(GRANTOR), an Arkansas limited liability company, being the owner of Lot 4, Corporate Hill Subdivision and a portion of Lot 1, Ensco Parkhill; and ENSCO, INC., an Arkansas corporation, being the owner of the remaining portion of Lot 1, Ensco Parkhill, together desire to replat the said two lots to coincide with their present ownerships; and WHEREAS: In order to facilitate the sale of the aforementioned portion of Lot 1, Ensco Parkhill from ENSCO, INC. to LILAC L.L.C., the City of Little Rock allowed the plat of Lot 4R, Corporate Hill Subdivision and Lot I Ensco Parkhill to be filed without the state plane coordinates shown for property boundary corners, with the stipulation that the state plane coordinates be fiirnished at a later time; and WHEREAS: LILAC L.L.C. filed the said plat of Lot 4R, Corporate Hill Subdivision and Lot 1R, Ensco Parkhill, recorded as Instrument Number 94-80717 on November 22, 1994; and WHEREAS: The state plane coordinates of the property boundary corners have now been determined, and pursuant to the City of Little Rock requirement to include the state plane coordinates on the said plat; NOW THEREFORE: LILAC L.L.C. and ENSCO, INC. hereby plat Lot 4R, Corporate Hill Subdivision and Lot 1R, Ensco Parkhill (being a replat of Lot 4, Corporate Hill Subdivision and Lot 1, Ensco Parkhill) in the City of Little Rock, and HMOBOA.DOC in the Southeast Quarter of the Northwest Quarter of Section 3, Township 1 North, Range 13 West; Pulaski County, Arkansas, as shown on the attached plat and henceforth description and conveyance by such designation or part thereof, as shown and represented on said attached plat, shall be a proper and sufficient description thereof. Permanent easements for drainage, for laying and maintaining sewer pipes and mains and for the installation and maintenance of utilities and for access, ingress and egress are created, excepted and reserved over, across and through said land as shown on said attached plat. Any business, trade, activity or undertaking not in keeping with the first class commercial use of said land, herein platted, and each of them, is prohibited and shall not be carried on or permitted on any part of said land; and anything deemed a nuisance or to create undue annoyances or which interferes with the first class commercial use and occupancy of said land shall be prohibited thereon. The covenants, restrictions, requirements and provisions of this instrument shall be automatically extended for successive periods of ten years each on and after January 1, 2024, unless and until amended or cancelled as authorized herein. Invalidation of any covenant, restriction, requirement or provision set forth herein or any part thereof by an order, judgment or decree of any Court or otherwise shall not invalidate or affect any of the other covenants and/or restrictions or any part thereof as set forth herein but they shall remain in full force and effect.
