As reflected on the Plat, all lots have at least a 10 foot wide utility easement adjacent to the street right-of-way. Drainage easements may be used for storm drainage and storm drainage overflow. No trees, shrubbery, structures, fences or similar improvements shall be grown, built or maintained within the area of such utility easement. In the event any trees, shrubbery, structures, fences or similar improvements shall be grown, built or maintained within the area of such easement, no person, firm or corporation engaged in supplying public utility services shall be liable for the destruction of same in the installation, maintenance, repair or replacement of any utility service located within the area of such easement. All Tracts designated on the Plat are hereby donated and dedicated by Deltic to the owners, as they may exist from time to time, within the Wildwood Place Neighborhood with the right, subject to further terms and conditions of the Plat and this Bill of Assurance, to use these 3 areas for landscaping. No improvements by any party shall be placed on any Tract unless first approved by Deltic, the appropriate agencies of the City of Little Rock, Arkansas, Wildwood Place Property Owners Association, Inc., and the Architectural Control Committee of Wildwood Place. The use of the areas designated on the Plat as Tracts G and I, Block 3, Wildwood Place, an addition to the City of Little Rock, Arkansas (herein "tract" or "Tract") are hereby donated and dedicated by Deltic to the owners, as they may exist from time to time, of lots within the Wildwood Place Neighborhood with the right, subject to further terms and conditions of the Plat and this Third Supplement to Covenants and Restrictions, to use this area for drainage, storm drainage overflow, landscaping and pedestrian paths. The Wildwood Place Property Owners Association, Inc. shall maintain such above ground areas and improvements at its sole cost. The City of Little Rock, Arkansas shall maintain, replace and repair all underground improvements. No improvements by any party shall be placed on the area designated as Tracts G and I, Block 3, Wildwood Place, an addition to the City of Little Rock, Arkansas, unless first approved by Deltic, the appropriate agencies of the City of Little Rock, Arkansas, Wildwood Place Property Owners Association, Inc., and the Architectural Control Committee of Wildwood Place. Subject to the terms and conditions of the Plat, the Original Covenants and Restrictions, as amended, and the restrictions of the U.S. Corps of Engineers described hereinafter, the use of the areas designated on the Plat as Tracts D and E, Block 3, Wildwood Place, an addition to the City of Little Rock, Arkansas, is hereby donated and dedicated by Deltic to the owners, as they may exist from time to time, of lots within the Wildwood Place Neighborhood with the right to use these areas, upon being given prior written approval by Developer and Wildwood Place Property Owners Association, Inc., for drainage, storm drainage overflow, pedestrian paths and landscaping. Tract D can be used for a neighborhood park that may include a swimming pool, pool house, playground, parking areas, lighting and other amenities related to the operation of a neighborhood park. Wildwood Place Property Owners Association, Inc. shall maintain any above -ground areas and improvements, including landscaping, pedestrian paths and neighborhood park improvements, at its sole cost. No improvements for a neighborhood park may be installed or constructed without approval by Deltic, the appropriate agencies of the City of Little Rock, Wildwood Place Property Owners Association, Inc. and the Architectural Control Committee of Wildwood Place. THE USE AND DEVELOPMENT OF PORTIONS OF TRACTS D AND E, BLOCK 3, ARE FURTHER RESTRICTED PURSUANT TO U.S. ARMY CORPS OF ENGINEERS SECTION 404 PERMIT NO. 2010-00682 AND THE PLAT. A COPY OF SUCH PERMIT MAY BE ACQUIRED FROM THE LITTLE ROCK, ARKANSAS DISTRICT OFFICE OF THE U.S. ARMY CORPS OF ENGINEERS. THE UNIMPROVED TRACTS MAY NOT BE 4 ALTERED OR IMPROVEMENTS CONSTRUCTED OR PLACED THEREON EXCEPT IN ACCORDANCE WITH THE AFOREMENTIONED PERMIT. THE AREAS SHOWN ON THE PLAT AS MITIGATION SITES SHALL BE PRESERVED FOR WETLANDS, STREAMS, RIPARIAN BUFFER AND WILDLIFE HABITAT MITIGATION, AND MAY NOT BE CONVERTED TO ANOTHER USE, INCLUDING, BUT NOT LIMITED TO, CLEARING, LOGGING, BUSH HOGGING, MOWING, SPRAYING WITH HERBICIDES, FILLING, LEVELING, DRAINING AND DUMPING. CONSTRUCTION OF ANY STRUCTURE OR ANY OTHER ACTIVITY THAT WOULD ADVERSELY IMPACT THE NATURAL STATE OF THE AREA IS PROHIBITED IN THE AREAS SHOWN AS MITIGATION SITE. PRIOR TO THE COMMENCEMENT OF ANY INSTALLATION OF UTILITIES WITHIN THE UTILITY EASEMENTS REFLECTED ON THE PLAT, THE UTILITIES PROVIDER MUST SUBMIT WRITTEN PLANS AND SPECIFICATIONS OF THE PROPOSED IMPROVEMENTS TO THE ARCHITECTURAL CONTROL COMMITTEE OF WILDWOOD PLACE AND DEVELOPER FOR REVIEW AND APPROVAL. What is the purpose of the 30 ft Drainage and Sewer Easement on the west side of Wildwood Creek Blvd in the vicinity of the mitigation area. If no drainage infrastructure is constructed or placed within the proposed drainage easement, the drainage portion of the easement should be removed; 2. The plat does not state the purpose of the Tracts D, E, F and G; 3. Note #2 should be modified and "drainage" removed. If drainage infrastructure is not constructed or installed within the easement, the plat should not reflect it being used for drainage; 4. The notes should state Tract G and F are overflow paths and should not be fenced over, obstructed, or filled in; 5. The notes should state the 10 ft and 15 ft drainage easements should not be fenced over, obstructed or filled in. General: Provide a maintenance bond for 50% of the value of improvements to streets and drainage infrastructure. Provide as -built plans for drainage infrastructure. Inlets and manholes: All inlets of depth greater than 36 in must have steps. Provide steps in the inlets located at Lot 11 of Block 3 and between Lot 66 and Lot 65 of Block 3. All inlets should be free of debris and construction waste. Remove construction waste from inlets located at Lot 8 of Block 4 and between Lot 77 and Lot 78 of Block 3. Curb and Gutter: Seal all curb and gutter joints with Sonneborn SL2 or equivalent sealant. Stormwater Quality: Overflow swales should be provided in accordance with planned 100-yr overflow path. Provide swales (min, Ift depth, 3:1 slope) within the drainage easements between Lots 66 and 65 of Block 3 and Lots 85 and 86 of Block 3. Provide rip -rap at storm drain discharge located NNE of Lot 86 of Block 3 to prevent scour. Open areas not planned for immediate use must be seeded or sodded in accordance with item 6 of issued grading permit (issued June 7, 2016 to McGeorge Contracting via Chuck Jones) and Little Rock Code of Ordinances Sec 29-190. Tracts D, E and F should be stabilized with vegetation prior to final approval. The City of Little Rock will not accept for maintenance slopes greater than 3:1 within the right of way. The side slope adjacent to the eastern side of Melicourt Boulevard within Tract E should be graded and vegetation established to meet this requirement. Traffic: Install traffic calming measures on Melicourt Boulevard in compliance with comment 19 of approval letter dated January 24, 2017. Install signage. Note: Requirements have not been met for release of completion bond for Wildwood Place Phase III with expiration date July 31, 2017. These include extending the sidewalk on the western side of Denny Road. Drainage plans for the southeastern side of the advanced graded area, where significant ponding has been observed, should be addressed. I am still waiting on comments from the Vance Harper and will email any comments provided by him. Also as noted in approval letter, please provide an electronic copy of the construction plans.
