3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO AMEND
4 THE CONTRACT WITH GENE SUMMERS CONSTRUCTION, INC., IN
5 AN AMOUNT NOT TO EXCEED FIFTY-FIVE THOUSAND DOLLARS
6 ($55,000.00) FOR ADDITIONAL STREET RECONSTRUCTION AND
7 RELAY OF A SEWER MAIN FOR THE WEST 10TH STREET
8 RECONSTRUCTION IMPROVEMENT PROJECT; AND FOR OTHER
9 PURPOSES.

11 WHEREAS, the Board of Directors of the City of Little Rock (the "City") adopted Resolution No.
12 16,435 (October 2, 2024) to authorize the City Manager to enter into a contract with Gene Summers
13 Construction, Inc., for the West 10th Street Reconstruction Project in an amount not to exceed Three
14 Hundred Twelve Thousand, Seventy-Two Dollars($312,072.00); and,
15 WHEREAS, a contract for the West I0t' Street Reconstruction Project was executed November 12,
16 2024, between the Acting City Manager and Gene Summers Construction, Inc.; and,
17 WHEREAS, after construction commenced, it was been determined that the intersection of 10th and
18 Maple needs to be reconstructed as part of the project,to provide proper drainage,and relay a sanitary sewer
19 main which conflicts with the new storm drain; and,
20 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. The Board of Directors hereby authorizes the City Manager to execute an amendment to
23 the contract with Gene Summers Construction, Inc., in an amount not to exceed Fifty-Five Thousand
24 Dollars ($55,000.00) for a revised total contract not to exceed amount of Three Hundred Sixty-Seven
25 Thousand, Seventy-Two Dollars ($367,072.00) for construction of the West 10th Street Reconstruction
26 Project.
27 Section 2. Funding for this project is from the 2022 Capital Improvement Bonds as authorized by
28 Resolution 15,968 (May 2,2023)with funds from Account Activity B I DOO6S.
29 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
31 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
32 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
33 resolution.

1 Section 4. Repealer.All laws, ordinances,resolutions, or parts of the same,that are inconsistent with
2 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
