WHEREAS, (Mason Templeton and Debbie Elliott) are the sole owners of the following
described property in Pulaski County, Arkansas, and desire to plat said property:
Part of the Northwest Quarter of the Southwest Quarter of Section 4, Township 2
North, Range 14 West, Pulaski County Arkansas, more particularly described as
follows:
Commencing at the Southwest corner of the NW 1/4, SW'/4 section 4; thence South
89018'33" East 492.99 feet to the Point of Beginning; thence North 01148'48" East
433.17 feet; thence North 87102'50" East 335.16 feet; thence South 01048'48" West
454.78 feet; thence North 89018'33" West 334.06 feet returning to the Point of
Beginning, containing 3.403 acres, more of less. -� �' -= ~L_� %� 7 TS -7 7 C>
ALSO SUBJECT TO
A 25 foot access and utility easement along the west line of the Lot 1 Kirchner
Subdivision thereof.
NOW, THEREFORE, WITNESSED:
That we, the said Owners, hereinafter termed grantor(s), have caused said tract of land to
be surveyed by (SMITH AND GOODSON, PLLC), and a plat thereof made which is
identified by the title (LEEK SUBDIVISION) and the date (DULY 22, 2021) and by the
signatures of the said surveyor and the said grantor(s), and bears a Certificate of Approval
executed by the (LITTLE ROCK PLANNING COMMISSION) and the Pulaski County
Planning Board, and is on record in the Office of the Circuit Clerk and ex-officio Recorder
of Pulaski County, Arkansas, in Plat Book Page _ and the grantor(s)
do hereby make this Bill of Assurance.
The grantor(s) do hereby certify that they have replatted said real estate in
accordance with said plat. The lands embraced in said plat shall be forever known as
designated on said plat; and every deed of conveyance for said property shall use this
designation.
The filing of this Bill of Assurance and plat for record in the Office of the Circuit
Clerk and ex-officio Recorder of Pulaski County shall be valid and complete delivery and
dedication of the easements and rights of way as shown on the said plat. Included, is a 25'
private utility and access easement for the benefit of said tract owner(s) and the owner(s)
of the parcels adjoining said property.
This Bill of Assurance declares that the property is and shall be held, transferred,
sold, conveyed and occupied subject to the covenants, restrictions, easements, charges, and
liens set forth herein;
a) Grant of permanent right of private easement via driveway and utility access to
adjoining parcels.
b) Mi mum heated living area exclusive of porches, patios, garages, breezeways,
exterior stairways, porte cocheres, storage areas and out buildings shall equal
no less than 3,200 square feet in one story, or 3,500 square feet if a multi -story
residence.
c) No used or previously erected or temporary house structure, house trailer or
nonpermanent outbuilding shall ever be placed, erected or allowed to remain on
part of property.
d) Any abandoned and/or non-functioning junk vehicles, boats, trailers, trucks, or
heavy equipment are expressly prohibited.
e) Fences - Chain link is expressly prohibited.
f) Duty of Maintenance. Owners and occupants (including lessees) of any part of
the Property shall jointly and severally have the duty and responsibility, to keep
that part of the Property so owned and occupied, including buildings,
improvements and grounds in a well -maintained, safe, clean, and attractive
condition.

This Bill of Assurance shall run for a period of ten (10) years and thereafter shall
automatically renew itself every ten (10) years unless amended or terminated by a majority
of the property owners of the lots in the subdivision.
All buildings constructed on said lots shall be constructed no nearer to the street
than the building line shown on the plat, and all building shall be constructed in
conformance with the Building Code and Zoning Ordinance of the City of Little Rock,
Arkansas and the Pulaski County Subdivision and Development Code.
