The lot under consideration for McDonalds is too small for any drive-thru. While I understand the city wants the tax revenue and Mr, and Mrs. Flake want to sell the property, 1.25 acres is too small for any drive-thru --- especially on the corner of Hwy 10 (Cantrell) and Chenonceau Blvd. The speed limit is 50 MPH on Cantrell and most drivers exceed that. There have been at least 2 fatalities and more than 50 wrecks at that intersection. Why does the city have a design plan when it grants 75% of the variances it receives? Why bother having a plan? We built here with an understanding of exactly what would be surrounding our property, so as not to have our property devalued and we respectively request you adhere to the city plan. 1.25 acres is a far cry from the city requirement of 2 acres of land for a business. No traffic study is necessary when common sense screams backed up traffic, more wrecks and more fatalities. ...not to mention litter and loud music all hours of the day and night. McDonald's will apply for longer hours if established. It makes no sense to cram a drive thru on that lot, when 2 acre parcels are available elsewhere. It's already a dangerous intersection. The hours of operation are not conducive with our neighborhood or the other subdivisions in the area, neither is a drive thru restaurant of any kind. A drive-thru fast food restaurant with its high volume of traffic entering and exiting on this particular section of Hwy. 10 would create an extremely hazardous situation. The purpose of our letter to you is to indicate our strong opposition to the building of a 244hour drive -through restaurant on the corner of Chenonceau Blvd. and Highway 10. We have seen, and welcomed, new business growth in West Little Rock out Highway 10 over the past few years. However, we feel the current proposal for a drive-thru restaurant is not only outside the guidelines established by the City of Little Rock, but would pose significant public safety concerns for all the neighborhoods in our immediate vicinity. We feel it is inappropriate because it violates both the spirit and the letter of the Little Rock DOD for Highway 10 zoning and construction. The City of Little Rock set very specific standards for the DOD, based on a minimum size lot size of 2 acres, but the proposed variance request for this drive-thru shows the lot size in question to be less than 1.5 acres. We are asking the City of Little Rock Board of Directors to deny this requested variance and maintain the rules and standards already approved and in place for the DOD and this important corridor. The plot of land is simply too small. Secondly, traffic is already a concern for patrons of First Security Bank, the residents of Chevaux Court, The Ranch neighborhood, and for all the neighborhoods off Chenonceau Blvd. We have seen the number of traffic accidents escalate year after year, including one with a fatality (as confirmed by accident reports front City of Uttle Peck Police Department). I understand a lot of money and several very Janet Bartos knowledgeable and capable people prepared this DOD for the protection of the Highway 10 corridor while 75 Chevaux Circle allowing for appropriate development to take place. The Planning Commission stated at their August 7 868-8969 jpbartos@sbcglobal.net meeting, that they felt a drive-thru at this particular corner met the "spirit" of the DOD. If the DOD were adhered to as originally intended, there wouldn't have to be an interpretation of the "spirit" which is a very subjective thing. Is there a minimum lot size, less than 2 acres, that has been established as the least that can be granted a variance? A half or three-quarters of an acre less than 2 acres is too big a variance in my opinion. If variances must be granted, a business more in character with what is already in our neighborhood would not be so vigorously opposed. A drive-thru at this location would be totally inappropriate as it would bring additional traffic to an intersection that has already had since the year 2000, 55 traffic accidents, many with injuries and one fatality. The other businesses at this corner close at 9 or 10 p.m. A drive-thru has asked to have their hours of operation as 5 a.m. to 2 a.m. and I am certain they would apply to have their hours extended to 24 hours once they become established. This, too, is totally wrong for our quiet neighborhood. I would be happy to meet with you and look over the property in question if you feel so inclined. I am a resident of Bayonne Place and an immediate past -president of the Bayonne Place Property Owners Association. Our Property Owners Association is totally against having a McDonald's restaurant with a drive -through window at the corner of Highway 10 and Chenonceau and asks the Planning Commission to refuse the variance requested by Orion and McDonalds. This is not a good location for a high volume McDonalds for the following reasons: 1. This is yet another variance to the Highway 10 Design Overlay District that requires a minimum of 2 acres per building. 2. The high traffic level at this corner would cause a safety issue as vehicles exit onto Highway 10 which has a 50 mph speed limit...and we all know no one drives 50 on that stretch of highway! 3. The proposed hours of operation from 5 a.m. to I a.m. seven days per week would serve as a magnet to attract late -night undesirables to the area and cause an increase in the crime rate in our neighborhood — Bayonne - as well as surrounding neighborhoods — Aberdeen and Chevaux. 4. Property values will be negatively impacted with this McDonalds restaurant at the entrance to the Chenal Valley neighborhoods. 5. The neighborhood concept of livability will be violated with trash, noise and odor as well as air pollution from vehicles idling at the drive - through window. 6. We have been advised by many of our residents that they bought homes in Bayonne Place because of the peaceful atmosphere and neat appearance. A restaurant with a drive -through window will certainly compromise our peaceful atmosphere. 7. We do not understand why we need a second McDonalds in our neighborhood when there is already one located in the Wal-Mart Super Center one mile away. There are many other locations in the Highway 10 corridor that are not adjacent to residential neighborhoods and available for sale. We ask you, the Planning Commission members, to consider the wishes of the residents that you represent and refuse this request for a variance to the Highway 10 Overlay Plan. I would like to remind the Planning Commission members of your Mission Statement..."To enhance the quality of life for the citizens of Little Rock by providing a Department which encourages quality growth, development and redevelopment and the stabilization of neighborhoods through a concentrated effort of planning, land use controls, Historic Preservation, permitting and enforcement." As you have been advised by our earlier letter to you dated April 7, 2008, we are of the firm view that past representations of those involved in development of Chenal Valley, as well as Chenal generally, are being ignored, disclaimed and disavowed, and the quality of life in which we invested is, we are also convinced, directly threatened if not already damaged. A duplicate of that previous letter is transmitted with this communication. We understand this specific re -zoning request, the change from C-3 to Planned Commercial Development of Lots 1 and 2, at the corner of Chenonceau and Highway 10, is for the purpose of facilitating the development of a fast-food, drive -through operation — which, of course, would be dissimilar from the other commercial developments in the area and would convert our entrance into a high -traffic, late -night, loud, and, we believe, unnecessarily dangerous transformation to our neighborhood, impacting also our walking and exercise paths which were supposed to be for public benefit. It is also noted that we have attempted to learn from the developer the precise development intended for the land in issue, but that information has been deliberately withheld. This should not be tolerated, and the re -zoning should be denied on that basis alone, as land planning is directly impeded when the developer keeps known development plans secret. We do not believe we should be reduced to targets from congested traffic, or that the quality of our life should be directly altered, because a developer needs a zoning change to essentially change the nature of a neighborhood. We oppose this change emphatically. We oppose the lobbying we believe is occurring with regard to all the zoning activities taking place in Chenal generally. As you know, a substantial number of the residents of our subdivision, Bayonne Place, appeared at the Little Rock Planning Commission meeting held on February 28, 2008, to support our own interests and the interests of the residents of the nearby Aberdeen subdivision re zoning changes you are currently requesting as to land contiguous to the Aberdeen subdivision. We were very surprised to learn, as one Commissioner stated several times, the large tract of undeveloped land across from the Bayonne Place entrance and extending then on its eastern border north down Chenonceau Boulevard to Highway 10 is now, and as Mr. Spivey stated, has been since 1993, zoned Multi -Family 12 [referred to below as "MF 12" or "MF 6"]. Our problem with this is that such a zoning classification is dramatically different from the direct, written and widely distributed representations which came directly from Deltic Timber Corporation' and on which we have all relied in the substantial investments we have made in our homes. Whether we, or our builders, bought lots directly from Deltic Timber Corporation, or whether we bought our homes from prior owners, we were all provided with the "Chenal Valley Land Development Plan," and, because of this, we believed — as was expressly and explicitly 'No attempt is made here to define at this point the exact corporate identity of the exact entity which is responsible for these (mis)-representations. It would be either Deltic Timber Corporation or a subsidiary charged with the development of Chenal Valley. Deltic Timber Corporation Chenal Properties, Inc. April 7, 2008 Page Two represented by Deltic Timber Corporation in writing — nearby land, and specifically the above - referenced land, was to be used for "Limited Multi -Family" development described to us as high - end condominiums, patio homes, and, specifically, "Multi -Family 6" development. We, of course, have many copies of the written "Chenal Valley Land Development Plan" which remove from debate what was represented to us. We understand, and we believe we can ultimately prove, that "Land Development Plan" was distributed generally and routinely until approximately six months ago. We understand, and believe we can ultimately prove, Deltic agents were told to describe "Limited Multi -Family development" as condominiums, patio homes, and, specifically, "Multi -Family 6" development. Our representatives attended another meeting with representatives of Deltic Timber Corporation on April 2" d, 2008. We were told there would be no negotiation as to the MF 12 zoning classification. However, a representative of Deltic Timber Corporation acknowledged the "Chenal Valley Land Development Plan" represented what is asserted here, that a developer can always implement a land -use program with lesser density than the approved zoning classification, and there is no zoning classification "Limited Multi -Family." Because we view an MF 12 zoning directly across from our entrance [and this also is misrepresented on the "Chenal Valley Land Development Plan," for the reason that across the street from this entrance point is shown as a citypark on the "Chenal Valley Land Development Plan"], and covering the substantial acreage described above, as truly ruinous of the investments we have made, we are currently seeking to retain an attorney to pursue our claims, and we are, consequently, unsure at this point as to whether further consideration by the Little Rock Planning Commission will be requested or whether we should directly seek judicial remedies. We do, however, document at this point what we have now learned of the plans of Deltic Timber Corporation and will respond to protect our rights within a reasonable time. This rezoning request seeks permission to squeeze a fast-food restaurant with a drive -through window onto an undersized lot at an already busy intersection. A drive -through restaurant is dissimilar from the other commercial developments in this area and would convert Chenonceau Boulevard (which is the only access into our neighborhood) into an even more highly -trafficked, noisy late -night, dangerous roadway. Highway 10 already bears four lanes of high-speed traffic at this location and adding a large volume of transient vehicles constantly entering and exiting at this intersection will further congest the flow of traffic and increase the danger exponentially. Our request is that this rezoning request be denied and that the property be developed in an organized manner that conforms to the existing commercial zoning intended for this area.
