I have been told that a vote WILL be taken tonight and it will be final. I am appealing to you one more
time to PLEASE listen to the citizens who live around this intersection. We are very concerned for the
safety of ourselves and others, especially young people who will frequent a drive-thru McDonald's
because of all the schools around us.
You know one of the main concerns we have is the high potential for loss of more lives, along with even
more traffic accidents, if this is approved. And now we are finding out that we may face the same issue
with another fast food restaurant at Saddle Creek at the Ranch development by Ed Willis. This just can't
be allowed to continue! Lack of planning for traffic entering and leaving businesses with so many
cutouts and not enough traffic lights is just a combination for a bad storm - a traffic storm. This is just
one of many concerns we have about a drive-thru restaurant of any kind at the intersection of
Chenonceau & Cantrell/Hwy 10.
PLEASE listen to the people who live in this area and who try to navigate the obstacle course we
already have in safely moving in and out of our neighborhoods and PLEASE vote NO to the proposed
McDonald's on Cantrell and Chenonceau tonight. PLEASE do the right thing, according to the DOD
and begin drawing the line in the sand that says NO MORE.
Again, thank you for your time and efforts on behalf of the great City of Little Rock and its citizens. It
is usually a thankless job you do on our behalf.

Re: Proposed Drive -Through Restaurant at Chenonceau and Cantrell Roads
Dear Mr. Carney,
This is to make you aware of our objection to the proposed development referenced
above. There are the usual reasons why we don't want a drive -through restaurant at this
particular location to include excessive lights and noise almost around the clock, and
trash along the roadway. However, our biggest concern is the safety issue due to
increased drive -through traffic.
We attended the Planning Commission's meeting on August 7t` where the
Commissioners voted to allow a variance requested because the development is too big
for the lot size. The Commissioners' decision was based at least in part on their staff s
traffic analysis. However, it was not at all clear to us that an adequate traffic analysis had
been conducted. There was no document introduced or specifics offered by the staff
representative at the meeting to support the existence of an analysis. There was,
however, research offered up by concerned citizens in attendance that clearly pointed to
serious problems in this area. We are convinced that we already have an unacceptable
traffic safety problem. The addition of this drive -through traffic will turn an already
scary situation for us, and our neighbors in Chevaux Court, into a nightmare.
The DOD, prepared for the specific purpose of providing minimum guidelines for the
ongoing growth and development along the Highway 10 corridor, should be followed.
Serious consideration should be given to a proposed business's adverse impact on traffic
in the area. Clearly, a drive -through type restaurant is not appropriate for this particular
lot. Please give our concerns serious consideration when this proposal comes before the
Board of Directors on December 16t'.

The Owner and McDonalds agreed last week to additional restrictions on the hours of operation of the
McDonalds. It has come to our attention that the Burger King at 14,910 Cantrell Road is open until midnight. We
would like to exclude the Burger King at this location for our reference to "other restaurant" as it relates to any
future expansion of the hours of operation.
To be perfectly clear, when the McDonalds opens it will be with the following hours:
Lobby: 5 am until 11 p.m. 7 days a week.
Drive Thru: 5 am until 10 pm 7 days a week.
I would also like to clarify that the McDonalds will open and operate with both order boards in operation.
Please let me know if you need any additional information.

Development.
Hours of operation will be (limited) as follows:

Provided: That if any other restaurant that offers drive-thru service along Hwy. 10 between
East Taylor Loop and Chenal Parkway is allowed to open the drive thru later than 10 pm; then

The existing sign on Highway 10 will be removed. The existing sign on
Chenonceau will be moved to the South side of the drive on Chenonceau (Lot
2). The proposed sign shown on the PCD will be a "Project" or "Development"
sign, no more than 100 SF in area with a maximum height not to exceed 10
feet.
Screening and Elevations
I will send these in a separate email as attachements. Some explantion will

The property located at the northwest corner of ranch Boulevard and Cantrell Road was
rezoned from C-3 general commercial to PCD , Planned Commercial Development,
through the adoption of Ordinance No. 19, 507 on March 21, 2006. The property was
rezoned to PCD since the proposed site contains 1.55 acres, less than the 2 acres required
under the Highway 10 Design Overlay District. Approval was granted for development of
the site with either a 7,300 square foot restaurant or a 10, 000 square foot retail building.
Other than the lot size, the proposed development complied fully with the standards of
the Overlay; including building setbacks and landscaping.
In response to a request from the Board, staff has the following additional information on
the proposed Chenonceau Commercial Lots 1 and 2 Short -form PCD; site of the
proposed McDonalds restaurant.
Signage will comply with the Highway 10 Design Overlay District. The existing sign on
Highway 10 will be removed. The existing sign on Chenonceau will be moved off of Lot
1 and to the south side of the driveway, placing the sign on Lot 2. A single ground -
mounted sign will be placed on the Cantrell Road frontage. The sign will be a
commercial development sign not to exceed 10 feet in height and 100 square feet in area.
The applicant has presented a representation on the proposed building design. The
building will have an exterior finish of brick or stone and E.I.F.S. The building design
must also be approved by the Chenal Architectural Review Committee to assure that the
design is appropriate for Chenal.
The proposed dumpster is to be located generally south of the building. The dumpster
enclosure will be deigned to match the material of the building. The dumpster enclosure
is located approximately 70 feet off of the Chenonceau property line. The property has a
platted 50-foot setback on the Chenonceau side. The code for commercially zoned
districts requires that dumpsters not be located in the front yard or street side yard
setbacks. As proposed, the dumpster is not located within the setbacks and complies with
the code requirement for dumpster placement and screening.
The areas set aside for landscaping on the proposed plan comply with the standards
established by the Overlay. The Overlay requires a minimum of a 40 foot landscaped
front yard along Highway 10. The Code specifies that the landscape area shall contain
organic and/or combined man-made/organic features as berms, brick walls and dense
plantings such that vehicular use areas are screened when viewed from an elevation of
forty-two (42) inches above the elevation of the adjacent street. The applicants have
stated plantings will be installed to comply with this requirement.
The proposed hours of 5:00 a.m. — 2:00 a. in., seven (7) days a week have not changed.
The staff of the Traffic Engineer's office has conducted field studies to determine the
traffic volumes and drive-thru performance s of the McDonalds restaurants at Rodney
Parham Road and Breckenridge Drive and Broadway Street and 7th Street. The proposed
McDonalds is approximately 3,900 square feet in area. Based on the trip generation data
form the other two locations, staff feels the proposed new restaurant may be expected to
generate close to 150 vehicles (entering only) during the AM peak hour. The single -lane
drive-thru as designed can accommodate 12 cars. Based on the data collected at the other
two locations, a drive-thru volume of 120-40 vehicles may be expected during the AM
peak hour. If the drive-thru volume exceeds 132 vehicles per hour on any day, the
available stack room in a single -lane drive-thru is not adequate to store the extra vehicles.
The vehicle queue will extend onto the main drive, thus blocking traffic. A copy of the
complete study from the City's Traffic Engineer is attached for your information.
The applicant has indicated a willingness to modify the driveways to create dual stacking
lanes by removing the parking located directly adjacent to the building, if it found that
stacking in a single -lane drive-thru causes vehicles to back onto the main drive.

Traffic Engineering staff visited a new McDonalds location in Bryant and
confirmed that the average time taken to serve one drive-thm vehicle is about 30
seconds.
Based on these findings, a restaurant can process about 120 cars per hour in the
drive-thru lane. Any cars in excess of this number will have to be accommodated
in the drive-thru lane.
Proposed McDonalds at Hwy. 10 and Chenonceau
The proposed McDonalds at Hwy. 10 and Chenonceau is about 3900 sq. ft. in floor area.
Based on the trip generation data from the other two locations, the proposed restaurant
maybe expected to generate close to 150 vehicles (Entering only) during the AM peak
hour. The single -lane drive-thru as designed can accommodate 12 cars. Based on the

may be expected during the AM peak hour. If the drive-thru volume exceeds 132
vehicles per hour on any day, the available stack room is not adequate to store the extra

McDonalds Drive-Thru Operation Study
Traffic Engineering staff conducted field studies to determine the traffic volumes and
drive-thra performances of McDonalds Restaurants at two locations- Rodney Parham
Breckenridge and 7thBroadway. The results of the studies are given below.
McDonalds at Breckenridge/Rodney Parham.
The floor area of this restaurant is about 4200 sq. ft. The drive-thru has two lanes for
placing orders and one shared lane at the pick-up window. The total available stack
room is about 375 ft, (300 Main Lane + a second lane of about 75 ft. )

In light of your comments we will increase the width of the pickup lane on the south side of the building to 16 feet.
This will allow a vehicle to exit around a vehicle in the pick up line. We will also construct the parking lot so that it
can be striped in the future to allow two lanes to stack across the north side of the restaurant. With the present
configuration 18 vehicles can be accommodated in the drive through, with the modification this would be
increased to 23.
We will move the existing sign on Chenonceau south of the drive on Chenonceau. We will remove the existing
sign on Highway 10 and construct a singe development sign with an area not to exceed 100 square feet.
I have also enclosed sketches we have been working on to show the screening on Chenonceau and the berme
along Highway 10 and a section through the drive thru.
These are for your use to help in answering any questions you may get tonight. Please don't distribute these until
we have completed them

We looked at a few locations and based on our observations we think the following modifications need to be
made to make this site operate without negatively affecting traffic on this commercial site.
1. Provide drivers a way to exit the site from the order boards when service is too slow for the customer. We
saw quite a few drivers take this option at the Breckenridge store as well as the Alcoa Road location.
2. Lengthen the double stack of waiting vehicles from the east drive to the order boards. This will help
prevent vehicles from blocking the access easements into this site.

In light of your comments we will increase the width of the pickup lane on the south side of the building to 16 feet.
This will allow a vehicle to exit around a vehicle in the pick up line. We will also construct the parking lot so that it
can be striped in the future to allow two lanes to stack across the north side of the restaurant. With the present
configuration 18 vehicles can be accommodated in the drive through, with the modification this would be
increased to 23.
We will move the existing sign on Chenonceau south of the drive on Chenonceau. We will remove the existing
sign on Highway 10 and construct a singe development sign with an area not to exceed 100 square feet.
I have also enclosed sketches we have been working on to show the screening on Chenonceau and the berme
along Highway 10 and a section through the drive thru.
These are for your use to help in answering any questions you may get tonight. Please don't distribute these until
we have completed them.

We looked at a few locations and based on our observations we think the following modifications need to be
made to make this site operate without negatively affecting traffic on this commercial site.
1. Provide drivers a way to exit the site from the order boards when service is too slow for the customer. We
saw quite a few drivers take this option at the Breckenridge store as well as the Alcoa Road location.
2. Lengthen the double stack of waiting vehicles from the east drive to the order boards. This will help
prevent vehicles from blocking the access easements into this site.

a AM Peak -hour trip generation study for the drive-thru lane of McDonalds at Rodney
Parham /Breckenridge. and 7`h/Broadway
McDonals at Breckeridge/Rodney Parham.
The floor area is about 4200 sq. ft. The drive-thru has two lanes for placing orders and
one shared lane to the pick-up window. The total length is about 300 ft. + a second lane
of about 75 ft.
The results of the study were as follows:
Total traffic (Entering)
(between 7:00 and 8:00 AM) :......... 154 vehicles
Drive-thru volume: 115 vehicles
Longest queue: 19 vehicles
Observed Drive thru capacity: 115 vehicles/hour (based on non-stop activity)

Based on the trip generation data from the other two locations, the proposed restaurant
may be expected to generate close to 150 vehicles (Entering) during the AM peak hour.
The ITE Trip Generation estimates show a slightly less entering volume of 106 vehicles.
The drive-thru for this location is about 300 ft. long. Based on the drive-thru queuing
seen at the McDonalds on Broadway, it is possible that the queues during the AM peak
hour may be long enough to block traffic on the access easement which in turn may block
traffic on Hwy. 10. The drive-thru layout may have to be reversed or modified in some
way so as to allow more double -lane stacking room for drive-thru vehicles. Also, the
drive-thru lane should be redesigned to not trap the customers in the drive-thru lane. Staff
noticed that several customers at the Breckenridge location left without ordering when
the wait time became too long.

decade to combat blight, but now
the capital city has turned its at-
tention to unsafe manufactured
homes.
City directors unanimously ap-
proved an ordinance Tuesday that
gives Little Rock the authority to
deem a manufactured or mobile
home a nuisance. Starting today,
code enforcement officers can
issue citations for violations and

West Little Rock residents han-
kering for an Egg McMuffin will
have to continue driving several
miles east for the breakfast sand-
wich after city directors on Tues-
day rejected a proposed Cantrell
Road location for a McDonald's
restaurant.
Eight months after planning
commissioners originally ap-
proved the proposed Chenon-
ceau Boulevard and Arkansas 10
location, city directors listened to
more than an hour ofpublic com-
ment on the proposed fast-food
restaurant.
City Hall was packed with resi-
dents from surrounding neighbor-
hoods who opposed the McDon-
ald's because of the traffic hazard
they believed it would create, and
because it violated Little Rock's
design overlay district standards.
The 1.45-acre lot falls below the
two -acre minimum threshold the
city established in its Arkansas 10
standards, although in the past the
city has approved numerous de-
velopments that ran afoul of the
19-year-old rules.
In an attempt to appease resi-
dents and city directors, McDon-
ald's corporate representatives
said they would lirnit the restau-
rant's hours, build a double drive -
through and leave trees on the site
intact, The lot is larger than the
average McDonald's site, repre-
sentatives said, and the restaurant
would create about 70 jobs an
$244,004 in sales tax For city co.

But none of that was enough t

reach a McDonald's with a drive -

for use in all City equipment. This is an annual purchase order for
one (1)-year with an option to renew each year for up to four (4)
additional years.

ThyssenKrupp Elevator, to supply materials and labor to
renovate the City Hall elevator. Staffrecommends approval.
Synopsis: ThyssenKrupp Elevator submitted a bid of $160,098
and was the only bid received to renovate the elevator at City Hall.
The funding will come from 2008 Short Term Financing.
6. RESOLUTION To renew taxicab operator permits for Greater Little Rock
Transportation Service, LLC (GLRTS); and for other
purposes. Staffrecommends approval.
Synopsis: A resolution authorizing the approval of 123 operator
permits for Greater Little Rock Transportation for 2009.
7. RESOLUTION To authorize the City Manager, Mayor, and City Clerk to
execute any documents necessary and take other actions

Synopsis: These 26 units will replace units that have been totaled
and older units with high miles and maintenance costs.
5. RESOLUTION To authorize the City Manager to enter into a contract with
Tri-State Truck Center for the purchase of seven (7) 30-
cubic yard side -load refuse trucks for a total amount of
$675,429. Staffrecommends approval.
Synopsis: Three competitive bids were obtained. The bid award was
made to the lowest responsible bidder meeting minimum
specifications.
6. RESOLUTION Authorizing an increase to the construction contract for
Joyner -Ford -Burke Construction Company, Inc., for
University Avenue (191h Street to Park Plaza Drive);
Arkansas Highway and Transportation Department Job
Number 060917. Staffrecommends approval.
Synopsis: Authorizes the City Manager to approve an amendment

the City Attorney to take such action as is necessary to raze
and remove said structures; declaring an emergency; and for

Synopsis: Fifty (50) residential structures in dilapidated and/or
burned condition causing a negative environmental impact on the
residential neighborhoods in which they are located. The estimated
cost to demolished remove these structures is $290,700.

the bonds and the approval of a bond purchase agreement
and payment in lieu of taxes agreement in connection
therewith; authorizing the execution and deliver of a
mortgage and security agreement securing the bonds;

Objectors fail; land
rezoned for mining
Little Rock city directors re-
zoned 44 acres Tuesday for min-
ing near Arch Street and Interstate
530 despite objections from resi-
dents who live abouta mile away
from the property owned by Mc-
George Contracting Co.
It took Mayor Mark Stodola's
favorable vote to push the rezon-
ing through on a 6-4 vote, with
City Directors Joan Adcock, Erma
Hendrix, Ken Richardson and B.J.
Wyrick voting against it. Vice -
Mayor Gene Fortson was absent.
The undeveloped property
was zoned for residential use but
is surrounded by other mining
properties. City directors in March
rezoned for mining 50 acres: of
residential land that is owned by
3M for mining and is near the -Mc-
George Contracting site.
Residents from the Granite
Mountain area; as well as people
living north of interstate Park, op-
posed the rezoning, saying more
tinning and.. blasting would hurt
their homes.
Haskell Dickinson, president of
the McGeorge Contracting, said
homes a mile away wouldn't: suf-
fer damage from blasting.
City directors. said the mining
hadn't damaged Interstate 530
and that no one had ever taken
legal action against the -mining
operation for damage. They also
questioned why residents didn't
oppose the 3M rezoning request
as welt, but residents said they
weren't notified about that project
and had found out the last minute
about Tuesday's rezoning.
LR's $125,000 aids
Holiday on ice bid
Little Rock Advertising and
Promotion Commissioners com-
mitted $125,000 on.Monday to
help Alltel Arena land a Holiday
on Ice show in November that will
air on NBC. •
The North Little Rock arena
plans to bid on the show after
securing the commitment from
Little Rock commissioners. The
arena has committed another
$125,000 for the program.
The November 29 show is ex-
pected to feature Olympic gold
medalist Brian Boitano; according
to the commission.

in west prompts suit
Property owners who planned
to redevelop their west. Little Rock
land for a McDonald's have sued
the city over the city Board of Di-
rectors' March3l decision to deny
the rezoning request. -
[brion Capital Partners LLC,
'Karen Flake and Delta Trust &
Bank filed the appeal in Circuit
Court on April24 against the city,
but City Attorney Tom Carpenter
said Thursday that city officials
have yet to be served.
City directors rejected a rezon-
ing request for a corner lot at the
southeast intersection of Cantrell
Road and Chenonceau Boule-
vard..The property is zoned for
commercial use but because the
property didn't meet.an acreage
requirement of the Arkansas 10
design overlay district plan, prop-
erty owners needed. a planned,
commercial development zoning
designation. The overlay plan requires 2
..acres -
•acres- per building, or.4 acres in
this instance. One building already
sat on'the 3.19-acre lot. Planning
commissioners approved the re-
zoning request'lastyear and the
city's planning staff also sup-
ported it.
Residents from surrounding
neighborhoods packed city board
meetings to oppose the request
out of concerns about increased
traffic in the area, where vehicles
go 50 `miles' per hour, and about
building on a lot that didn't meet
size requirements.
McDonald's representatives at
the time said they would limit the
restaurant's hours, build a double
drive -through and leave trees on
the site intact. The lot, they said, was. larger than the average Mc-'
Donald's site.
City directors voted 5-3 against
the rezoning request. The.lawsuit
calls the decision arbitrary and
unreasonable, and' "reverse spot
zoning' because the city approved
similar lot -size variances for other
properties in the overlay district.

on Wednesday during an annual
city luncheon.
Spencer has worked for five
police chiefs and -four interim
chiefs in the 24 years she has
worked at the Little Rock Police
