WHEREAS, The Estate of Robert M. Guenther, Sr., is the sole owner of the following
described property in Pulaski County, Arkansas, and desire to plat said property: (See
Exhibit "A.")
NOW, THEREFORE, WITNESSED:
That we, the said Owner, hereinafter termed grantor, has caused said tract of land to be
surveyed by William Corbitt R. Shoeffner of Hope Consulting, Inc., and a plat thereof
made which is identified by the title, Robert Guenther Heritage Plat, and the date
and by the signatures of the said surveyor and the said grantor(s), and bears
a Certificate of Approval executed by the the Pulaski County Planning Board, and is on
record in the Office of the Circuit Clerk and ex-officio Recorder of Pulaski County,
Arkansas, in Plat Book ),O)-> _ Page and the grantor(s) do hereby make
this Bill of Assurance.
The grantor does hereby certify that they have replatted said real estate in
accordance with said plat. The lands embraced in said plat shall be forever known as
designated on said plat; and every deed of conveyance for said property shall use this
designation.
The grantor restricts Lot 2 and Lot 3 such that no residence may be built on Lot 2
or Lot 3 until a septic system is installed or such lots are connected to a sewage system.
The filing of this Bill of Assurance and plat for record in the Office of the Circuit
Clerk and ex-officio Recorder of Pulaski County shall be valid and complete delivery and
dedication of the easements and rights of way as shown on the said plat.
This Bill of Assurance shall run for a period of ten (10) years and thereafter shall
automatically renew itself every ten (10) years unless amended or terminated by a majority
of the property owners of the lots in the subdivision.

All buildings constructed on said lots shall be constructed no nearer to the street
than the building line shown on the plat, and all building shall be constructed in
conformance with the Pulaski County Subdivision and Development Code.

Thank you for talking. My client is Mr. James Guenther. His dad passed away last year leaving
behind a parcel of land that he asked to be divided between his three kids.
Although the words above sound like I'm talking about three completely new lots, it's actually one
existing lot gets bigger and two new lots.
I've spoken with Monte Moore and he tells me that if the utility companies have no objections this
can be approved at staff level which will save my client a lot of time an expense.
Attached is the proposed new replat. If you have questions, please let me know.

I left you a voicemail, this is the follow up to it.
My client is Mr. James Guenther. His dad passed away last year leaving behind a parcel of land that
he asked to be divided between his three kids.
Although the words above sound like I'm talking about three completely new lots, it's actually two
new lots (one just get bigger).
I've spoken with Monte Moore and he tells me that if you and the utility companies have no
objections this can be approved at staff level which will save my client a lot of time and expense.

All of my issues have been addressed. I have all of the utility approvals that you sent. I do not have a final sign -off from
our engineering division. They made initial comments on June 1, 2022 (below e-mail). Chris Smith is copied. Also, when
you bring the plat in to be signed, there will be a filing fee of $215.00.

Thanks for your time. Attached is a PDF of the latest survey that should incorporate your requests, and a request by the
city to "turn off the buildings" and "remove side setbacks." If this meets the County's requirements I'll have him send
me the CAD as well.
Also attached is the latest Bill of Assurance. In this latest document I've added a paragraph, "The grantor restricts Lot 2
and Lot 3 such that no residence may be built on Lot 2 or Lot 3 until a septic system is installed or such lots are
connected to a sewage system." Once again, if the Bill of Assurance is satisfactory please let me know.

I think we're almost there. Attached is a PDF from the City of Little Rock with their comments on it in BLUE.
Below are comments from the County:
-Show distance, bearing and state plane coordinate to a second section or quarter section corner.
-Show the center line of West Ridge Road and dimension the existing right of way.
-Show the plat title on the drawing (Guenther Heritage Plat).
-Pulaski County will need preliminary septic approval for any lots without septic systems.
The comment about preliminary septic approval... can Hope do that or do we need to get this from someone else? If
someone else, who do you recommend?
