HomeMy WebLinkAboutS-0188 Staff Analysisr] May 12, 1981 SUBDIVISIONS Item No. 1 NAME: Baker's Replat LOCATION: Factoria and East Roosevelt Road REQUEST: Waiver of Street Improvements on Roosevelt Road DPnnnPAT. This was originally presented as a staff matter for rezoning and closure of McComb's Street and the alleys abutting Block 20 and 21. The applicant has now stated his desire not to provide any curbs and gutters or other improvements along the portion of Roosevelt Road that abuts his property. STAFF REPORT Staff disagrees with this request. The applicant should be required to construct one-half of the principle arterial improvements as mandated by Ordinance. To allow a variance on these grounds would be inconsistent with the already established policy. This policy as applied to East Roosevelt Road requires 1/2 of a 48' pavement with paved shoulders and ditches rather than underground drainage and curb and gutter. STAFF -RECOMMENDATION Denial on the above grounds. SUBDIVISION COMMITTEE RECOMMENDATION By request of the applicant, the Commission passed a motion to defer this matter until the March meeting. The vote: 5 ayes, 0 noes, 0 absent. PLANNING COMMISSION ACTION A motion to defer this item until the March 10, meeting was passed unanimously. The vote: 11 ayes, 0 noes, 0 absent. SUBDIVISION COMMITTEE RECOMMENDATION (2-26-81) Since staff had received no correspondence from the applicant at meeting time, a vote was passed to send this issue to the Commission without specific action. The vote was: 4 ayes, 0 noes, 1 absent. a May 12, 1981 + SUBDIVISIONS Item No. 1---Continued PLANNING COMMISSION ACTION (3-10-81) The applicant was present. There was some confusion as to the true nature of the proposal, so the Commission moved to defer the item until the April 14th Public Hearing so that the applicant could further discuss the matter with the staff. The motion carried by a vote of 8 ayes, 0 noes, 3 absent. SUBDIVISION COMMITTEE RECOMMENDATION (3-26-81) Since the applicant had not contacted Staff or the Committee, a motion was made and passed to send this issue to the Commission without specific action. The vote: 3 ayes, 0 noes, 2 absent. PLANNING COMMISSION ACTION (4-14-81) The applicant was not present. Prior to the meeting, a letter was submitted in Mr. Baker's behalf, requesting that this item be deferred until the May 12th Subdivision Meeting, so that the entire application could be revised. The Commission voted in favor of this request: 9 ayes, 0 nays and 2 absent.* * Commissioners Tabor and Arnett were absent. This item was considered out of sequence, therefore Commissioner Tabor was not in attendance. REVISED PROPOSAL (May 12, 1981) The item is now being resubmitted in order that the property may be replatted into two lots and one tract as indicated by the revised sketch. Because of the expense involved, the applicant is now requesting that the Commission allow the postponement of improvements to Roosevelt Road until building permits are obtained for each development. Since 0- F& May 12, 1981 !� SUBDIVISIONS Item No. 1 _-_Continued Tract A is not presently a buildable lot, the applicant wishes to use it in conjunction with the future development of the abutting property. STAFF -RECOMMENDATION: The applicant has been in contact with Staff throughout the revisions; so Staff is basically in agreement with the new proposal. PLANNING COMMISSION ACTION (5-12-81) The applicant, Mr. Dan Baker, presented his revised plan and request for a delay on improvements to the Commission. A motion for approval was made and passed by a vote of 7 ayes, 0 noes, 4 absent. *(Commissioners Massie, Scribner, Tabor and Arnett were not attendance throughout the entire meeting).
