HomeMy WebLinkAboutS-0867-EEEE Application2000021494 83/31/2000 02:07:59 PM Filed & Recorded in Official Records of � 5 FIFTH SUPPLEMENT TO BILL OF ASSURANCE CAROLYN 5TALEY PULASKI COUNTY CIRCUIT/COUNTY CLERK Fees $2E.00 This Fifth Supplement to Bill of Assurance executed this 23rd day of March, 2000, is made by Deltic Timber Corporation (the "Developer" or the "Declarant") as hereinafter set forth: WHEREAS, Developer caused to be filed in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, that certain Bill of Assurance to Chenal Valley, an addition to the City of Little Rock, Arkansas, on May 24, 1994, as Instrument No. 94-39014 (the "Original Bill of Assurance") creating the Bayonne Place Neighborhood, First Supplement to Bill of Assurance on February 9, 1996, as Instrument No. 96-11903, Second Supplement to Bill of Assurance dated December 16, 1997, as Instrument No. 97-083635, Corrected Second Supplement to Bill of Assurance on January 15, 1998, as Instrument No. 98-003471; Third Supplement to Bill of Assurance dated July 19, 1998, as Instrument No. 98-061437 and Fourth Supplement to Bill of Assurance dated December 22, 1998, as Instrument No. 98-101840. WHEREAS, the following real property is part of the Bayonne Place Neighborhood subject to the Original Bill of Assurance, to -wit: PART OF THE N1/2, SECTION 23, T-2-N, R-14-W, PULASKI COUNTY, ARKANSAS BEING MORE PARTICULARLY DESCRIBED AS: BEGINNING AT THE NORTHEAST CORNER OF LOT 47, BLOCK 25, CHENAL VALLEY, AN ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS; THENCE N68 ° 13'44"E ALONG THE SOUTH RIGHT=OF-WAY LINE OF EQUENNES DRIVE, 105.22 FT. TO THE POINT OF BEGINNING, CONTAINING 0.3157 ACRES MORE OR LESS (the "Unplatted Property"). WHEREAS, the previously described Unplatted Property is being platted as Lot 48, Block 25, Chenal Valley, an Addition to the City of Little Rock, Arkansas. WHEREAS, Developer files this Fifth Supplemental Bill of Assurance to reflect the new legal description to the Unplatted Property as Lot 48, Block 25, Chenal Valley, an Addition to the City of Little Rock, Arkansas. NOW, THEREFORE, Developer, for and in consideration of the benefits to accrue to it, its Successors and Assigns, which benefits it acknowledges to be of value, has caused to be made a Plat, showing a survey made by Paul M. White, Registered Land Surveyor dated 3'3 1—ov , and bearing a Certificate of Approval executed by the Department of Comprehensive Planning of the City ofLittle Rock, Arkansas, and showing the boundaries and dimensions of the Real Property now being divided into a Lot (the "Plat"). There are shown on said Plat certain easements for drainage and/or utilities which Developer hereby donates and dedicates to and for the use of public utilities, the same being, without limiting the generality of the foregoing, electric power, gas, telephone, water, sewer and cable television with the right hereby granted to the persons, firms or corporations engaged in the supplying of such utilities to use and occupy such easements, and to have free ingress and egress therefrom for the installation, maintenance, repair and replacement of such utility services. F:\HOME\PATP\DELTIGIbayor w-supboa5 wpd 2 The filing of this Fifth Supplement to the Bill of Assurance and Plat for record in the Office of Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, shall be a valid and complete delivery and dedication of the drainage and/or utility easements subject to the limitations herein set out. The land embraced in the Plat shall be forever known as Lot 48, Block 25, Chenal Valley, an addition to the City of Little Rock and any and every deed of conveyance of the Lot describing the same as shown on said Plat shall always be deemed a sufficient description thereof. Said land herein platted and any interest therein is hereby subject to all those certain terms, covenants and restrictions contained in the Bill of Assurance to Chenal Valley filed May 24, 1994 as Instrument No. 94-39014, and all supplements and amendments thereto, all of which are incorporated herein by reference and made a part hereof and Deltic Timber Purchasers, Inc. executes this Fifth Supplement to the Bill of Assurance of Chenal Valley for the purposes set forth in Paragraph 23 of the Original Bill of Assurance.
