KNOW ALL MEN BY THESE PRESENTS: THAT, WHEREAS, Deltic Timber Corporation, a Delaware corporation, and its wholly owned subsidiary, Deltic Timber Purchasers, Inc., an Arkansas Corporation, (jointly "Deltic") are the owners of the following property: Lots 38 and 39, Block 83, Chenal Valley, an addition to the City of Little Rock, Arkansas. ("The Arbors Neighborhood"); and WHEREAS, JOHN THOMAS KENNEDY and KRISTI M. KENNEDY, husband and wife, (jointly and severally "Kennedy"), are the owners of the following property: Lot 43, Block 83, Chenal Valley, an addition to the City of Little Rock, Arkansas ("The Arbors Neighborhood"). WHEREAS, it has been deemed necessary to replat Lots 38, 39 and 43, and this Replat and Amendment to Bill of Assurance is executed for that purpose; and WHEREAS, the undersigned being the owners of more than seventy-$ve percent (75%) of the total area contained within The Arbors Neighborhood consent and agree to this replatting. NOW, THEREFORE, Deltic and Kennedy, for and in consideration of the benefits to accrue to them, their successors and assigns, which benefits they acknowledge to be of value, have caused to be made a replat, showing a survey made by Paul W. White, Registered Land Surveyor, dated the - - day of do fob , 2008, and bearing a Certificate of Approval executed by the Department of Comprehensive Planning of the City of Little Rock, and showing the boundaries and dimensions of the replatted property (the "Replat"). The lands embraced in this Replat shall be forever known as Lots 38R, 39R and 43R, Block 83, Chenal Valley, an Addition to the City of Little Rock, Arkansas ("The Arbors Neighborhood"), and any and every deed of conveyance describing same as shown on the Replat shall always be deemed a sufficient description thereof. This Replat and Amendment to Bill of Assurance amends the Bill of Assurance (the `Bill of Assurance") filed on June 30, 2004, in the Office of the Circuit Clerk and Ex Officio Recorder of Pulaski County, Arkansas as Instrument No. 2004051912 as amended by the Amended Plat and Amendment to Bill of Assurance filed on C:\Documents and Settings\Megreb\Local Settings\Temporary Internet Files\Content.IE5\OTMV05AN\REPLAT AND AMENDMENT TO BILL OF ASSURANCEv2.doc November 9, 2004, in the Office of the Circuit Clerk and Ex Officio Recorder as Instrument No. 2004092562 and as amended by the First Supplemental to Bill of Assurance filed on January 17, 2007 in the Office of the Circuit Clerk and Ex Officio Recorder of Pulaski County, Arkansas as Instrument No. 2007004832.
