My husband and I are property owners, tax payers and avid voters who live in Chevaux Court.
The lot under consideration for McDonalds is too small for any drive-thru. While I understand the city wants the
tax revenue and Mr, and Mrs. Flake want to sell the property, 1.25 acres is too small for any drive-thru --- especially
on the corner of Hwy 10 (Cantrell) and Chenonceau Blvd. The speed limit is 50 MPH on Cantrell and most
drivers exceed that. There have been at least 2 fatalities and more than 50 wrecks at that intersection.
Why does the city have a design plan when it grants 75% of the variances it receives? Why bother having a
plan?
We built here with an understanding of exactly what would be surrounding our property, so as not to have our
property devalued and we respectively request you adhere to the city plan. 1.25 acres is a far cry from the city
requirement of 2 acres of land for a business.
No traffic study is necessary when common sense screams backed up traffic, more wrecks and more
fatalities. ...not to mention litter and loud music all hours of the day and night. McDonald's will apply for longer
hours if established.
It makes no sense to cram a drive thru on that lot, when 2 acre parcels are available elsewhere. It's already
a dangerous intersection. The hours of operation are not conducive with our neighborhood or the
other subdivisions in the area, neither is a drive thru restaurant of any kind.

serious problem. There was not even a traffic light until the Walton Heights
entrance.
Obviously, I anticipated commercial development in the area, but I trusted that
city officials would protect citizens from intrusive building that would damage the
quality of life in the area.
Now, we are facing the prospect of a fast food restaurant with drive -through
capabilities at the intersection of Cantrell and Chenonceau. The proposed
restaurant would be located on land that is not large enough for such a facility,
and the terrain is not appropriate for a drive -through. It would be located at an
intersection that has had multiple automobile accidents in the past. The
increased traffic in this area of Cantrell would seriously affect the residents in
Chevaux Court. It is already difficult to enter and exit Chevaux Court during
certain times of the day. Additional traffic would only add to the safety concerns
of our residents.
I respectfully request that you vote against the location of a fast food restaurant
at the intersection of Cantrell and Chenonceau.

I have retired, and my home is in the Chevaux Court Subdivision directly across
from the Ranch Subdivision. I am sending each one of our Board Directors this
message of my disapproval regarding the possible proximity of Chevaux Court to
a fast food restaurant on the lot at Chenonceau and Hwy. lo. There is a traffic
light at Hwy. io and Chenonceau, and I assume this is the reason we do not have
a traffic light on Hwy. io at Chevaux Court and the Ranch Subdivisions.
I am an older resident now and find that turning left onto Hwy. xo at Chevaux is
almost impossible at certain times of the day. Coming in and out of Chevaux is
presently a traffic accident about to happen.
The proposed drive -through restaurant at Chenonceau will only escalate traffic,
and it will be even more dangerous for us in Chevaux. Traffic on Hwy. io is only
going to increase more and more as time goes by. We must do all in our power to
add businesses carefully and responsibly as we add more and more traffic to Hwy.
io and to the subdivisions involved along Hwy. io.
I love Little Rock and every mud puddle in Little Rock, and I choose to live here
because my city is a beautiful and progressive city. Let us all make decisions that
all of us can be proud of.

I am writing to express my concern over the proposed zoning variance to allow for a
drive -through fast food restaurant to be located at the intersection of Highway 10 and
Chenonceau in West Little Rock. While I understand that this property has been zoned
for commercial use it does not meet the two acre requirement for the DOD and this
particular intersection is a very bad choice for this type of business.
There have been over fifty traffic accidents at this intersection (including one fatality)
over the past few years with traffic continuing to increase along Highway 10. With a
drive -through restaurant operating almost 24 hours a day it will make this intersection
even more congested and dangerous. There are many other more appropriate uses for
this piece of property and there are many other locations along Highway 10 that would be
more appropriate for a drive -through fast food restaurant.
I love Little Rock and want us to make every effort to keep our city as a great place to
live. While I understand that growth is very important it needs to be properly managed to
maintain the appeal of our wonderful city.

As residents of Chevaux Court, we are writing to express our strong opposition to the
building of a 24-hour drive -through fast food restaurant on the corner of Chenonceau
Boulevard and Highway 10. There are several reasons we oppose this construction.
According to the DOD of the city of Little Rock, the site is not large enough to
accommodate a business of this type. The DOD specifies a two acre plot and the sign
advertising the land states that it is only 1.25 acres. The developers are asking for a
variance from the rules and we ask that you not allow this to happen. The DOD has set
rules and standards for a reason.
Also, due to the rapid growth of businesses, schools, and churches along Highway 10, the
traffic has increased tremendously. The addition of a fast food restaurant would certainly
add to the congestion that is already a problem. Entering and exiting a fast food venue at
this site would be extremely difficult and would most likely cause back ups on the
highway.
Lastly, we have strong concerns about the safety of both our residents and those who live
near us. Many people enjoy the area for walking, jogging, and bicycling. In addition,
there is a neighborhood swimming pool on Chenonceau Boulevard that attracts many
families and young children. The increased traffic will surely have an adverse impact on
the residents.
Please be assured that we are not against growth in west Little Rock. We are only
suggesting that this type of business would be better located at a site that is more
appropriate both in size and in location.

I currently reside at #37 Chevaux Circle located in the subdivision of
Chevaux Court off Highway 10. As a member of the POA of Chevaux
Court, I am vehemently opposed to McDonalds locating a drive -through
restaurant at the corner of Hwy. 10 and Chenonceau. This type of restaurant
will cause severe traffic problems traveling west on Hwy. 10. The City of
Little Rocks' growth to the western part of the city has already created
increased traffic congestion on Hwy. 10.
Little Rock Christian Academy and The Bible Church are both located on
Hwy. 10, both have school programs, therefore increasing traffic flow. The
neighborhood of Chevaux Court is opposed to locating a drive -through
restaurant such as McDonalds on the corner of Hwy. 10 and Chenonceau.
Crimes invading homes and cars in west Little Rock has increased, and will
continue to increase if McDonalds is allowed to locate a drive -through
restaurant in this area. If McDonalds is allowed to locate a restaurant at
Hwy. 10 and the corner of Chenonceau, the ascetics and curb appeal of the
western part of the City will be compromised.

If variances must be granted, a business more in character with what is already in our neighborhood would
not be so vigorously opposed. A drive-thru at this location would be totally inappropriate as it would bring
additional traffic to an intersection that has already had since the year 2000, 55 traffic accidents, many
with injuries and one fatality. The other businesses at this corner close at 9 or 10 p.m. A drive-thru has
asked to have their hours of operation as 5 a.m. to 2 a.m. and I am certain they would apply to have their
hours extended to 24 hours once they become established. This, too, is totally wrong for our quiet
neighborhood.
I would be happy to meet with you and look over the property in question if you feel so inclined. There will
be a meeting, to which you are invited, about this issue on Thursday, August 28, 5:30 p.m. at Winfield
United Methodist Church, 20100 Cantrell Road. We will be grateful if you will plan to attend so that Chevaux
and surrounding neighborhoods can discuss our concerns with you.

I was born in Little Rock and have resided here for most of my 70 years. It is a place that
I dearly love. I currently reside at #65 Chevaux Circle in the Chevaux Court subdivision.
The request for a variance from the DOD at the location referenced above concerns me
for the following reasons:
1. The management of traffic due to the increased number of vehicles. There is a
proposed Elementary School at Hwy # 10 and Taylor Loop Road, as well as The Bible
Church and Little Rock Christian Academy(which is under a major expansion). With
traffic flowing at 45-50 mph it is extremely dangerous even now.
2. If we keep changing the development rule's, what does this mean for the rest of the
undeveloped property around us. 1 bought my home with the understanding that the
undeveloped property behind me would be single level quiet office. Now I'm concerned
it may be a Sonic or Wendy's.
3. The Planning Commissions states the the variance meets with the "spirit" of the DOD.
Can I build a building and just conform to the "spirit" of the Electrical Code and
Plumbing Code. Is that sufficient ??
Please help control our growing City. I know you are concerned or you would not be
serving in the capacity of Board of Director's, and for that I thank you all.

We live in Chevaux Court and we are very much opposed to the rezoning of the property
to allow a drive-thru fast food restaurant on this corner. The developer is asking for a
variance from the DOD. The DOD specifies a 2 acre plot and the sign on the property
says it is only 125 acres.
The traffic along CantrelllHwy 10 has increased greatly with the growth of homes,
businesses, churches, and schools. The speed limit in this area is 50 mph, but I can
assure you that this is a minimum speed. On this particular stretch of the road, it is
already dangerous to use the center turn lane (otherwise known to residents in the area as
the "suicide lane") because of the traffic backing up to make left turns. We live in a
quiet neighborhood with mostly older residents and we have concerns about the highway
safety of our residents and those that live nearby. A drive-thru fast food restaurant with
its high volume of traffic entering and exiting on this particular section of Hwy. 10 would
create an extremely hazardous situation.
We realize that this property is zoned for commercial development and we are not anti
business. If a variance must be granted, we would like to think that a business more in
keeping with the area and the traffic problems would be more appropriate.
We hope you will attend the Town Hall meeting about this issue on Thursday, August 28,
5:30 p.m. at Winfield United Methodist Church, 20100 Cantrell Road, so we can discuss
our concerns with you.

My wife and I have been residents of Cheavaux Court since April, 2001. The purpose of our letter to you is to
indicate our strong opposition to the building of a 244hour drive -through restaurant on the corner of Chenonceau
Blvd. and Highway 10. We have seen, and welcomed, new business growth in West Little Rock out Highway 10
over the past few years. However, we feel the current proposal for a drive-thru restaurant is not only outside the
guidelines established by the City of Little Rock, but would pose significant public safety concerns for all the
neighborhoods in our immediate vicinity.
We feel it is inappropriate because it violates both the spirit and the letter of the Little Rock DOD for Highway 10
zoning and construction. The City of Little Rock set very specific standards for the DOD, based on a minimum size
lot size of 2 acres, but the proposed variance request for this drive-thru shows the lot size in question to be less
than 1.5 acres. We are asking the City of Little Rock Board of Directors to deny this requested variance and
maintain the rules and standards already approved and in place for the DOD and this important corridor. The plot
of land is simply too small.
Secondly, traffic is already a concern for patrons of First Security Bank, the residents of Chevaux Court, The Ranch
neighborhood, and for all the neighborhoods off Chenonceau Blvd. We have seen the number of traffic accidents
escalate year after year, including one with a fatality (as confirmed by accident reports front City of Uttle Peck
Police Department). I am convinced that the addition of a business ort this �;c=f;~r, with a dri.v� thru restaurant,
open from 5:00 am until 2:00 am each duty, will only exacerbate this problem and result in even more accidents
an+d pp==iC 1p f t !i 4,ics, durim morning rush hour. Thera are many other possible sites located just off
Highway 10 that would offer much easier traffic flow and provide 41 much higher level of safety for both the
patrons of the drive-thru and for the residents of our neighborhoodz.
We appreciate your consideration of our request to maintain our safety as residents here, and to confirm your
commitment to the DOD plans for the Highway 10 corridor.

My name is Frank Pohlkamp. I am a resident of Bayonne Place and an
immediate past -president of the Bayonne Place Property Owners
Association.
Our Property Owners Association is totally against having a McDonald's
restaurant with a drive -through window at the corner of Highway 10 and
Chenonceau and asks the Planning Commission to refuse the variance
requested by Orion and McDonalds. This is not a good location for a high
volume McDonalds for the following reasons:
1. This is yet another variance to the Highway 10 Design Overlay District
that requires a minimum of 2 acres per building.
2. The high traffic level at this corner would cause a safety issue as
vehicles exit onto Highway 10 which has a 50 mph speed limit...and
we all know no one drives 50 on that stretch of highway!
3. The proposed hours of operation from 5 a.m. to I a.m. seven days per
week would serve as a magnet to attract late -night undesirables to the
area and cause an increase in the crime rate in our neighborhood —
Bayonne - as well as surrounding neighborhoods — Aberdeen and
Chevaux.
4. Property values will be negatively impacted with this McDonalds
restaurant at the entrance to the Chenal Valley neighborhoods.
5. The neighborhood concept of livability will be violated with trash,
noise and odor as well as air pollution from vehicles idling at the drive -
through window.
6. We have been advised by many of our residents that they bought homes
in Bayonne Place because of the peaceful atmosphere and neat
appearance. A restaurant with a drive -through window will certainly
compromise our peaceful atmosphere.
7. We do not understand why we need a second McDonalds in our
neighborhood when there is already one located in the Wal-Mart Super
Center one mile away.
There are many other locations in the Highway 10 corridor that are not
adjacent to residential neighborhoods and available for sale. We ask you, the
Planning Commission members, to consider the wishes of the residents that
you represent and refuse this request for a variance to the Highway 10
Overlay Plan.
I would like to remind the Planning Commission members of your Mission
Statement..."To enhance the quality of life for the citizens of Little Rock by
providing a Department which encourages quality growth, development and
redevelopment and the stabilization of neighborhoods through a concentrated
effort of planning, land use controls, Historic Preservation, permitting and
enforcement."

This is submitted as formal notice of the Bayonne Place Property Owners' Association's
opposition to any change in the current C-3 zoning classification regarding Lots 1 and 2, Chenonceau
Boulevard. As you have been advised by our earlier letter to you dated April 7, 2008, we are of the
firm view that past representations of those involved in development of Chenal Valley, as well as
Chenal generally, are being ignored, disclaimed and disavowed, and the quality of life in which we
invested is, we are also convinced, directly threatened if not already damaged. A duplicate of that
previous letter is transmitted with this communication.
We understand this specific re -zoning request, the change from C-3 to Planned Commercial
Development of Lots 1 and 2, at the corner of Chenonceau and Highway 10, is for the purpose of
facilitating the development of a fast-food, drive -through operation — which, of course, would be
dissimilar from the other commercial developments in the area and would convert our entrance into a
high -traffic, late -night, loud, and, we believe, unnecessarily dangerous transformation to our
neighborhood, impacting also our walking and exercise paths which were supposed to be for public
benefit. It is also noted that we have attempted to learn from the developer the precise development
intended for the land in issue, but that information has been deliberately withheld. This should not be
tolerated, and the re -zoning should be denied on that basis alone, as land planning is directly impeded
when the developer keeps known development plans secret.
We do not believe we should be reduced to targets from congested traffic, or that the quality of
our life should be directly altered, because a developer needs a zoning change to essentially change the
nature of a neighborhood. We oppose this change emphatically. We oppose the lobbying we believe is
occurring with regard to all the zoning activities taking place in Chenal generally. We will also
consider, subject to the advice and counsel of our attorney, challenging any change in the current
zoning classifications along with the other issues reviewed in the letter of April 7, 2008.

This letter is submitted for the purpose of documenting the position of the Bayonne
Property Owners Association with respect to the above -referenced matter. As you know, a
substantial number of the residents of our subdivision, Bayonne Place, appeared at the Little
Rock Planning Commission meeting held on February 28, 2008, to support our own interests and
the interests of the residents of the nearby Aberdeen subdivision re zoning changes you are
currently requesting as to land contiguous to the Aberdeen subdivision.
We were very surprised to learn, as one Commissioner stated several times, the large tract
of undeveloped land across from the Bayonne Place entrance and extending then on its eastern
border north down Chenonceau Boulevard to Highway 10 is now, and as Mr. Spivey stated, has
been since 1993, zoned Multi -Family 12 [referred to below as "MF 12" or "MF 6"]. Our problem
with this is that such a zoning classification is dramatically different from the direct, written and
widely distributed representations which came directly from Deltic Timber Corporation' and on
which we have all relied in the substantial investments we have made in our homes.
Whether we, or our builders, bought lots directly from Deltic Timber Corporation, or
whether we bought our homes from prior owners, we were all provided with the "Chenal Valley
Land Development Plan," and, because of this, we believed — as was expressly and explicitly
'No attempt is made here to define at this point the exact corporate identity of the exact
entity which is responsible for these (mis)-representations. It would be either Deltic Timber
Corporation or a subsidiary charged with the development of Chenal Valley.

represented by Deltic Timber Corporation in writing — nearby land, and specifically the above -
referenced land, was to be used for "Limited Multi -Family" development described to us as high -
end condominiums, patio homes, and, specifically, "Multi -Family 6" development. We, of
course, have many copies of the written "Chenal Valley Land Development Plan" which remove
from debate what was represented to us. We understand, and we believe we can ultimately prove,
that "Land Development Plan" was distributed generally and routinely until approximately six
months ago. We understand, and believe we can ultimately prove, Deltic agents were told to
describe "Limited Multi -Family development" as condominiums, patio homes, and, specifically,
"Multi -Family 6" development.
Our representatives attended another meeting with representatives of Deltic Timber
Corporation on April 2" d, 2008. We were told there would be no negotiation as to the MF 12
zoning classification. However, a representative of Deltic Timber Corporation acknowledged the
"Chenal Valley Land Development Plan" represented what is asserted here, that a developer can
always implement a land -use program with lesser density than the approved zoning
classification, and there is no zoning classification "Limited Multi -Family."
Because we view an MF 12 zoning directly across from our entrance [and this also is
misrepresented on the "Chenal Valley Land Development Plan," for the reason that across the
street from this entrance point is shown as a citypark on the "Chenal Valley Land Development
Plan"], and covering the substantial acreage described above, as truly ruinous of the investments
we have made, we are currently seeking to retain an attorney to pursue our claims, and we are,
consequently, unsure at this point as to whether further consideration by the Little Rock Planning
Commission will be requested or whether we should directly seek judicial remedies. We do,
however, document at this point what we have now learned of the plans of Deltic Timber
Corporation and will respond to protect our rights within a reasonable time.

Dear Mr. Bozynski:
On behalf of the Aberdeen Court Property Owners Association, I am writing to express
our opposition to Orion Capitol Ventures' request to rezone Chenonceau Boulevard Commercial
Lots 1 and 2 Short -form PCD from C-3 to Planned Commercial Development. This rezoning
request seeks permission to squeeze a fast-food restaurant with a drive -through window onto an
undersized lot at an already busy intersection.
A drive -through restaurant is dissimilar from the other commercial developments in this
area and would convert Chenonceau Boulevard (which is the only access into our neighborhood)
into an even more highly -trafficked, noisy late -night, dangerous roadway. Highway 10 already
bears four lanes of high-speed traffic at this location and adding a large volume of transient
vehicles constantly entering and exiting at this intersection will further congest the flow of traffic
and increase the danger exponentially.
Our request is that this rezoning request be denied and that the property be developed in
an organized manner that conforms to the existing commercial zoning intended for this area.
