White Edward Smith and Associates 401 Victory Little Rock, AR OWNER: T.A. Brundage 700 E. Hildebrand San Antonio, Texas 78212 REQUEST: For the encroachment of a sign into a 70' area established by a platted building line. STAFF REPORT The site is located off 65th Street in what is mainly a commercial area. It is bordered immediately to the west by the Mopac Railroad. The only use apparent on the property is a mini -warehouse business. The applicant is requesting a variance in the front setback line to allow the encroachment of a proposed sign 10' by 40' and 45' high. Staff does not feel that the applicant has offered justification enough for a variance from the requirements; however, we are willing to allow a reduction of setbacks on the west side from 30' to 151, and on 65th Street from 70' to 501. STAFF RECOMMENDATION Denial as filed. SUBDIVISION COMMITTEE ACTION: The applicant did not agree with Staff's recommendation. It was suggested by the Committee that he present justifications for the waiver to the Commission at the Public Hearing. This was passed to the Commission without recommendation. PLANNING COMMISSION ACTION: Mr. Joe White, the applicant, submitted a revised plan in which the encroachment was reduced to 51; thereby changing the request from a 25' setback to a 45' setback. Since this December 15, 1981 SUBDIVISIONS Item No. 7 was only a minor encroachment, Staff expressed support for the plan. A motion for approval was made and passed by a vote of 10 ayes, 0 noes and 1 absent.
