WHEREAS, Grantor wishes to plat such lots into a final plat containing two lots, eliminate any easements and other platted setbacks on the original plat and any related bills of assurance, as amended, and after final platting own and hold such platted lots subject only to the easements, setbacks, dedications, restrictions and other matters set forth on the Final Plat as hereafter described; op a05a010val NOW, THEREFORE, for and in consideration of the benefits to accrue to Grantor, its successors and assigns, the receipt and sufficiency of such consideration being hereby acknowledged, Grantor hereby makes this Plat and Bill of Assurance, and hereby establishes the covenants, restrictions and conditions pursuant to which the Property shall be owned and used, which covenants and restrictions shall run with the Property as set forth below. 1. SPLASH AT BASELINE, CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS. Grantor has caused the Property to be surveyed and a plat ("the Plat") made thereof by Phillip Lewis, Arkansas registered professional engineer no. 9450, which Plat bears the signature of the surveyor and engineer and is recorded in the office of the Circuit Clerk and Record of Pulaski County, Arkansas as Instrument No. The Property shall henceforth be referred to as Splash At Baseline Subdivision, City of Little Rock, Pulaski County, Arkansas ("the Lot"), which description shall be sufficient in all respects and for all purposes. All persons or entities who are or become the fee owner of the Property which is platted as the Lot shall take title to it and hold it according to the terms of this Plat and Bill of Assurance and to the monuments and pins located on the ground. 2. Buildinp, Setback and Easements. All prior utility easements, drainage easements, setback lines, rights of ingress and egress, or other encumbrances or limitations on the use of the Lot are extinguished, and the building setback lines, rights of way, utility easements, shared access easements and other matters as shown on the Plat are now the sole and only setback lines, rights of ingress and egress, rights of way, easements and other encumbrances or limitations which apply to and bind the Lot. 3. Duration. The terms, conditions and restrictions of this declaration shall remain in full force and effect for a period of twenty-five (25) years from the date of filing, and shall be extended for consecutive periods of ten (10) years thereafter unless Grantor, its successors and assigns, files an instrument of record which modifies or terminates these covenants. 4. Severabili . Invalidation of any restriction set forth herein, or any part hereof for any reason shall not invalidate or affect any of the other restrictions, which shall remain in full force and effect.
