BILL OF ASSURANCE
WHEREAS, DARRAGH INVESTMENT COMPANY, LLC, an Arkansas limited liability
company ("Grantor"), is the owner of the following described land lying in the City of Little Rock, Pulaski
County, Arkansas:
Grantor has caused the land legally described as Tracts `C' and D', Rock Creek Industrial
Subdivision to the City of Little Rock, Pulaski County, Arkansas to be replatted pursuant to that certain
"Replat, Tract CD-R, Rock Creek Industrial Subdivision" prepared by Joe White & Associates, Inc.. (the
"Replat"). This Bill of Assurance and the Replat have been si by Grantor, and the Replat is recorded
in the real property records of Pulaski County, Arkansas, a5 �� Gt��� �' 4r Grantor does hereby
make this Bill of Assurance to govern and control the land described in the Replat.
HEREAFTER, conveyances and descriptions of the property as shown on the Replat shall be a
proper and sufficient description thereof.
Tract CD-R, Rock Creek Industrial Subdivision to the City of Little Rock, Pulaski County,
Arkansas, shall be conveyed by Grantor and shall be acquired by the grantees thereof subject to the
covenants contained herein and the Replat.
RIGHTS OF WAY: With the filing of this Bill of Assurance and the Replat in the real property
records of Pulaski County, Arkansas, the rights -of -way shown on said
Replat (if any) are hereby dedicated to the City of Little Rock. The utility
easements shown thereon on dedicated to the appropriate public utilities.
TERM/AMENDMENT: This Bill of Assurance shall be in full force and effect in perpetuity subject
to the following amendment and tennination rights of the owners of the
Property. This Bill of Assurance may be amended or terminated at any
time from the date hereof by the written agreement of the owner of Tract
CD-R. Grantor is mindful of the decision in Rausch Coleman Homes, LLC
v. Brech, 2009 Ark. App. 225 (the "Decision") and does not wish for the
Decision to limit the ability of the parties to amend this Bill of Assurance
at any time and from tune -to -tune. Grantor intends that this Bill of
Assurance may be amended at any time from the date hereof throughout
the term of this Bill of Assurance and expressly intends and agrees that
this Bill of Assurance may be amended prior to any expiration or
termination date set forth herein.
RESTRICTIONS.: Grantor and all future grantees of the property described in this Bill of
Assurance and the Replat specifically agree all ordinances of the City of
Little Rock shall be strictly adhered to and followed and, should the Replat
or this Bill of Assurance be contrary, in any way, to the ordinances adopted

by the City of Little Rock, from time to time, such ordinances shall have
precedence.
All buildings shall be constructed in conformance with the Building Code
and Zoning Ordinance of the City of Little Rock, Arkansas.

WHEREAS, K AND D HUCHINGSON LIMITED PARTNERSHIP, LLLP, an
Arkansas limited liability limited partnership ("Declarant"), is the owner of the following lands
lying in Pulaski County, Arkansas:
A PART OF THE W 1 /2, SE 1 A, NE1 A, SECTION 24, T-2-N, R-14-W, PULASKI
COUNTY, ARKANSAS; MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
COMMENCING AT A POINT LOCATED ON THE SOUTHWEST CORNER

WHEREAS, it is desirable that the Property be platted into lots;
NOW, THEREFORE, the Declarant, for and in consideration of the benefits to accrue to it
and its successors and assigns, which benefits Declarant acknowledges to be of value, has caused
the Property to be surveyed and a plat (hereinafter referred to as the "Plat"), a copy of which is
attached hereto as Exhibit A, made thereof by Benson John Leboeuf, Registered Land Surveyor
(No. 1900), and Joe D. White, Jr., Registered Professional Engineer (No. 7094), said Plat bearing
the signature of the said Surveyor and Engineer and being of record in the office of the Circuit

Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, as Plat Number
and the Declarant does hereby make this Bill of Assurance applicable to the Property.
IN FURTHERANCE THEREOF, Declarant warrants and represents that it has laid off,
platted, and subdivided, and does hereby lay off, plat, and subdivide the Property in accordance
with the aforesaid Plat. The Property embraced in said Plat shall be forever known as:
Lot 3 and Lot 4, Cantrell Village, an Addition to the City of Little Rock, being
part of Section 24, T-2-N, R-14-W, Pulaski County, Arkansas;
and any and every deed of conveyance of any Lot in said Addition describing the same by the lot
number shown on said Plat shall always be deemed a sufficient description thereof.
FURTHER, Declarant hereby dedicates to the public forever an easement of way on and
over the streets as shown on the Plat, to be used as public streets. There are strips of land shown
and dimensioned on t1he Plat designated as Utility and/or Drainage Easements, which are reserved
for the use of public utilities and/or drainage purposes, respectfully, subject to the rights of public
utilities and the public in general. The filing of the Plat and this Bill of Assurance for record in
the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, shall
constitute a complete and valid delivery and dedication of any and all streets and/or easements
shown on said Plat.
For purposes of this Bill of Assurance, "Lot(s)" shall mean and refer to any plot or tract of
land which is properly identified or designated as a lot on the Plat, and "Owner(s)" shall mean the
owner of a Lot and refer to each and every person or business entity who or which is a record
owner or subsequently becomes a record owner of a fee or undivided fee interest in any Lot.
All Owners of a Lot, and all persons, natural and artificial, claiming an interest in any Lot,
shall take their titles subject to the grants, rights, easements, retainage, privileges, restrictions, and
reservations herein contained, including but not limited to, the rights of public utilities in and
to the easements shown on the Plat.
FURTHER, for and in consideration of the benefits to accrue to Declarant and its
successors and assigns, which benefits Declarant acknowledges to be of value, Declarant for itself
and its successors and assigns, agrees that the Lots shall be subject to the following covenants and
restrictions:
Land Use and Building Type, Said Property herein platted as Lots shall be held, owned,
and used only for residential building sites. No structures are to be erected, altered,
placed, or permitted to remain on any Lot other than a single detached single-family
dwelling, a private garage for storage of passenger cars owned or used by the residents,
guest house, servant's quarters, and other outbuildings clearly incidental and related to
residential purposes of the premises.
2. Minimum Princi al Dwelling Size. No principal residential structure shall be
constructed or permitted to remain on any Lot unless the total square footage

determined by outside measurements of the actual heated and cooled floor area,
exclusive of porches, patios; carports, garages, and breezeways, shall be at least twelve
hundred (1200) square feet minimum. All dwellings placed upon said premises shall
be of new condition and shall be of quality workmanship and materials.
Building Location. No building, fence, or wall shall be constructed on any Lot nearer
to the street than the building line shown on the Plat. No residential structure shall be
located nearer than six (6) feet to an interior lot line or ten percent (10%) of the average
width of the single-family lot, whichever is greater. For the purposes of this covenant,
eaves, steps, and open porches shall not be considered a part of the dwelling. No
residential structure shall be nearer to the rear lot line than allowed by the City of Little
Rock.
4. Temporary Structures. No trailer, tent, shack, garage, hutment, barn, structure of a
temporary character, or outbuildings of any kind on said Property shall at any time be
used or occupied as a residence, temporarily or permanently.
5. Signs, Except for subdivision, monument, or identification signs, no billboard, poster,
or sign shall be placed or permitted to remain on any part of a Lot; provided, however,
one sign per Lot (not exceeding five (5) square feet in area) may be displayed
advertising the property for sale or rent, and signs used by the Declarant or a builder
may be displayed to advertise the property during the construction and sale period, or
otherwise with reference to model homes, etc.
6. Completion of Construction. Any dwelling must be completed in its entirety within a
period of one (1) year from the date such construction is commenced.
7. Garbage and Refuse _Disposal. No Lot or easement shall be used or maintained as a
dumping ground for rubbish. Trash, garbage, and other waste shall not be kept, except
in sanitary containers. There shall be no burning of trash, rubbish, leaves, or yard
waste.
8. Easements. Easements for installation and maintenance of utilities and drainage
facilities, and construction, repair, and maintenance of walls, roofs, and eaves are
reserved as shown on the Plat.
9. Term. These covenants are to run with the land and shall be binding on all parties
and all persons claiming under them for a period of ten (10) years from the date this
Bill of Assurance is recorded, after which time said covenants shall be automatically
extended for a successive period of ten (10) years, subject to the express provision that
these covenants may be amended at any time by an instrument signed by a majority
(being any amount greater than fifty percent (50.0%)) of the Owners of the Lots.
10. Enforcement. Enforcement shall be by proceedings at law or in equity to restrain
violations or to recover damages against any person or person violating or attempting
to violate any covenant.

11. Severability. Invalidation of any one of these covenants by judgement or court order
shall in no way affect any of the other provisions, which shall remain in full force and
effect.
12. Additional Lands. If Declarant owns or acquires additional lands, which the
Declarant desires in its sole discretion to encompass within the Addition ( "Additional
Lands"), then the Declarant, in its sole discretion, shall have the right, but not the
obligation, to annex said Additional Lands to this Addition. The annexation of the
Additional Lands by the Declarant, from time to time, may be made by filing of
record an Addendum to this Bill of Assurance adding and annexing the Additional
Lands therein described to the Addition. Under no circumstances shall this Bill of
Assurance or any subsequent annexation or addition to this Addition bind or require
the Declarant to make any annexation or addition to this Addition or to adhere to any
development plan, regardless of how that development plan is published or presented,
in any subsequent development of any lands now owned or hereafter acquired by the
Declarant. Nor shall the Declarant be precluded from conveying any lands it now
owes or hereafter acquires, not expressly made subject to the terms and provisions
hereof, free and clear of this Bill of Assurance. Except as herein allowed, there shall
be no other annexation or addition of lands into the Addition without the prior written
consent of the Declarant.

After reviewing the plats associated with this project, I do not see any issues with the replat. Our records indicate a gas
service line to 4808 Gooch Drive that should be located along the northern edge of the proposed Lot 3. In order to verify
the exact location of all gas facilities we recommend calling Arkansas One Call at 811.
