This Bill of Assurance of Copper Run, Phase IV Subdivision, an Addition to the City

of Little Rock, Arkansas is executed this day of 202y, and is made by
Layman Lane LLC, an Arkansas Limited Liability Company, by Robert Graham Smith, its
authorized member, duly authorized by appropriate resolution of the members of Layman Lane
LLC, hereinafter referred to as "Developer":
1. Developer caused to be filed in the Office of the Circuit Clerk and Ex-Officio
Recorder of Pulaski County, Arkansas, a certain Bill of Assurance Covenants and Restrictions
Copper Run, Phase H, an Addition to the City of Little Rock, Arkansas, as Instrument No.
2020046639 on July 24, 2020, same is hereafter referred to as Phase H Bill of Assurance and;
2. Developer caused to be filed in the Office of the Circuit Clerk and Ex-Officio
Recorder of Pulaski County, Arkansas, a certain Bill of Assurance Covenants and Restrictions
Copper Run, Phase III, an Addition to the City of Little Rock, Arkansas, as Instrument No.
2021062749 on September 3, 2021, same is hereafter referred to as Phase III Bill of Assurance
and;
3. Developer hereby dedicates and declares the property described in Exhibit A
attached hereto and made a part hereof and incorporated herein as though specifically set forth
word for word, shall be held, transferred, sold, conveyed and occupied subject to the covenants,
restrictions, easements and charges as set forth in the Original Bill of Assurance, Covenants and
Restrictions, Copper Run, Phase H, an Addition to the City of Little Rock, Arkansas, Instrument
No. 2020046639 on July 24, 2020, and same are hereby incorporated herein as though set forth
word for word.
4. Developer has caused to be made a plat hereinafter referred to as "the "Plat", filed
herewith in the Plat Record Book as Instrument No.T' leJ . �;0[05� -4— , prepared
by Joe White & Associates, Inc. and by Joe D. White, Jr., Registered Professional Engineer, No.
7094, and showing a survey by Dane} W. Havner, Registered Land Surveyor, No. 1542, dated the

day of , 2021, and bearing a Certificate of Approval executed by the
Planning Commission of the City of Little Rock, Arkansas, and showing the boundaries and
dimensions of the property now being subdivided into lots, tracts and streets.
5. Developer, to the extent required, hereby donates, and dedicates to the public an
easement of way on, over and under the streets and rights of way on the Plat to be used and utilized
as public streets. In addition to the streets that are shown on the Plat, certain easements for drainage
and/or utilities which Developer hereby donates and dedicates to and for the use of public utilities,

without limiting the generality of the foregoing electric power, gas, telephone, water, sewer and
cable television with a right hereby granted to the persons, firms and corporations engaged in
supplying the utilities to use and occupy the easements and to have ingress and egress therefrom
for the installation, maintenance, repair and replacement of the utility services.
6. The filing of this Bill of Assurance and Plat for record in the office of the Circuit
Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, shall be a valid and complete delivery
and dedication of the streets and easements subject to the limitations herein set out.
7. The lands and property embraced in the Plat shall be forever known as:
COPPER RUN, PHASE IV SUBDIVISION,
AN ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS
Lots 31-35 Block 1
Lots 52-67 Block 2
Lots 14-26, Block 5
and any and every deed of conveyance of any lot so described shall be deemed to contain a
sufficient description thereof.

LRWRA has no objections to the Phase 4 Plat. We're awaiting As-Builts for phase 5 before approving.
Also, because this has been an issue in the past, please communicate with the builders that the manholes CAN NOT be
covered. We've dealt with them being covered by landscaping and/or driveways and this will cause inspection issues.

Traffic engineering has approved the roadway lighting plans for Copper Run Phase 4 & 5. Therefore, since all review
comments for Copper Run Phase 4 plat have been addressed, Department staff recommends recording of the final plat
for Copper Run Phase 4. Please coordinate with Mr. Monte Moore for final signature before recording with Pulaski
County.

Department engineering review comments on Copper Run Phase 4 & Phase 5 are below:
Copper Run Phase 4:
1. No comments. All comments have been addressed. However, per 31-403, street lighting plans are required to be
reviewed and approved prior to filing the final plat for the subdivision. Consultant has been notified of this
requirement, and staff is waiting on the documents to send to Traffic Engineering Division for their review and
approval.
Per City Code 31-434, a 50% maintenance bond is required to be submitted to the Department for the street
and drainage infrastructure improvements withing the public right of way. Staff requires this prior to recording
of the final plat for the subdivision. Staff has reviewed the costs for these improvements in accordance with the
City's weighted averages and have recommended issuance of the 50% maintenance bond. Staff is currently
waiting on receiving the 50% maintenance bond from the developer.
Copper Run Phase 5:
1. Comments are regarding Ownership and responsibility of Tract M & N, please identify on plat.
2. City surveyor may have additional comments on the subject plat.
3. However, per 31-403, street lighting plans are required to be reviewed and approved prior to filing the final plat
for the subdivision.
4. Per City Code 31-434, a 50% maintenance bond is required to be submitted to the Department for the street
and drainage infrastructure improvements withing the public right of way. Staff requires this prior to recording
of the final plat for the subdivision. This entails submission of an itemized list of unit costs for all street and
drainage infrastructure items within the public right of way for the Department's review and approval prior to
issuance of the 50% maintenance bond.

the City of Little Rock AND Final Plat of Copper Run Phase V, Lots 36-40, Block 1, Lots 40A, 41, 41A & 42-51, Block 2,
Tracts M & N, an addition to the City of Little Rock.
1. The owner needs to record PHASE 4 PLAT THIS FRIDAY, February 171n
2. They would like to record PHASE 5 PLAT BY Friday, February 24th
