SECOND SUPPLEMENT TO BILL OF ASSURANCE
This Second Supplement to Bill of Assurance executed this day of March,
2013, is made by Deltic Timber Corporation ("Deltic," also "Developer" or "Declarant") as

WHEREAS, Developer caused to be filed in the office of the Circuit Clerk and Ex-
Officio Recorder of Pulaski County, Arkansas, that certain Bill of Assurance to Chenal Valley,
an addition to the City of Little Rock, Arkansas, on November 12, 2009, Instrument No.
2009075892 (the "Original Bill of Assurance") creating the Tournay Circle Neighborhood, and
First Supplement to Bill of Assurance on May 15, 2012 as Instrument No. 2012029214;
WHEREAS, paragraph 1 of the Original Bill of Assurance specifically provides that the
Developer has the right to bring within the plan and the Original Bill of Assurance, as amended,
additional properties provided such properties are in accord with the general plan of development
and may contain such complimentary additions and modifications of the provisions of the
Original Bill of Assurance necessary to reflect the different character, if any, of the added
properties; and
WHEREAS, Developer files this Second Supplement to Bill of Assurance for the u

WHEREAS, all owners of lots within the Tournay Circle Neighborhood are members of
Tournay Circle Property Owners Association, Inc. as provided for in the Original Bill of
Assurance, as amended, and members of Chenal Valley Property Owners Association, Inc. as
provided for in the Covenants and Restrictions filed November 22, 1989, in the Office of the
Circuit Clerk of Pulaski County, Arkansas, as Instrument No. 89-61706, as amended (the
"Covenants and Restrictions"); and

WHEREAS, it is deemed advisable that all of the property shown on the plat hereinafter
mentioned be subdivided into building lots, a tract and streets as shown on the Plat filed herein,
and that said property be held, owned and conveyed subject to the protective covenants
contained in the Covenants and Restrictions and Original Bill of Assurance, as amended, in order
to enhance the value of the Toumay Circle Neighborhood.
NOW, THEREFORE, Developer for and in consideration of the benefits to accrue to it,
its successors and assigns, which benefits it acknowledges to be of value has caused to be made a
plat showing a survey made by Paul M. White, Registered Land Surveyor, dated
, and bearing a Certificate of Approval executed by the Department of
Comprehensive Planning of the City of Little Rock, and showing the boundaries and dimensions
of the property now being subdivided into lots, a tract and streets (the "Plat").
Deltic hereby donates and dedicates to the public an easement of way on, over and under
the streets and right of way on said Plat to be used as public streets. In addition to the said streets,
there are shown on said Plat certain easements for drainage, landscape and/or utilities which
Deltic hereby donates and dedicates, subject to other provisions of this Second Supplement to
Bill of Assurance, to and for the use of utilities ("utilities"), the same being, without limiting the
generality of the foregoing, electric power, gas, telephone, water, sewer and cable television with
the right hereby granted to the persons, firms or corporations engaged in the supplying of such
utilities to use and occupy such easements, and to have free ingress and egress therefrom for the
installation, maintenance, repair and replacement of such utility services.
The use of the area designated on the Plat as Tract D, Block 68, Chenal Valley, an
addition to the City of Little Rock, Arkansas, is hereby donated and dedicated by Deltic to the
owners, as they may exist from time to time, of lots within the Tournay Circle Neighborhood
with the right to use this area for drainage and utilities. The cost of the maintenance and
replacement of utilities on, under and over Tract D, Block 68, including, but not limited to, those
serving Lot 28, Block 68 as described in Paragraph 6 hereof, shall not be the responsibility of
Developer or Tournay Circle Property Owners Association, Inc. Excluding the aforementioned,
Tournay Circle Property Owners Association, Inc. shall maintain such area and improvements at
its sole cost. ADDITIONALLY, DELTIC HEREBY GRANTS TO ANY UTILITY PROVIDER,
AFTER RECEIVING WRITTEN CONSENT FROM DELTIC AND TOURNAY CIRCLE
PROPERTY OWNERS ASSOCIATION, THE RIGHT TO USE THOSE PORTIONS OF THIS
AREA WITHIN SAID TRACT SPECIFICALLY DESIGNATED AND IDENTIFIED BY
DELTIC AND TOURNAY CIRCLE PROPERTY OWNERS ASSOCIATION, INC. FOR
UTILITY AND DRAINAGE EASEMENTS PROVIDED SUCH IMPROVEMENTS ARE
MAINTAINED BY SAID UTILITIES. No improvements shall be placed on the area designated
as Tract D, Block 68, Chenal Valley, an addition to the City of Little Rock, Arkansas, unless first
approved by the appropriate agencies of the City of Little Rock, Deltic, Tournay Circle Property
Owners Association, Inc. and the Architectural Control Committee established pursuant to the

Covenants and Restrictions and By -Laws of Chenal Valley Property Owners Association, Inc.
(the "Architectural Control Committee").
PRIOR TO THE COMMENCEMENT OF ANY INSTALLATION OF UTILITIES
WITHIN THE UTILITY EASEMENTS REFLECTED ON THE PLAT OR WITHIN TRACT
D, BLOCK 68, CHENAL VALLEY, AN ADDITION TO THE CITY OF LITTLE ROCK,
ARKANSAS, THE UTILITIES PROVIDER MUST SUBMIT WRITTEN PLANS AND
SPECIFICATIONS OF THE PROPOSED IMPROVEMENTS TO THE ARCHITECTURAL
CONTROL COMMITTEE OF CHENAL VALLEY FOR REVIEW AND APPROVAL.
ALL UTILITIES TO BE INSTALLED BY UTILITIES PROVIDERS AFTER
PLATTING OF THE RIGHTS -OF -WAY MUST BE APPROVED PRIOR TO
COMMENCEMENT OF CONSTRUCTION BY THE PUBLIC WORKS DEPARTMENT OF
THE CITY OF LITTLE ROCK AND IF SUBSEQUENTLY INSTALLED IN THE RIGHTS -
OF -WAY OR IN ANY EASEMENT ADJACENT TO THE RIGHTS -OF -WAY SUCH
INSTALLATION MUST BE AT A DEPTH OF AT LEAST 30" BELOW THE ELEVATION
OF THE ADJACENT STREET.
The filing of this Second Supplement to Bill of Assurance and Plat for record in the
office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County shall be a valid and
complete delivery and dedication of the streets and easements subject to the limitations herein set
out.
The lands embraced in the Plat shall be forever known as Lots 24-29, Block 68, Tract D,
Block 68, and Lots 11-25, Block 69, Chenal Valley, an Addition to the City of Little Rock,
Arkansas, and any and every deed of conveyance of any lot in the Tournay Circle Neighborhood,
describing the same by the number shown on said plat shall always be deemed a sufficient
description thereof.
1. Landscape Easement. The ten foot Landscape Easement reflected on the Plat at
the western boundaries of Lots 19 thru 25, Block 69 shall be maintained by Tournay Circle
Property Owners Association, Inc. at its sole cost and expense.
2. Common Drive Easement. The use of the area designated on the Plat as Common
Drive Easement is restricted to the owners of Lots 18 thru 26, Block 69, Chenal Valley, an
Addition to the City of Little Rock, their guests, invitees, family members and contractors.
Provided, however, an easement is also hereby granted to the public for access to the Lots in the
case of a reasonable need created by fire, public safety, or other occurrence necessitating access
to a Lot by any utility, sanitation department, fire department, police department, United States
Postal Service or other public agency. The roadway constructed within the Common Drive
Easement and that portion of the Common Drive Easement located to the east of the roadway
shall be maintained by the Tournay Circle Property Owners Association, Inc.

3. Restrictions on Use and Vehicular Access. There shall be no vehicular access to
_ the street designated on the Plat as Tournay Circle from the rear of Lots 20 thru 25, Block 69.
These Lots will have access to Tournay —Mr—cleesolely from t ll�e Common Drive Easement located
at the front and/or side of their Lot as reflected on the Plat.
Owners of Lots 11 thru 17,, Block 6�9, .their successors and assigns, may not use the
Common Drive Easement or access their Lof aver the Common Drive Easement reflected on the
Plat.
4. Fencing. No fencing in excess of six (6) feet in height may be located on any
portion of Lots 20 thru 25, Block 69, without the written consent of the Architectural Control
Committee of Chenal Valley ("ACC"), the consent to which is solely within the discretion of the
ACC.
No fencing can be constructed closer than four (4) feet from the western boundaries of
Lots 11 thru 17, Block 69 (rear lot line) without prior written consent of the ACC, the consent to
which is solely within the discretion of the ACC.
5. Setback RCtJLIII-CIII Ws. No residence shall be located on any Lot described in this
Second Supplement nearer to the front lot line, side lot line or rear lot line reflected on the Plat as
follows:

For the purposes of this covenant, eaves, steps and porches not under roof shall not be considered
as a part of the building. Where two or more Lots are acquired as a single building site, the side
building lines shall refer only to those bordering the adjoining property owner.
6. Lot 28, Block 68 Sewer Service. There currently exists a sewer service line from
Lot 28, Block 68 across Tract D, Block 68, to the main sewer line located within the 10 foot
easement at the front of Tract D, Block 68. Said line provides sewer service to Lot 28, Block 68.
The owner of Lot 28, Block 68, its successors and assigns, shall be solely responsible for the
costs and expenses for the repair, maintenance or replacement of the sewer service line from Lot
28, Block 68 to the point it ties on to the main sewer line located within the 10 foot easement on
the south boundary line of Tract D, Block 68.
Said lands herein platted and any interest therein are hereby added to and made a part of
the Tournay Circle Neighborhood and shall, on and after the date hereof, be subject to all of
those certain terms, covenants and restrictions contained in the Covenants and Restrictions and
the Original Bill of Assurance filed November 12, 2009, as Instrument No. 2009075892, and all
supplements and amendments thereto, all of which are incorporated herein by reference and
made a part hereof and Deltic Timber Purchasers, Inc. executes this Second Supplement to Bill
of Assurance for the purpose set forth in paragraph 28 of the Original Bill of Assurance.
