BILL OF ASSURANCE: CHENAL HEIGHTS
ADDITION TO THE CITY OF LITTLE ROCK
WHEREAS, ATRS Retirement Properties, LLC, an Arkansas limited liability company,
is the sole owner of the real property described in Exhibit "A" attached hereto, and desires to plat
said property into lots:
NOW, THEREFORE, WITNESSETH:
That the said ATRS Retirement Properties, LLC, hereinafter termed grantor, has caused
said tract of land to be surveyed by WHITE-DATERS & ASSOCIATES, INC., Registered
Professional Engineer/Land Surveyor, and a plat thereof made which is identified by the title
"Chenal Heights addition to the City of Little Rock, Pulaski County, Arkansas" and the date
Aun�cfi 2005 and by the signature of the said engineer/surveyor and the said grantor and the
grantor does hereby make this Bill of Assurance, on the following terms:
1. The grantor does hereby certify that it has platted said real estate in accordance with
said plat. The lands embraced in said plat shall be forever known as designed on said plat; and
every deed of conveyance for said property shall use this designation.
2. The filing of this Bill of Assurance and plat for record in the Office of the Circuit
Clerk and exofficio Recorder of Pulaski County shall be a valid and complete delivery and
dedication of the streets and easements shown on the said plat.
3. All buildings constructed on said lots shall be constructed no nearer to the street than
the building line shown on the plat, and all buildings shall be constructed in conformance with
the Building Code and Zoning Ordinance of the City of Little Rock, Arkansas.
4. There is shown on that plat a lot designated as Tract "A," upon which is located a
water drainage and detention facility. By purchase of any other lot in the subdivision,
purchaser agrees to become a member of a nonprofit corporation to be organized by
which corporation shall be responsible for maintaining Tract "A" and the facilities therein, and
which corporation shall have the authority to assess owners of property within the subdivision
for their pro rata share of the costs of such maintenance, as well as the maintenance of any other
properties or facilities owned by said corporation, including common signage for the subdivision.
5. All facilities constructed and operated in the subdivision shall include the name
"Chenal Heights" within the name under which they operate, unless consented to by the owners
of at least sixty per cent (60%) of the surface area of the subdivision. All construction is subject
to review and approval by the Chenal Valley Architectural Control Committee ("Committee")
and shall otherwise conform to the recorded Declaration of Covenants and Restrictions for
Chenal Valley ("Declaration"). Additionally, site plans shall also be submitted to grantor for its
approval of the terms thereof, as to shared driveways, set -backs and consistency with existing
development, but no requirements imposed by grantor shall contradict those imposed by the
Committee or the Declaration. Prior to April 1, 2029, no part of the subdivision shall be used for
any use other than multi -unit residential retirement facilities without the consent of Deltic
Timber Corporation and grantor.
