision - Phase IV, Little Rock, Pulaski County,
Arkansas ("Hickory Creek Subdivision - Phase IV" or "Phase IV"),
as shown on the plat attached hereto as Exhibit "A" and made a
part of this instrument (the "plat").
WHEREAS, the Grantor owns other land adjacent to Phase IV, a
portion of which other land is platted as Hickory Creek Sub-
division - Phase I ("Hickory Creek Subdivision - Phase I" or
"Phase 1"), with the plat prepared by Garver and Garver Engineers,
P.A., recorded as Document Number 87-11552, filed of record
February 18, 1987, in Plat Book C, Page 112, in the Pulaski County
Circuit Clerk's Office, and a portion of which other land is
platted as Hickory Creek Subdivision, Lot 1 ("Hickory Creek
Subdivision, Lot 1" or "Lot 1"), with the plat prepared by Garver
and Garver Engineers, P.A., recorded as Document Number 88-08330,
filed for record February 24, 1988 in Plat Book C, Page 387, in
the Pulaski County Circuit Clerk's Office, and a portion of which
other land is platted as Lots 4, 5, 6, 85, 86 and 87, Hickory
Creek Subdivision ("Lots 4, 5, 6, 85, 86 and 87, Hickory Creek
Subdivision" or "Lots 4, 5, 6, 85, 85 and 87") with the plat
prepared by Garver and Garver Engineers, P.A. recorded as Document
Number 88-19070, filed for record April 20, 1988 in Plat Book C,
Page 423, in the Pulaski County Circuit Clerk's Office, as well as
other land not yet platted, but all of the said Phase 1, Lot 1,
Lots 4, 5, 6, 85, 86 and 87, Phase III and the adjacent unplatted
land of the Grantor is being developed for high -quality
residential use and is, pursuant to the herein after described
Amended and Restated Bill of Assurance filed February 24, 1988, as
Instrument Number 88-08282, in the Pulaski County Circuit Clerk's
Office, designated and known as Hickory Creek Subdivision, Little
Rock, Pulaski County, Arkansas "Hickory Creek Subdivision"
("Hickory Creek Subdivision").
WHEREAS, simultaneously with the filing of the plat for
Hickory Creek Subdivision - Phase I, the Grantor cause to be filed
a Bill of Assurance for Hickory Creek Subdivision - Phase I, also
recorded February 18, 1987, as Instrument Number 87-11552, in the
Pulaski County Circuit Clerk's Office; and
THEREAFTER, the Grantor amended the Bill of Assurance for
Hickory Creek Division - Phase I by filing an "Amended and Re-
stated Bill of Assurance for Hickory Creek Subdivision" on
February 24, 1988, as Instrument Number 88-08282 in the Pulaski
County Circuit Clerk's Office; and
THEREAFTER, and simultaneously with the filing of the plat
for Hickory Creek Subdivion, Lot 1, Grantor caused to be without a
Bill of Assurance for Hickory Creek Subdivision, Lot 1, also
recorded February 24, 1988, as Instrument Number 88-08330, in the
Pulaski County Circuit Clerk's Office; and
THEREAFTER, and simultaneously with the filing of the plat
for Lots 4, 5, 6, 85, 86 and 87 of Hickory Creek Subdivision, the
Grantor caused to be filed a Bill of Assurance for Lots 4, 5, 6,
85, 86 and 87, Hickory Creek Subdivision, also recorded April 20,
1988, as Instrument Number 88-19070, in the Pulaski County Circuit
Clerk's Office.
WHEREAS, it is the intent and purpose of this Bill of
Assurance to incorporate by reference and cause Hickory Creek
Subdivision - Phase IV to be bound by and subject to the Amended
and Restated Bill of Assurance of Hickory Creek Subdivision
(Pulaski County Instrument Number 88-08282) as hereafter provided.
NOW, THEREFORE, the Grantor incorporates by reference the
Amended and Restated Bill of Assurance of Hickory Creek Sub-
division (Pulaski County Instrument Number 88-08282) as the Bill
of Assurance to which Hickory Creek Subdivision - Phase IV is
bound by and subject to, the same as (a) the lots of Hickory Creek
Subdivision - Phase 1, (b) Hickory Creek Subdivision, Lot 1, (c)
Lots 4, 5, 6, 85, 86 and 87, Hickory Creek Subdivision, and (d)
the future phases in Hickory Creek Subdivision.
FURTHERMORE, with regard to the easements for drainage and
utilities shown on a plat, the Grantor hereby donates and ded-
icates the easements to, and for use by the public utilities, the
same being, without limiting the generality of the foregoing,
electric power, gas, telephone, water and sewer, with the right
hereby granted to the persons, firms, or corporations engaged in
the supply of such utility services to use and occupy such ease-
ments and to have free ingress and egress therefrom for the
installation, maintenance, repair and placement of such utility
services and for storm water drainage systems as the case may be;
and in addition, the plat also shows "access and utility ease-
ments" which are for the use and benefit of the public utilities
as herein above -described, and also for the use and benefit of the
owners of (a) the lots in Hickory Creek Subdivision, Phase I, (b)
Hickory Creek Subdivision, Lot 1, (c) , Lots 4, 5, 6, 85, 86 and
87, Hickory Creek Subdivision, and (d) the future phases in
Hickory Creek Subdivision to be used for ingress, egress and
regress only by said owners, their agents, licensees, tenants,
family and invitees and for drainage.
FURTHER, Hickory Creek Subdivision - Phase IV, platted by the
attached plat and any interest therein, shall be held and owned
subject to and in conformity with, the dedication, covenants,
restrictions, uses and limitations set forth in the Amended and
Restated Bill of Assurance of Hickory Creek Subdivision (Pulaski
County Instrument Number 88-08282), which shall be construed to be
covenants running with the land as provided therein and shall be
binding upon the owner(s) of Hickory Creek Subdivision, Phase IV,
and his or her heirs and assigns.

ACKNOWLEDGMENT
On this day, before me, a Notary Public, duly commissioned,
qualified and acting within and for the State and County afore-
said, appeared in person, Clint Boshears, who stated that he is
the General Partner of Hickory Creek Joint Venture, an Arkansas
joint venture, and was duly authorized in his respective capacity
to execute the foregoing Bill of Assurance of Hickory Creek
Subdivision -Phase IV, Pulaski County, Arkansas, for and in the
name and on behalf of said joint venture; and further stated that
he had so signed, executed and delivered said instrument for the
consideration, used and purposes therein mentioned and set forth.
