AND, WHEREAS, it is deemed desirable that the above property be now subdivided as shown on the attached Replat of a portion of Area 101, and that said property be held, owned and conveyed as replatted; NOW THEREFORE, Grantor, City of Little Rock, Arkansas, for and in consideration of the benefits to accrue to it, which benefits it acknowledges to be of value, has caused to be made the Plat hereto attached showing survey made October 19, 2016, by Daniel Phillips, Professional Surveyor, and by William E. Ruck, Professional Engineer, and bearing a Certificate of Approval executed by the Little Rock Planning Commission and showing the bounds and dimensions of the property now being replatted, and by the signature of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, in Plat Book , Page Z 0 1(a D . the Grantor does hereby make this Bill of Assurance. Page 1 of 3 REPLAT AND BILL OF ASSURANCE TRACT K, AREA 101 LITTLE ROCK PORT INDUSTRIAL PARK There are strips of ground shown and dimensioned on said plat marked "10' Utility Easement, 20' Sewer Easement, and 50' Texas Eastern Gas Line Easement" reserved for the use of public utilities, subject at all times to the proper authorities and to delivery and dedication hereby of the easements shown on the said plat. The land embraced in said Plat shall be forever known as "Tract K, Area 101, Little Rock Port Industrial Park of the City of Little Rock, Arkansas", and any and every deed of conveyance describing the property by the letters and numbers shown on said Plat shall always be deemed a sufficient description thereof. Rebars'/z-inch in diameter have been set or found as monuments to mark corners (and "offset corners" to those in Fourche Bayou) of the property being platted. In the event of minor discrepancies between the dimensions or distances as disclosed by the established pins, the pins as set shall control. No monuments were able to be set in the center line of Fourche Bayou, which is the west line of the described parcel, but offset corners were set as shown on the Plat. Said property herein platted and any interest therein, shall be held, owned and conveyed subject to and in conformity with the covenants and restrictions contained in that certain Amendment of Bill of Assurance filed for record by Grantor on the 13th Day of December, 1996, in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, and appearing of record as instrument 96 85228, as amended. The considerations set forth are hereby approved by the City of Little Rock Planning Commission. Any additional requirements, restrictions or statements are entered without review or action by the Planning Commission and shall not be considered part of the Little Rock Planning Commission's requirements for plat approval.
