This morning, 2 April, I was greeted by a contingent of representatives of Pulaski County, McClelland Engineering and Little Rock Public Works regarding our truck access from McMath. I had previously met with Sherman Smith, Pulaski County, in November about access and believed that we had reached a compromise. This morning I was told by the county representative that there would be no compromise, and that I would simply have to load in and out to trucks parked in the street. The representatives from the City said they really had no input, for the project is funded by the county. I address this to you, Mayor Stodola, for obviously this project should have been vetted before it began, with anyone affected by the project. And this project should have gone through a COA process, like any other project in the Historic area. And I remind you, that you are an ex-officio member of the Historic Commission. Mr. Carpenter, I remind you again, as in my letter to you 14 September 2011 that Little Rock Code of Ordinances Section 23-115 states that a COA is necessary and there is no provision for exemption. AR72202 Telephone 501/372-4488 Fax 501/371-0030 I should point out that the published Notice of Public Hearing of 12 1-888-BYLITES September 2011 was to include discussion about "widen McMath Street into www.byliles.com a boulevard w/median." But the staff report Item number two presented at the hearing excluded discussion about McMath from the hearing. When I protested, I was told I should "get a lawyer". I certainly hope it doesn't come to that. Ms. Priest, the Downtown Partnership has been a loyal customer of Bylites for many years, and it must be obvious that the additional time and labor to push cases 150' to a truck and up a ramp would be a cost that must be passed on to the customer. And all of us know, not many customers will appreciate that. Mr. Beck, in the eyes of the Public Works department, I'm sure you appreciate the how ludicrous it would be to block a street lane for hours at a time with large trucks, placing my employees at safety risk from traffic and discomfort in rain or cold. All for the vision of an improved landscape for visitors. To all I say, this refusal of the County to compromise will devalue the property of Bylites , and indeed soon cost the future of Bylites. I insist the City respond to the needs of one of its business' for the last 23 years at this location. Brian Minyard has requested of Sharon Priest and Truman Tollfree that the Conway Schulte group make a presentation to the Historic District Commission concerning the plan. Chairmen Peters asked what happens if a department of the city executes work in the MacArthur Park district without a COA. Ms. Weldon stated that it would be an enforcement issue. Chairmen Peters expressed his concern over the approval of the Conway Schulte plan without HDC approval. Commissioner Wiedower asked about the construction of structures or implementation of the plan. Debra Weldon stated that before implementation of any part of the plan occurs, the City of Little Rock would be required to obtain a COA from the HDC; i.e.: Korean Memorial. The Police Substation was also mentioned. A discussion was held about appeals to the HDC going to court instead of the Board of Directors. D: Work Plan Commissioner Wiedower complimented Staff on the format of the work plan. She continued that if the commission were going to adjourn in time, there would not be any discussion on the work plan tonight. Pulaski County Lane would extend in a serpentine fashion from Commerce Street to the Round -a -bout. Pulaski County Lane would have parallel parking on both the north and south sides of the street.
