This Bill of Assurance is executed as of 2022 by

Whereas, Owner is the sole owner of the following described real property located in Little
Rock, Pulaski County, Arkansas (the "Real Property'):
Part of the NE1/4 SW1/4 Section 17, Township 1 North, Range 11 West, which lies
West of Lindsey Road in the City of Little Rock, in Pulaski County, Arkansas, more
particularly described as follows: Beginning at a found 1" pipe along the West right
of way line of Lindsey Road that is also the Northeast corner of the Lot 1-R Pratt
Cates Remmel Subdivision, thence leaving said right of way North 87 degrees 27
minutes 51 seconds West 596.08 feet; thence North 00 degrees 58 minutes 23
seconds East 324.95 feet; thence South 88 degrees 53 minutes 25 seconds East
449.69 feet to a point which is also on the west right of way of Lindsey Road; thence
continue along said right of way South 13 degrees 46 minutes 11 seconds East 62.32
feet; thence along a curve to the left having a radius of 823.94 feet having a chord
bearing and distance of South 23 degrees 59 minutes 45 seconds East 308.72 feet to
the point of beginning.
Whereas, in order to enhance the value of the Real Property, the Owner deems it advisable
for the Real Property to be reconfigured and subdivided into those lots that are more fully
illustrated on the Plat (defined below), with the understanding that said Real Property shall
hereafter be held, owned and conveyed subject to those covenants and conditions set forth herein
and pursuant to Arkansas Code Annotated section 18-12-103, as amended;
NOW, THEREFORE, Owner, for and in consideration of the benefits to accrue to it, its
successors, and its assigns, which benefits it acknowledges to be of value, has caused and does
hereby cause to be made and prepared by Eric Holloway, Registered Land Surveyor Number 1803
and dated as of a - a -,Z0 a a , 2022 a plat entitled:
Circle K Lindsey Addition, City of Little Rock, Pulaski County, Arkansas
bearing a Certificate of Approval executed by the Little Rock Planning Commission, and filed of
record, pursuant to Arkansas Code Annotated section 14-41-201 et seq., and other applicable law,
in the office of the Clerk and Ex-Officio recorder in Pulaski County, Arkansas, on
2022, in Plat Book and Page illustrating and
reflecting the bounds and dimensions of the Real Property along with the lots created pursuant
thereto and illustrated thereon (the "Plat").
The Real Property shall be forever known, laid off and platted as:
Lot 1 and Lot 2
Circle K Lindsey Addition,
City of Little Rock, Pulaski County, Arkansas
Hereafter, any conveyance of any portion of the Real Property by reference to the lot number
illustrated and identified on the Plat shall be a proper and sufficient legal description thereof.
The Real Property and any lots or interest therein shall be held, owned, and/or conveyed subject to
and in conformity with the following restrictive covenants, which restrictive covenants shall remain
valid and enforceable for a period extending 30 years from the date hereof, and shall be extended
as set forth below:
1. Setback Requirements, Building Code, Zoning Ordinances. The Real Property is
additionally subject to those additional building setback requirements, if any, and other applicable
building codes and zoning ordinances that the City of Little Rock, Arkansas may adopt or modify
from time to time.
2. Property Lines and Boundaries. Iron pins have been set on all corners of the Real
Property. In the event of minor discrepancies between the dimensions or distances as shown on
the Plat and the actual dimensions or distances as disclosed by the established iron pins, said iron
pins, as set, shall control.
3. Amendment. The Owner reserves the right to amend and/or modify the terms and
conditions of this Bill of Assurance at any time in order to cure ambiguities set forth herein,
conform the provisions hereof with applicable governmental rules and regulations, or otherwise
clarify the intentions of the Owner asset forth herein. Moreover, this Bill of Assurance can further
be modified or amended at anytime pursuant to the written consent of the subsequent owners of
the Real Property. All such amendment shall be reduced to writing and filed of record in the office
of the Circuit Clerk and Ex officio Recorder in and for Pulaski County, Arkansas.
4. Severability. Invalidation of any provision set forth herein or any part thereof by an
order, judgment, or decree of any court, or otherwise, shall not invalidate or affect any of the other
restrictive covenants, or any part thereof as set forth herein, and the remaining provisions hereof
shall remain in full force and effect.

This letter is to advise you that Entergy has three phase electrical lines in the vicinity of
proposed site near Lindsey Rd and Pratt Remmel Rd in Little Rock. Three phase or
single phase service at any of Entergy's available service voltages to this development
can be made from these lines depending on service needs and locations. Since this in
Entergy's allocated service territory, then Entergy has an obligation to serve the
development pursuant to Arkansas Public Service Commission rules once the customer
has met all of the prerequisite requirements for service.
When the project gets further along and specific information is required based on a
detailed development plan, then contact Entergy at 1-800-ENTERGY (1-800-368-3749)
and a work ticket will be made which will initiate the process for an Entergy engineer to
meet at the site.

Sewer Service
Dear Ms. Arps:
Little Rock Water Reclamation Authority has reviewed the tract of land located at 1-440 and Lindsey Road in
Little Rock, as indicated in the sketch you provided, for sewer service from the LRWRA System. There is
gravity sewer available to the site which is accessible for connection, and which has adequate capacity to
receive the sewage flow from normal development of the parcels in question.
A Service Connection Permit will be required for new building connection, at the time of connection to the
LRWRA System, which will require payment of the Connection and Inspection Fees in effect at the time of
connection, which as of this writing are $80.00 and $135.00, respectively (subject to increase January 1,
2022.)

According to our records water service is available to the previously described
property. The water facilities in this area were installed, have been accepted as part of
our system, and are being maintained by Central Arkansas Water. The new addition
will need to be evaluated once plans are available for installation of on -site fire
protection. Construction will be at the expense of the developer.
All Central Arkansas Water requirements in effect at the time of request for water
service must be met.
