PART A. PREAMBLE
WHEREAS, Kuhn Construction, LLC, the sole owner of the following land situated in Pulaski
County, Arkansas, to wit:
PART OF THE SW1/4 OF SECTION 6, T-2-N, R-14-W, PULASKI COUNTY, ARKANSAS,
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE
NORTHWEST CORNER OF THE NW1/4 SW1/4 OF SAID SECTION 6; THENCE
S01 041'03"W, ALONG THE WEST LINE OF SAID SECTION 6, A DISTANCE OF 58.14 FEET
TO THE POINT OF BEGINNING; THENCE S88'18'57"E, A DISTANCE OF 238.78 FEET;
THENCE S01 °40'26"W, A DISTANCE OF 1370.48 FEET TO A POINT IN THE CENTERLINE
OF NOWLIN CREEK; THENCE S86'13'59"W , ALONG SAID CENTERLINE OF NOWLIN
CREEK, A DISTANCE OF 240.11 FEET TO A POINT ON THE WEST LINE OF SAID SECTION
6; THENCE N01'41'03"E, ALONG SAID WEST LINE OF SECTION 6, A DISTANCE OF
1393.28 FEET TO THE POINT OF BEGINNING. CONTAINING 7.58 ACRES, MORE OR LESS.
LESS AND EXCEPT THE EXISTING RIGHT-OF-WAY FOR HOOD ROAD -
The Plat referenced herein bears the date October 2019, and the signatures of the said
Surveyor and the said Grantor, and bears a Certificate of Approval executed by the Pulaski
County Planning Commission, The Plat is of record in the office of the Circuit Clerk and ex-
officio Recorder of Pulaski County, Arkansas, as Instrument No. J00 and the
Grantor, in conjunction
therewith, does hereby make, and cause to be filed, this Bill of Assurance.
The Grantor certifies that it has subdivided said real estate in accordance with said Plat.
The lands embraced in said Plat shall be forever known as Lot 1A & 1 B, Pinnacles Subdivision
Phase 1 as designated on said Plat; and every deed of conveyance for said property shall use
this designation which will be a sufficient description thereof. Structures shall not be built on
Tract A as it's in the floodway.
NOW THEREFORE, in consideration of the purposes herein stated, Kuhn Construction, LLC, do
hereby designate said land above described as shown by said plat and make part hereof to be
know as "Lot 1A & 1 B", Pinnacles Subdivision, Phase 1, an addition to the City of Roland,
Pulaski County, Arkansas, and theater hereafter any conveyance by the Owner of said land by
lot numbers shall forever be held to be good and legal description. The use of the land in said
Subdivision being subject to the following Protective and Restrictive Covenants, which all also
be known as The Bill of Assurance.
PART B. PROTECTIVE AND RESTRICTIVE COVENANTS
B-1. LAND USE AND BUILDING TYPE. No lot shall be used except for residential purposes.
No business of any nature or kind shall at any time be conducted in any building located on any
of said lots except for real estate sales and marketing of lots and homes during the construction
phase. No building shall be erected, altered, placed or permitted to remain on any lot other than
one detached, single-family dwelling not to exceed two and one-half stories in height, excluding
basement area. Single car garages are not allowed. Garages may not be enclosed at a later
date without the approval of the Architectural Control Committee and the construction of another
two -car garage. In -Law Quarters are also permitted, but must architecturally conform to the
residence. The maximum allowable square foot is 50% of the residence. In no event shall any
structure allowed by this subsection be used for long term or short term rental property.
B-2. FENCING USE AND TYPE. If any builder or homeowner wishes to erect a fence, only
wood or brick privacy fences shall be allowed. An iron security fence will be acceptable. Chain
link fences will not be allowed. Also, no fence will come forward to the actual structure or the lot
building line, whichever is further back from the street, except that a house erected on a corner
lot may have a side fence no closer than 15 feet to the street on the side of a corner lot, such
fence to begin at least 15 feet behind the front property line. All other perimeter boundaries may
follow the lot line. All fencing so placed shall have the finished side towards the streets where
applicable. When fencing is installed, the finished side must face out unless the Architectural
Control Committee allows otherwise. Any variations in fencing must be approved by the
Architectural Control Committee.
B-3. NUISANCES. No unlawful, noxious or offensive activities shall be carried out upon lot, nor
shall anything be done or kept thereon which may be or become an annoyance or nuisance to
the neighborhood, or may adversely affect the value of other dwellings.
B-4. TEMPORARY STRUCTURES. No structure of a temporary character, motor home trailer,
travel trailer, basement, tent, shack, garage, barn or other out building shall be used on any
tract at any time as a residence either temporarily or permanently, unless agreed to in writing by
the Architectural Control Committee.
B-5. OUT BUILDINGS. All out buildings must be approved in writing by the Architectural Control
Committee, and may not be located on easements.
B-6. SIGNS. No sign of any kind shall be displayed to the public view on any lot, except two
professional signs advertising: "For Sale", "For Lease", "For Rent" (one for Real Estate and one
for builder). The signs will not be more than 2.5 square feet. No signs advertising any business
shall be allowed. Signs advertising "Yard Sales" will be temporarily allowed and they are to be
displayed not more than 1 day prior to the day of the sale and removed as soon as the sale has
ended.
B-7. GARBAGE AND REFUSE DISPOSAL. No lot or easement shall be used or maintained as
a dumping ground for rubbish. Trash, garbage and other waste shall not be kept except in
sanitary containers. All material shall be kept in a clean and sanitary condition, and not be
permitted at any time at a location which is visible from the front of the lot, except for the
evening prior to scheduled trash pickup through the following evening.
B-8. WATER SUPPLY. No individual water supply system shall be permitted on any lot. The
same shall be served by the Central Arkansas Water, or its assignee.
B-9. SEWAGE DISPOSAL. Individual sewage connections must be in the form of an approved
septic system, tested and approved by the State of Arkansas Health Department, servicing the
household of each Lot.
B-10. LOT, YARD AND HOME MAINTENANCE. All property owners, including builders, shall
keep all grounds and yards mowed, trimmed and clean, and all houses shall be painted or
stained. Nothing may be stored on a front porch or in front of the house. No homes can be kept
where they are a detraction to the neighborhood or unsightly.
PART C. GENERAL PROVISIONS:
C-1. TERM. These covenants are to run with the land and shall be binding on all parties and all
persons claiming under them for a period of twenty-five years from the date these covenants are
recorded, after which time said covenants shall be automatically extended for successive period
of ten years, subject to the express provision that these covenants may be amended at any time
after the date of execution by the owner or owners of a majority of the lots herein platted.
C-2. ENFORCEMENT. Enforcement shall be by proceedings at law or in equity or any
appropriate court against any person or persons violating or attempting to violate any covenant
either to restrain violations or to recover damages. If it is necessary to enforce this Bill of
Assurance and a person, or persons is found to have violated the Bill of Assurance, said
person(s) will be responsible for repaying the reasonable costs required to enforce and resolve
the violation.
C-3. SEVERABILITY. Invalidation of any one of these covenants by judgment or court order
shall in no way affect any of the other provisions which shall remain in full force and effect.
C-4. AMENDMENTS. These restrictions and covenants may be amended at any time by the
owner or owners of "Lot 1A & 1 B", Pinnacles Subdivision, Phase 1.
C-5. CONFLICTS. If there is a conflict within different paragraphs of this document, within a
single paragraph or between this document and the plat, then the more restrictive language or
interpretation will apply.
