FEE $20.00 !f �rrlrell!11 Sif71�S� BILL OF ASSURANCE WHEREAS, DARRAGH INVESTMENT COMPANY, LLC, an Arkansas limited liability company ("Grantor"), is the owner of the following described land lying in the City of Little Rock, Pulaski County, Arkansas: Grantor has caused the land legally described as Tracts `C' and D', Rock Creek Industrial Subdivision to the City of Little Rock, Pulaski County, Arkansas to be replatted pursuant to that certain "Replat, Tract CD-R, Rock Creek Industrial Subdivision" prepared by Joe White & Associates, Inc.. (the "Replat"). RIGHTS OF WAY: With the filing of this Bill of Assurance and the Replat in the real property records of Pulaski County, Arkansas, the rights -of -way shown on said Replat (if any) are hereby dedicated to the City of Little Rock. The utility easements shown thereon on dedicated to the appropriate public utilities. TERM/AMENDMENT: This Bill of Assurance shall be in full force and effect in perpetuity subject to the following amendment and tennination rights of the owners of the Property. This Bill of Assurance may be amended or terminated at any time from the date hereof by the written agreement of the owner of Tract CD-R. Grantor is mindful of the decision in Rausch Coleman Homes, LLC v. Brech, 2009 Ark. App. 225 (the "Decision") and does not wish for the Decision to limit the ability of the parties to amend this Bill of Assurance at any time and from tune -to -tune. Grantor intends that this Bill of Assurance may be amended at any time from the date hereof throughout the term of this Bill of Assurance and expressly intends and agrees that this Bill of Assurance may be amended prior to any expiration or termination date set forth herein. Minimum Princi al Dwelling Size. No building, fence, or wall shall be constructed on any Lot nearer to the street than the building line shown on the Plat. No residential structure shall be located nearer than six (6) feet to an interior lot line or ten percent (10%) of the average width of the single-family lot, whichever is greater. For the purposes of this covenant, eaves, steps, and open porches shall not be considered a part of the dwelling. No residential structure shall be nearer to the rear lot line than allowed by the City of Little Rock. 4. Temporary Structures. No trailer, tent, shack, garage, hutment, barn, structure of a temporary character, or outbuildings of any kind on said Property shall at any time be used or occupied as a residence, temporarily or permanently. 5. Signs, Except for subdivision, monument, or identification signs, no billboard, poster, or sign shall be placed or permitted to remain on any part of a Lot; provided, however, one sign per Lot (not exceeding five (5) square feet in area) may be displayed advertising the property for sale or rent, and signs used by the Declarant or a builder may be displayed to advertise the property during the construction and sale period, or otherwise with reference to model homes, etc. 6. Completion of Construction. Any dwelling must be completed in its entirety within a period of one (1) year from the date such construction is commenced. 7. Garbage and Refuse _Disposal. No Lot or easement shall be used or maintained as a dumping ground for rubbish. Trash, garbage, and other waste shall not be kept, except in sanitary containers. There shall be no burning of trash, rubbish, leaves, or yard waste. 8. Easements. Easements for installation and maintenance of utilities and drainage facilities, and construction, repair, and maintenance of walls, roofs, and eaves are reserved as shown on the Plat. 9. Term. These covenants are to run with the land and shall be binding on all parties and all persons claiming under them for a period of ten (10) years from the date this Bill of Assurance is recorded, after which time said covenants shall be automatically extended for a successive period of ten (10) years, subject to the express provision that these covenants may be amended at any time by an instrument signed by a majority (being any amount greater than fifty percent (50.0%)) of the Owners of the Lots. 10. Enforcement. Enforcement shall be by proceedings at law or in equity to restrain violations or to recover damages against any person or person violating or attempting to violate any covenant. Invalidation of any one of these covenants by judgement or court order shall in no way affect any of the other provisions, which shall remain in full force and effect. 12. Additional Lands. If Declarant owns or acquires additional lands, which the Declarant desires in its sole discretion to encompass within the Addition ( "Additional Lands"), then the Declarant, in its sole discretion, shall have the right, but not the obligation, to annex said Additional Lands to this Addition. The annexation of the Additional Lands by the Declarant, from time to time, may be made by filing of record an Addendum to this Bill of Assurance adding and annexing the Additional Lands therein described to the Addition. Under no circumstances shall this Bill of Assurance or any subsequent annexation or addition to this Addition bind or require the Declarant to make any annexation or addition to this Addition or to adhere to any development plan, regardless of how that development plan is published or presented, in any subsequent development of any lands now owned or hereafter acquired by the Declarant. Nor shall the Declarant be precluded from conveying any lands it now owes or hereafter acquires, not expressly made subject to the terms and provisions hereof, free and clear of this Bill of Assurance.
