BILL OF ASSURANCE
WHEREAS, DARRAGH INVESTMENT COMPANY, LLC, an Arkansas limited -liability
company ("Grantor"), is the owner of the following described land lying in the City of Little Rock, Pulaski
County, Arkansas:
Grantor has caused the land legally described as Tracts `C' and D', Rock Creek Industrial
Subdivision to the City of Little Rock, Pulaski County, Arkansas to be replatted pursuant to that certain
"Replat, Tract CD-R, Rock Creek Industrial Subdivision" prepared by Joe White & Associates, Inc.. (the
"Replat"). This Bill of Assurance and the Replat have been sig E b Granter, and the Replat is recorded
in the real property records of Pulaski County, Arkansas, as �� - Grantor does hereby
make this Bill of Assurance to govern and control the land described in the Replat.
HEREAFTER, conveyances and descriptions of the property as shown on the Replat shall be a
proper and sufficient description thereof.
Tract CD-R, Rock Creek Industrial Subdivision to the City of Little Rock, Pulaski County,
Arkansas, shall be conveyed by Grantor and shall be acquired by the grantees thereof subject to the
covenants contained herein and the Replat.
RIGHTS OF WAY: With the filing of this Bill of Assurance and the Replat in the real property
records of Pulaski County, Arkansas, the rights -of -way shown on said
Replat (if any) are hereby dedicated to the City of Little Rock. The utility
easements shown thereon on dedicated to the appropriate public utilities.
TERM/AMENDMENT: This Bill of Assurance shall be in full force and effect in perpetuity subject
to the following amendment and termination rights of the owners of the
Property. This Bill of Assurance may be amended or terminated at any
time from the date hereof by the written agreement of the owner of Tract
CD-R. Grantor is mindful of the decision in Rausch Coleman Homes, LLC
v. Brech, 2009 Ark. App. 225 (the "Decision") and does not wish for the
Decision to limit the ability of the parties to amend this Bill of Assurance
at any time and from time -to -time. Grantor intends that this Bill of
Assurance may be amended at any time from the date hereof throughout
the term of this Bill of Assurance and expressly intends and agrees that
this Bill of Assurance may be amended prior to any expiration or
termination date set forth herein.
RESTRICTIONS: Grantor and all future grantees of the property described in this Bill of
Assurance and the Replat specifically agree all ordinances of the City of
Little Rock shall be strictly adhered to and followed and, should the Replat
or this Bill of Assurance be contrary, in any way, to the ordinances adopted

by the City of Little Rock, from time to time, such ordinances shall have
precedence.
All buildings shall be constructed in conformance with the Building Code
and Zoning Ordinance of the City of Little Rock, Arkansas.

SUBDIVISION CONTAINED IN THE ORIGINAL BILL OF ASSURANCE, FILED AND
RECORDED IN THE PULASKI COUNTY, ARKANSAS, REAL ESTATE RECORDS ON
AUGUST 26, 2022, AS INSTRUMENT NO. 2022059613 AND THE PLAT FILED AS PLAT
NO. 2022059614.1
KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, K AND D HUCHINGSON LIMITED PARTNERSHIP, LLLP, an
Arkansas limited liability limited partnership ("Declarant"), did cause to be filed that certain Bill
of Assurance of Lots 3 and 4, Cantrell Village (hereinafter referred to as the "Bill of Assurance"),
recorded in the Pulaski County Real Estate Records on August 26, 2022, as Instrument No.
2022059613;
WHEREAS, simultaneously with the Bill of Assurance, the Declarant caused to be filed a
Plat of Lots 3 and 4, Cantrell Village in the Pulaski County Real Records as Plat No. 2022059613
(the "Plat"); and
WHEREAS, the survey of the real property depicted in the Plat is correct but a
typographical error in the written legal description is contained in the Plat and Bill of Assurance;
NOW, THEREFORE, in order to correct the written legal description of the real property
contained in the Bill of Assurance and Plat and for other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, the Declarant states as follows:

811.
