The owner of this property intends to file their plat by Friday, April 22, 2011. The City of Little Rock
now requires a sign -off from every utility company before the plat can be recorded.
An email response or signed copy via email will suffice in lieu of a signed paper copy. If you would like to

The attached pdf has the easements I need to serve Lots 1 R,2 thru 5, and 8 — Lots 6, 7, & 9R
are fine — problem with Lots 10 and 11, there is no sewer available to them without making a
sewer main extension, give me a call when you have looked at this. As it stands I cannot sign
the plat.

KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, LITTLE ROCK DEVELOPMENT COMPANY, LLC (hereinafter called
"Developer") is the owner of the following property (the "Property"):
Lots 2 through 9, inclusive, TRACT 5, CHENAL VALLEY, AN ADDITION TO
THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS,
located in the City of Little Rock, Arkansas ("The Promenade at Chenal Shopping Center"); and
WHEREAS, REGIONS BANK, (hereinafter called "Bank") is the owner of the following
property (the "Outlot"):
Lot 1R, TRACT 5, CHENAL VALLEY, AN ADDITION TO THE CITY OF LITTLE
ROCK, PULASKI COUNTY, ARKANSAS,
located in The Promenade at Chenal Shopping Center; and
WHEREAS, the Developer executed on August 7, 20.07 and recorded on August 16,
2007, a "Bill of Assurance of the Promenade at Chenal Shopping Center" which was recorded in
the real property records of Pulaski County, Arkansas as Instrument No. 2007064617 (the
"Original Bill of Assurance") and Developer further executed on July 8, 2008 and recorded on
August 21, 2008, an "Amended and Restated Bill of Assurance of the Promenade at Chenal
Shopping Center" which was recorded in the real property records of Pulaski County, Arkansas
as Instrument No. 200805 773 8 (the "Amended Bill of Assurance"); and
WHEREAS, the Developer wishes to amend the Original Bill of Assurance and to file in
connection herewith an "Amended Plat'- (as defined below) for the purpose of further
subdividing the Property; and
WHEREAS, the Property shown on the "Amended Plat" has been subdivided into lots as
shown on the Amended Plat filed herewith and that said Property shall be held, owned and
conveyed subject to the covenants herein contained and as contained in the Original Bill of
Assurance and Amended and Restated Bill of Assurance; and
WHEREAS, the Bank consents to the proposed Amended Plat and this Second Amended
Bill of assurance.
NOW, THEREFORE, Developer, for and in consideration of the benefits to accrue to it,
its successors and assigns, which benefits it acknowledges to be of value, has caused to be made
a plat, showing the boundaries and dimensions of the Property now being subdivided into lots
(the "Amended Plat"), being a replat of LOT 1 R and Lots 2 through 9, inclusive, TRACT 5,
CHENAL VALLEY, AN ADDITION TO THE CITY OF LITTLE ROCK, PULASKI
COUNTY, ARKANSAS.

The lands embraced in the Amended Plat shall be forever known as "Lot 1R and Lots 2-
8, 9R, 10-11, Tract 5, Chenal Valley, an Addition to the City of Little Rock, Arkansas," and any
and every deed of conveyance of any lot in The Promenade at Chenal Shopping Center
describing the same by the number shown on said Amended Plat shall always be deemed a
sufficient description thereof.
Said lands herein platted and any interest therein shall be held, owned and conveyed
subject to and in conformity with the conditions and requirements set forth in the Original Bill of
Assurance and the Amended Bill of Assurance.
Iron pins have been set on all lot corners and points of curve and all lot dimensions
shown on curves are chord distances, and all curve data as shown on the Amended Plat filed
herewith is centerline curve data. In the event of minor discrepancies between the dimensions or
distances as shown on the Amended Plat and actual dimensions and distances as disclosed by the
established pins, the pins as set shall control.
Any or all of the covenants, provisions or restrictions set forth in this Second Amended
Bill of Assurance may be amended, changed or terminated, in whole or in part, by a written
instrument signed and acknowledged by Developer, the owner or owners of the lots affected by
such amendment, change or termination, in addition to the City of Little Rock, Arkansas; it being
agreed that if any amendment, change or termination of all or any portion of this Second
Amended Bill of Assurance would not affect a lot, then the consent of the owner(s) of such lot(s)
shall not be required for such amendment, change or termination.
