Sherrill Road Little Rock, AR 72202-1552 411 2022026581 0415.202211:09:23AM RECORDED: 04-15-2022 11:14:54AM In Official Records of Terri Hollingsworth Circuit/County Clerk PULASKI CO, AR FEE $25.00 PLAT AND BILL OF ASSURANCE OF LOT 8-R, (BEING A REPLAT OF LOT 8, BLOCK 1, AND LOT 9, BLOCK 1, BEAR DEN ESTATES, AN ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS) ?vtz0��05� BEAR DEN DEVELOPMENT COMPANY, LLC, GRANTOR KNOW ALL PERSONS BY THESE PRESENTS: WHEREAS, Bear Den Development Company, LLC ("Grantor"), is the owner of certain real property in City of Little Rock, Pulaski County, Arkansas ("the Property"), more particularly described as Lot 8, Block 1, and Lot 9, Block 1, Bear Den Estates, an addition to the City of Little Rock, Pulaski County, Arkansas; WHEREAS, Grantor wishes to replat the Property into one lot, eliminate any easements and other platted setbacks on the original lots as shown on the previous plat and the related bill of assurance, and after replatting own and hold such replatted lot subject to the easements, setbacks, dedications, restrictions and other matters set forth on the Plat as hereafter described, but remaining subject to the Covenants and Restrictions (hereinafter referred to the "Covenants and Restrictions") of Bear Den Estates filed on in the Office of the Circuit Clerk and Recorder of Pulaski County, Arkansas as Instr. No. 2022003762; NOW, THEREFORE, for and in consideration of the benefits to accrue to Grantor, its successors and assigns, the receipt and sufficiency of such consideration being hereby acknowledged, Grantor hereby makes this Plat and Bill of Assurance, and hereby establishes the covenants, restrictions and conditions pursuant to which the Property shall be owned and used, which covenants and restrictions shall run with the Property as set forth below. Grantor has caused the Property to be surveyed and a plat ("the Plat") made thereof by Jared Pavatt, which Plat bears the signature of the surveyor and engineer and is recorded in the office of the Circuit Clerk and Recorder of Pulaski County, Arkansas as Instrument No. The Property shall henceforth be referred to as Lot 8-R, Bear Den Estates, an Addition to the City of Little Rock, Pulaski County, Arkansas ("the Lot"), which description shall be sufficient in all respects and for all purposes. 1. Title. All persons or entities who are or become the fee owner of the Property which is platted as the Lot shall take title to it and hold it according to the terms of this Plat and Bill of Assurance, the Covenants and Restrictions, and to the monuments and pins located on the ground. 2. Duration. The terms, conditions and restrictions of this declaration shall remain in full force and effect for the same period as the Covenants and Restrictions and may be extended for consecutive periods thereafter as set forth in the Covenants and Restrictions. 3. ecial Improvement Taxes and Bear Den Estates Communily Associ i n Inc. The Lot shall bear the sum of the assessments and taxes of the prior lots for purposes of special improvement district taxes which applied to Lots 8 and 9, Block 1. Lot 8-R, Block 1, as replatted, shall only be considered as one lot for purposes of the assessments and dues relating to or stemming from Bear Den Estates Property Owners Association, Inc. 4. Severabiiity. Invalidation of any restriction set forth herein, or any part hereof for any reason shall not invalidate or affect any of the other restrictions, which shall remain in full force and effect.
