Smith & Associates 401 Victory Street Little Rock, AR 72201 STAFF REPORT: This is a request for permission to construct a road north of Baseline Road. The purpose of the request, as stated by the applicant is, "to open additional lots on both sides of the road." The lots have not been sized as to frontage but will be based on actual need by the needs of the purchasers. This site is located outside the City limits and has been designated by the Land Use Plan for multifamily development. Existing uses apparent on the adjacent property include an abandoned car wash on Lot 8 and a day-care center/home on Lot 1. Staff is not in favor of the request as submitted. It is viewed as improper because of its (1) failure to provide the needed information by which to assess both the immediate and long-term effects of the inevitable development which will occur as a result of this construction; (2) avoidance of right-of-way dedication and street improvements on Baseline Road; (3) violation of the basic intent of the Ordinance. Although the applicant contends that he is only submitting plans for a street, the creation of such a street is in itself a Subdivision Act. Staff's position is that a proper plat, incorporating all the applicant's ownership should be filed with the provisions for right-of-way dedication and improvements to Baseline Road. A final plat incorporating the two front lots already committed to use should also be submitted. Since this site is immediately adjacent to the municipal boundary, it is not in the City's best interest to allow platting of this property without annexation. STAFF RECOMMENDATION Denial as filed. November 10, 1981 SUBDIVISIONS Item No. 1 - Continued SUBDIVISION COMMITTEE ACTION The applicant was instructed by the Committee to contact Staff so that a workable agreement could be reached. A motion for deferral until the November loth Public Hearing was made and passed by a vote of 3 ayes, 0 noes and 2 absent. PLANNING COMMISSION ACTION: (10-13-81) A motion for deferral until the November 10 Public Hearing was made and passed by a vote of 8 ayes, 0 noes and 3 absent. PLANNING COMMISSION ACTION: (11-10-81) The applicant, Mr. Sidney Thom, was present. There were no objectors. There was some confusion as to the nature of the proposal. Staff commented that the applicant's proposal involved the construction of a road from a previously approved preliminary, but did nothing to address the two illegal lots on which there are existing structures. The issues of importance revolved around whether or not the Commission would require annexation (as recommended by staff) and the final platting of the illegal lots along with the construction of Noble Drive. A motion to amend the final plat to require annexation and the inclusion of the two illegal lots. The applicant was instructed to get with staff after the Final was prepared. The vote was: 9 ayes, 0 noes and 2 absent.
