HomeMy WebLinkAboutS-0194-B Staff Analysis-BOARD OF DIRECTORS COMMUNICATION TO: MAYOR AND BOARD OF DIRECTORS FROM.: TOM DALTON CITY MANAGER SUBJECT: HISTORY OF THE LA QUINTA MOTOR INN PCD ON I-630 AT FAIR PARK BOULEVARD (Z-3143-A, B/194 A,B,C,) DATE: JANUARY 14, 1988 Listed below are the events of significance in the history of the La Quinta Development. ITEMS OF HISTORY to September 15, 1981 Planning Commission hearing on application to rezone from "0-3" and "R-2" to PCD for motel and office uses with accessory restaurant. - Public hearing with discussion on landscaping, screening, alley and street right-of-way abandonment, and street improvements on Tenth Street and Fair Park Boulevard. - Staff found no problem with the general layout. However, some concerns were stated: (1) buffering and screening houses to the east, (2) drainage, (3) Oak Forest Neighborhood Plan (this did not conform), and (4) saving some of the houses by moving them to other lots. Staff Recommendation: Approval subject to dealing with the four points above plus (1) widen Fair Park to 48 feet/one-half of street section, (2) external turning lane access to I-630 150 feet, (3) improve West Tenth Street to one-half of 27-foot street sections, ( 4 ) clarify use of Tyler Street along east boundary, and (5) internal drainage study. The Subdivision Committee reported from its meeting that the staff comments plus engineering comments should be a condition of approval. CITY OF LITTLE ROCK, ARKANSAS The hearing involved objectors with a petition of many signatures. Four persons spoke and 18 were present on the request .representing the neighborhood to the east. They objected to: (1) closing West Ninth Street (Maryland Street) and two blocks of_ Tyler Street from West Eighth to West Tenth Streets, (2) noise, light, and insects, (3) disruption of the view, and (4) access to homes. A lengthy discussion was held with resolution of most issues except the Tyler Street closing. The Commission voted 10 ayes and 1 no to approve the PUD application with the agreed upon amendments except that Tyler Street was not included, but that if the applicants could not work out a closure plan with the neighborhood, then the plan would be brought back to the Planning Commission on September 29. 2. September. 29, 1981 The architect presented a plan for resolution of the street issues on Tyler Street. The resolution was not accepted; therefore, the Commission acted to approve the PUD minus the Tyler Street right-of-way abandonment. The vote 8 ayes, 0 noes, and 3 absent. 3. October 20, 1.981 The application was presented to the Board of Directors at its regular meeting. The objectors and petitions were noted for the record. There were persons present for the neighborhood. The Board of Directors received direction from staff that Tyler Street could be acted upon as a part of the PUD application. The Board of Directors by Ordinance No. 14,135 approved the PUD including Tyler Street as well as the alley in the blocks and West Ninth Street. 4. November 13, 1981 The applicant filed a request for final plan and plat confirmation. These being a change in the PUD, the staff reviewed the filing, found it to be in conformance with the preliminary approval plan and ordinance with one change needing the Commission's review. The change was from two 2-story buildings to one 5-story building with less ground coverage. 5. November 19, 1981 Shortly after the filing, a .legal action was filed with Chancery Court by eight residents of the area in the form of a petition for injunction. 6. November 30, 1981 The trial began in the matter and continued to December 1, 1981. 7. December 15, 1981 The Commission reviewed the amended plan and voted unanimously to approve the modification of the office buildings plus accepting a City Engineer recommendation to reduce the width of construction on West Tenth Street from 27 feet to 24 feet. The Commission also directed that the reduced street standard recommendation be forwarded to the Chancery Court for the December 1 hearing. 8. December 1, 1981 The trial ended and the consent decree was entered upholding all of the actions of the City except the ordinance abandoning Tyler Street. The decree required specific requirements on West Tenth for two blocks east of Fair Park Boulevard, additional fencing and screening and proper drainage control. The court retained jurisdiction to assure compliance. 9. May 17, 1987 The plaintiffs filed a request with the Chancery Court for hearing on the developer's drainage plans. The court ruled that the plans as approved by the City Engineer were proper. 10. November 22, 1982 A complaint of the neighbors was filed with the court concerning the height of the fence along Tyler Street. The court had required that the fence be eight feet in height. It was found to be 4.5 feet atop the retaining wall. The court ordered the fence to be increased to eight feet and made opaque. The court retained jurisdiction. 11. January 22, 1985 The applicant filed a request with the Commission for permission to modify the office building on the -plan. The modifications were the canopies over the building entries and changing the north/south dimension of the building. The Planning Commission approved the changes and forwarded the matter to the Board of Directors for final approval. There were no objectors present. 12. February 19, 1985 The Board of Directors considered the request. There were no objectors. The Board approved the change by Ordinance No. 14,824. 13 November 9, 1987 The applicant filed an amended plan on the southwest quadrant of the block. The amendment deleted the five -story office building and requested a convenience store with gas pumps plus a general commercial building with a dry cleaning and "fun wash" operation. The staff recommendation was denial as being inconsistent with the Oak Forest Neighborhood Plan plus adverse effects on the neighborhood. The Subdivision Committee determined that the issue was not technical but land use and forwarded the matter to the full Commission on December 15, 1987. 14. December 15, 1987 The Commission held a public hearing with notice given. There were no objectors present. The Commission after debating the issue at length voted to recommend approval. RW/TD:jf1
