HomeMy WebLinkAbout16812 1 RESOLUTION NO. 16,812 2 3 4 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO 5 EXECUTE A MEMORANDUM OF UNDERSTANDING BETWEEN 6 THE CITY OF LITTLE ROCK AND PULASKI COUNTY, 7 ARKANSAS FOR THE SOUTHWEST TRAIL,PHASE 2; AND FOR 8 OTHER PURPOSES 9 10 WHEREAS, Pulaski County, Arkansas, has secured funding to design and construct a 11 shared-use pedestrian and bicycle trail from Hilaro Springs Road to Baseline Road to be known as 12 the Southwest Trail, Phase 2;and, 13 WHEREAS,Pulaski County,Arkansas,has requested authorization and right of access to 14 construct a portion of the Southwest Trail Phase 2 across a tract of land owned by the City of Little 15 Rock surrounding the Pinewoods Subdivision; and, 16 WHEREAS, upon the granting of access onto the identified property, Pulaski County, 17 Arkansas, will commence construction of the trail and retain ownership of the trail after its 18 completion until the expiration of the maintenance bond for the construction of that portion of the 19 trail. At the expiration of the maintenance bond,Pulaski County will transfer ownership of the trail 20 to the City of Little Rock. 21 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 22 THE CITY OF LITTLE ROCK,ARKANSAS: 23 SECTION 1. The City Manager is hereby authorized to execute a memorandum of 24 agreement with Pulaski County to authorize and grant right of access to construct a portion of the 25 Southwest Trail Phase 2 across a tract of land owned by the City of Little Rock and define the 26 responsibilities of the City of Little Rock and Pulaski County in respect to transfer of ownership 27 and maintenance thereafter,the tract being more particularly described as: 28 Part of the Southwest Quarter of the Northeast Quarter and part of the Northwest 29 Quarter of the Southeast Quarter of Section 5, Township 1 South, Range 12 West, 30 Pulaski County,Arkansas,more particularly described as follows: 31 32 Commencing at the Center South Sixteenth Corner of Section 5, Township 1 33 South, Range 12 West; thence North 03°24'36" East along the West line of said 34 Northwest Quarter of the Southeast Quarter of Section 5 a distance of 349.32 feet to the [Page 1 of 2] 1 POINT OF BEGINNING; thence continue North 03°24'36" East along said West line a 2 distance of 50.05 feet to a point; thence South 89°05'30" East a distance of 98.15 feet to 3 a point; thence North 89°30'55" East a distance of 422.53 feet to a point; thence North 4 51°09'23"East a distance of 221.67 feet to a point;thence North 41°39'56"East a distance 5 of 308.14 feet to a point;thence North 08°41'41"Fast a distance of 416.81 feet to a point; 6 thence North 14°42'59" East a distance of 316.57 feet to a point;thence North 15°51'41" 7 East a distance of 40.76 feet to a point on the North line of Pinewood Subdivision as 8 recorded in Plat Book 26 Page 90; thence South 88°55'50" East along said North line a 9 distance of 51.71 feet to a point; thence leaving said North line South 15°51'41" West a 10 distance of 53.46 feet to a point; thence South 14°42'59" West a distance of 313.44 feet 11 to a point;thence South 08°41'41"West a distance of 428.98 feet to a point;thence South 12 41°39'56" West a distance of 186.52 feet to a point on the Southeast line of Pinewood 13 Subdivision as recorded in Plat Book 26 Page 90;thence along said Southeast line South 14 54°15'00" West a distance of 441.92 feet to a point; thence leaving said Southeast line 15 South 89°30'55" West a distance of 364.76 feet to a point;thence North 89°05'30" West 16 a distance of 100.94 feet to the POINT OF BEGINNING, containing 1.86 acres 17 (80,820.54 sq. ft.)more or less. 18 SECTION 2. Severabiliry. In the event any title, section, paragraph, item, sentence, 19 clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, 20 such declaration or adjudication shall not affect the remaining portions of the resolution which shall 21 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional 22 was not originally a part of the resolution. 23 SECTION 3. Repealer.
