MOORE, CITY MANAG CHENONCEAU PLANNED COMMERCIAL DEVELOPMENT MARCH 27, 2009 The request was made at the March 10, 2009, Board of Directors Agenda Meeting for staff to provide additional information regarding the Chenonceau Planned Commercial Development. Specifically, the Board asked staff to provide a sketch showing the properties adjoining the proposed Chenonceau PCD, to clarify the amended hours of the Chenonceau PCD as they relate to the hours of the nearby Burger King and to provide a written overview of the changes made to the Chenonceau PCD since Planning Commission approval. Staff reports that the property to the east of Chenonceau Commercial Lots 1 and 2 is zoned POD and was approved by the Board of Directors on October 3, 2006. The approved site plan allows Lot 1 containing 1.55 acres to develop with a banking facility and the remaining lots to develop with small office users utilizing 0-3 uses as allowable uses. The remaining area was approved with five (5) lots ranging in size from 0.27 acres to 0.54. acres. A final plat was executed for the property on December 1, 2006. Lot 1, 1.55 acres, Lot 2, 0.27 acres, Lot 3, 0.24 acres, Lot 4, 0.54 acres, Lot 5, 0.34 acres and Lot 6, 0.39 acres. A copy of the area zoning map showing this property is attached. The hours of operation for the newly opened Burger King at 14910 Cantrell Road are 6:00 AM — midnight; seven (7) days a week. The proposed hours of operation submitted by the applicant for the Chenonceau PCD McDonald's are as follow: Lobby: 5:00 AM — 11:00 PM; seven (7) days a week rive-Thru: 5:00 AM — 10:00 PM; seven (7) days a week PFr—ov'idEd: That if any other restaurant that offers drive-thru service along Highway 10 between East Taylor Loop Road and Chenal Parkway, excluding the Burger King at 4910 Cantrell Road, is allowed to open the City of Little Rock, Arkansas drive-thru later than 10.00 PM; then McDonald's shall have the right to match the drive-thru closing hours. Since the date of the Planning Commission approval of the PCD there have been few changes to the plan. The original hours of operation were proposed at 5:00 AM — 2:00 AM; seven (7) days a week. Those hours have been modified as noted above. The McDonald's was originally proposed to have a separate .ground-mnoun.ted—s-ig.n—o.n-antr_ell_.Road.'_however_,_the_signage_-will, now-compl-y--------- -- with the Highway 10 Overlay. The existing sign on Cantrell Road will be removed and the existing sign on Chenonceau Boulevard will be moved off of Lot 1 and placed on Lot 2. A new sign will be placed on Cantrell Road and will be a commercial development sign, identifying the tenants of the Chenonceau PCD, including McDonald's. In addition, McDonald's will open with two (2) order boards in operation. Dual stacking lanes are now shown on the plan and will be implemented if stacking in a single -lane backs vehicles onto the main drive. The driveway adjacent to the pick-up window has now been widened to provide an "escape lane" and parking is now designated for individuals to wait while their order is brought out to them, if necessary. Below are the municipalities and the lot size for each location. For reference purposes, the McDonald's on West Markham Street has a site area of 0.96 acres. Conway: Site area of 1.14 acres. Hot 5 rin s: Site area of 1.45 acres (includes .2 acres for an extension drive.) Benton: Site area of 0.96 acres. ➢ Map of developments along Highway 10 and their res ective lot sites. MOORE, CITY MANAG SUBJECT: CHENONCEAU PLANNED COMMERCIAL DEVELOPMENT DATE: FEBRUARY 6, 2009 The request was made at a recent Board of Directors Meeting for staff to provide additional information regarding building design, signage, site development elements and traffic issues in relation to the proposed Chenonceau Planned Commercial Development (PCD). In addition to the proposed PCD, information was requested for an existing PC❑ at the northwest corner of Highway 10 and Ranch Blvd. According to staff, the applicant has presented a representation on the proposed building design, which will have an exterior finish of brick or stone and Exterior Insulation and Finish Systems (E.I.F.S.) Stucco. In addition, staff reports that the building design must be approved by the Chenal Architectural Review Committee to assure that the design is appropriate for Chenal Parkway. The site plan reviewed by the Planning Commission includes a drive-thru lane and windows for pick-up on the south side of the building. There are two (2) menu boards on Chenonceau Boulevard, the west side of the building, which will be properly screened per the ordinance, The proposed dumpster is to be located generally south of the building, and the enclosure will be designed to match the material of the building. The dumpster enclosure is located approximately seventy (70) feet off of the Chenonceau property line, and the property has a platted fifty (50)-foot setback on the Chenonceau side. The code for commercially zoned districts requires that dumpsters not be located in the front yard or street side yard setbacks. As proposed, the dumpster is not located within the setbacks and complies with the code requirement for dumpster placement and screening. The areas set aside for landscaping on the proposed plan complies with the standards established by the Highway 10 Design Overlay District (DOD). The DOD requires a minimum of a forty (40)-foot landscaped front yard along Highway 10. The Code specifies that the landscape area shall contain organic and/or combined man- made/organic features as berms, brick walls and dense plantings such that vehicular use areas are screened when viewed from an elevation of forty-two (42) inches City of Little Rock, Arkansas above the elevation of the adjacent street. The applicants have stated plantings will be installed to comply with this requirement. The proposed hours of operation, 5:00 AM — 2:00 AM, seven (7) days a week have not changed. Signage will comply with the Highway 10 DOD, and the existing sign on Highway 10 will be removed. The existing sign on Chenonceau will be moved off of Lot 1 and to the south side of the driveway, placing the sign on Lot 2. A single ground -mounted sign will be placed on the Canlrell Road frontage. The sign will be a commercial development sign not to exceed fen i 10)-feet in height and 100 square feet in area. Public Works Traffic Engineering Staff has conducted field studies to determine the traffic volumes and drive-thru performances of the McDonald's restaurants at Rodney Parham Road & Breckenridge Drive and Broadway Street & 7th Street. The proposed McDonald's is approximately 3,900 square feet in area, and based on the trip generation data from the other two (2) locations, it is staff's opinion that the proposed new restaurant may be expected to generate approximately 150 vehicles (entering only) during the AM peak hour, The single -lane drive-thru as designed can accommodate twelve (12) cars, and based on the data collected at the other two (2) locations, a drive-thru volume of 120-140 vehicles may be expected during the AM peak hour. If the drive-thru volume exceeds 132 vehicles per hour on any day, the available stack room in a single -lane drive-thru is not adequate to store the extra vehicles. The vehicle queue will extend onto the main drive, thus blocking traffic. Attached for your review is a copy of the complete study from Traffic Engineering. If it is determined that stacking in a single -lane drive-thru causes vehicles to back onto the main drive, the applicant has indicated a willingness to modify the driveways to create dual stacking lanes by removing the parking located directly adjacent to the building. Staff has been provided a revised site plan indicating the modifications to allow the dual stacking lanes when warranted. Staff reports that the property located at the northwest corner of Ranch Boulevard and Cantrell Road was rezoned from C-3 general commercial t❑ PC❑ Planned Commercial ❑evelopment through the adoption of Ordinance No. 19, 507 ❑n March 21, 2006. The property was rezoned to PC❑ due to the fact that the proposed site contains 1.55 acres, less than the two (2) acres required under the Highway 10 Design Overlay District. These improvements increased the capacity of the drive-thru, but are not as efficient as the new store layouts. To determine the impact of the proposed location, traffic counts were conducted at the following locations during the AM: 1. Conway (Salem Road) 2. Benton (I-30 WB Service Road) 3. Hot Springs (HWY 70 West) These stores have the same building layout as the proposed store. The counts included driveway volumes, parking volumes and drive-thru volumes. To calculate the capacity of the drive-thru, the pick-up window is the controlling factor for the capacity. The Rodney Parham pick-up window time was approximately 33 seconds, therefore over one hour (3600 seconds) 109 vehicles can be passed through the drive-thru. Using the worst case (Benton location) for the new layout, the pick-up window time was approximately 24 seconds, therefore over one hour 150 vehicles can be passed through the drive-thru. Using the Rodney Parham location as a baseline, the new layout locations function on average with greater than 36% more capacity. Traffic will not be a problem at this location. The new store layout operates with greater than 36% more capacity than the Rodney Parham location. Background. Jacobs Engineering was hired by McDonald's USA, LLC to conduct a traffic impact study for a proposed store location at the southeast corner of the intersection of Cantrell/Chenonceau. The proposed store would be approximately 4,000 square feet with indirect access to Cantrell and Chenonceau. Figure 1 shows the proposed site plan for the development. Concerns were raised about the traffic generated by the site during the AM peak hour of operation. The existing site at Rodney Parham/Breckenridge was cited as an example for the peak hour AM traffic spilling off site. Figure 2 shows several photos of the drive- thru queuing at the Rodney Parham/Breckenridge location. Rodney Parham/Breckenridge Location. The existing store at Rodney Parham/Breckenridge is an older store that has been retrofitted with dual ordering stations, a pay window and a pick-up window. These improvements increased the capacity of the drive-thru, but are not as efficient as the new store layouts. Circulation on the site is limited due to the close proximity to the signalized intersection. The driveways on Rodney Parham and the northern most driveway on Breckenridge are frequently blocked by traffic queuing for the light. Vehicles exiting the drive-thru are forced to exit immediately onto Breckenridge near the front of the intersection queue, circle the building to exit onto Rodney Parham or continue all the way around the building to exit at the southern most driveway onto Breckenridge. The maximum queuing distance at the site is 180 feet. Proposed Location — Cantrell/Chenonceau. The proposed store will use the new layout which further increases the capacity of the drive-thru window. The proposed site is accessed via internal roads to the development from both Cantrell and Chenonceau. The drive-thru will utilize dual order stations, a pay window and a pick-up window. The drive-thru exit is separate from the dine -in exits. The queue length for the drive-thru is 220 feet. Data Collection. To determine the impact of the proposed location, traffic counts were conducted at the following locations during the AM: 4. Conway (Salem Road) 5. Benton (I-30 WB Service Road) 6. Hot Springs (HWY 70 West) These stores have the same building layout as the proposed store. The counts included driveway volumes, parking volumes and drive-thru volumes. Additionally, traffic counts were also conducted at locations with the old configuration during the AM. These locations were at: 1. Little Rock (Markham) 2. Little Rock (Rodney Parham) The traffic counts were conducted without notifying the store to help ensure data accuracy. Times were also collected during the counts to determine what the average times were to order, pay and pick-up. The traffic volumes were collected from 6:45 to 8:30. From the collected data, the peak hour was used to analyze the site to determine the operation. The data collected exceeds the Institute of Transportation Engineers (TTE) Trip Generation Rates (shown in Appendix A), and corresponds with the data collected by the City. 4 The longest observed queue length for the new layout (Conway, Hot Springs, Benton) is 15 vehicles. Figure 3 shows how a 16 vehicle queue looks on the Conway site. Table 1 shows the AM peak traffic volumes for the locations. Table 2 shows the average times to order, pay and pick-up. The City provided a current turning movement count for the intersection of Rodney Parham/Breckenridge. Analysis. After the data was collected, microsimulation models were prepared for the AM peak hour at the Rodney Parham location and an additional model was prepared for the proposed Cantrell/Chenonceau location using VISSIM. The models were calibrated using standard Federal Highway Administration (FHWA) guidelines. AVI files were created for the models and have been submitted with this report. The Rodney Parham model was developed using the times collected above along with the driveway and drive through counts collected for Rodney Parham. The proposed Cantrell/Chenonceau location model was developed using the Benton location service times listed in Table 2 (this location had the slowest service rates of the new layouts analyzed). The model used a drive thru volume of 115 (to match the drive thru volume counted by the City at Rodney Parham). To calculate the capacity of the drive-thru, the pick-up window is the controlling factor for the capacity. The Rodney Parham pick-up window time was approximately 33 seconds, therefore over one hour (3600 seconds) 109 vehicles can be passed through the drive-thru. None. Staff recommends approval of the requested PCD zoning. The Planning Commission voted to recommend approval of the requested zoning by a vote of 7 ayes, 2 noes and 2 absent. The Planning Commission reviewed the proposed PCD request at its August 7, 2008, meeting. There were registered objectors present. The Aberdeen Court Property Owners Association, the Bayonne Place Property Owners Association, the Joluison Ranch Neighborhood Association, the Chevaux Court Property Owners Association, all residents who could be identified located within 300 feet of the site and all property owners located within 200-feet of the site were notified of the Public Hearing. BACKGROUND A Preliminary plat containing eleven lots was approved by the Little Rock Planning Commission at their May 16, 1995, Public Hearing. The proposal included a commercial and office subdivision on a 16.66-acre tract. The site has frontages on both Cantrell Road and Chenonceau Boulevard. One interior cul-de-sac street, approximately 500 feet in length was proposed within the subdivision. Lots ranged in size from 0.8 acres to 2.14 acres, with the average lot size being 1.44 acres. The Final Plat for Lot 1 was executed on January 29, 1996. The Final Plat for Lot 2 was executed on December 19, 2003. The remaining lots have not been final platted. On April 22, 2004, the Little Rock Planning Commission approved a site plan review to allow the construction of two buildings on this site which was previously final platted as two lots. The approval allowed the construction of a 2,700 square foot bank building located on the corner of Cantrell Road and Chenonceau Boulevard on Lot 1 and the construction of a retail building containing 12,000 square feet on Lot 2. The retail building was situated where it crossed the lot line . requiring the applicant to seek a multiple building site plan review. The site plan included the development of 120 parking spaces to serve the development. The commercial building on Lot 2 has been constructed and crosses the lot line between Lots 1 and 2. The bank on Lot 1 has not been constructed. The applicant is now proposing a rezoning of the site from C-3, General Commercial District to PCD to allow a revision to the previously final platted lots and to allow the development of the site with a new drive -through restaurant. Lot 1R is proposed adjacent to Cantrell Road containing 1.45 acres. The building proposed for Lot 1R will contain 3,900 square feet of gross floor area and 53 parking spaces. Lot 2R is incorporated into the PCD. The building located on Lot 2R exists including the drives and parking. The building presently contains 12,000 square feet and 93 parking spaces. Lot 2R contains 1.74 acres. Bicycle Plan: A Class III bike route is shown along Chenonceau Boulevard. A Class III bikeway is a signed route on a street shared with traffic. No additional paving or right- of-way is required. I was a member of the audience Tuesday night, March 31s`, 2009, at the meeting of the Board of Directors, City of Little Rock, and as I live in the Bayonne subdivision, it was my hope — but not my expectation — you would decline the zoning reclassification for a fast-food franchise at the Little Rock City Officials April 2, 2009 Page Two Southeast Corner of the Highway 10 and Chenonceaux Drive intersection. First, although I have lived in Little Rock for well over thirty years, I have attended very few city board meetings. I want to applaud each of you, no matter how you voted, for your sometimes heavily -taxed patience, for your respectful demeanor toward all participants, for the selfless donations of time each of you routinely contribute, and I also note Mayor Stodola's even- handed superintendence. In this matter at earlier stages with the Little Rock Planning Commission, an elderly male member of that commission seemed drawn to insult and demean the opponents of the development, particularly the women who spoke, and it was reassuring to experience an absence of such behavior with the City Board of Directors. Frankly, as I have already stated, I expected the zoning variance to be approved, and I expected that because I have seen in other matters how the wheels get greased. I believe the virtual certainty with which prior variances to "the Highway 10 Overlay," as well as numerous other variances requested by developers, have been approved by the Little Rock Planning Commission demonstrates a systemic bias toward any development requested. I would strongly recommend that the staff and members of the Little Rock Planning Commission be required to document all contact any employee has with any and all representatives seeking any zoning change and that such contact be generally discouraged. Further, the concluding comments of Mayor Stodola cause some concern (and I only point this out because he is no longer our Prosecuting Attorney and, consequently, cannot charge me with anything).* People such as those who spoke Tuesday night, and thousands more, buy their homes and plan their retirements in these west Little Rock neighborhoods with a firm expectation the permitted development will not degrade their investments or their expected security. The protection of these lawful expectations is central to zoning laws in the first place. Mayor Stodola seemed to suggest in his concluding comments that the Highway 10 Overlay will certainly be reviewed in coming days — and it will almost surely be modified to permit greater development in light of the many variances which have already been granted. I hope I misunderstood this (which is increasingly possible) or that this sentiment is reconsidered. I don't believe mistakes of the past should control decisions of the future. And finally, Mrs. Flake said the opponents of the variance had gotten "emotional" about the issue, and that comment missed the mark. In a courtroom, Mrs. Flake would have been asked about her own financial interest in the zoning variance, and she would also be asked how many fast-food restaurants were within 400 yards of her front door. Director Hendrix noted the traffic difficulties with the McDonald's in downtown Little Rock at 7t' and Broadway — but it is alright with everybody downtown, she said, because they like McDonald's. I also frequent the McDonald's at 7tn and Broadway, and I fight through the traffic — but it is coming at twenty or thirty miles per hour, not fifty or sixty. I also recognize Ms. Hendrix has a Masters Degree in Little Rock City Officials April 2, 2009 Page Three Urban Planning and Development, and I don't. If, on the other hand, the issue is perceived as involving race, ethnic backgrounds, living patterns by geography, or anything of that sort, I doubt if we are past those kinds of issues, but the desire to secure attractive and safe neighborhoods open to all should not be minimized by the fact others are less attractive and, or more dangerous. Again, even though a couple of you were absent, and even though several of you voted differently than I would have preferred, you demonstrated the best of grass -roots politics in this country — and I was proud of the Little Rock Board of Directors generally. First of all, there is not room for said restaurant at that location. Secondly, we already have too much traffic with people turning left at that corner. We do not need to make that corner even more hazardous. With all the places down Cantrell, why can't they locate it at a different site, that would be safer for the people. We can tolerate a business there from 8 to 5 during the day, but not a business there for 22 hours around the clock. We put our life savings into our home, and to have this restaurant so close to Chevaux Court, would lower the value of our home. With the real estate being What it is presently, we don't need another strike against us. Would you please put yourself in our situation, when you are 70 years old or older.
