VARIANCE REQUESTED:
A. EXISTING CONDITIONS
(1) Allow 20' paved street from
Cease Street, north to south
property line of the
subdivision.
(2) 24' minor residential street
in -lieu of 27th Street.
The land involved is presently partially wooded, and
with gentle slopes. The sole means of access to the
property is provided by Cease Street. The site, which
is currently zoned "R-2," is mainly bordered by
residential uses. No drainage problems are apparent.
There have been no adverse comments from utilities.
B. DEVELOPMENT PROPOSAL:
This is a plan to develop an area of three acres into
10 lots for single-family use. 640' of new street is
proposed for the provision of both internal and
external access. The applicant is asking to vary from
the Ordinance by allowing Shea to be a 20' paved street
from Cease, north to the subdivision's south property
lane and a 24' minor residential street in lieu of a
27' street from the south extending to the western
property boundary. Justification for the variances
requested are stated as limited means of access to the
subdivision.

No legal problems are apparent at this time.
ENGINEERING CONSIDERATIONS
(a) Engineering recommends a minimum 40' right-of-way
to accommodate utilities; however, the proposal
appears workable if sufficient space is provided
on the west side of the entrance road for a
drainage ditch and back slope.
(b) Recommends street width be 27' rather than 24'
through the developed area.

Staff is familiar with this site, due to a prior single
family plat submitted in April of 1977, which has not
been consummated. There is no particular opposition to
the plan as submitted, but staff does suggest that
Cease Street be closely scrutinized because of a future
possibility that it will serve as major means of access
for the adjoining property to the west. As for the
variances, staff is in agreement with Engineering's
comments. Of a more technical nature, staff would like
to point out that Lot 6 varies from the Ordinance's lot
depth requirement, and the lot line between Lots 7 and
8 should be modified to create a more radial -like
design.
STAFF RECOMMENDATION
Approval, subject to Staff's and Engineering's
comments.
F. SUBDIVISION COMMITTEE ACTION
Bob Richardson, engineer for the project, spoke in
behalf of the applicant. The Committee agreed with the
applicant's request to construct a 24' minor
residential street in -lieu of the required 27'.
A motion to approve the plat and both variances was
made and passed by a vote of 3 ayes, 0 noes and 2
absent.*
*(Commissioners Dorothy Arnett and Jack Taylor were
absent.)

PLANNING COMMISSION ACTION
Mr. Bob Richardson represented the applicant. There were no
opposers. A motion in agreement with the Subdivision
Committee's recommendation for approval, as filed, was made
and passed by a vote of 7 ayes, 0 noes, 4 absent.
