the situation.

The purpose of this communication is to provide notice of an
apparent violation of the site plan approved by the Little Rock
Historic District Commission for the above property. We have
observed that a fence of approximately 8 feet -in height has been
erected around the perimeter of the development site, along the
east, north and south boundaries. It is our opinion that this
fence was erected without review or authorization of the Historic
District Commission; therefore, it must be removed or an
application made to that commission for approval.
Several features of this site plan such as the David O'Dodd
monument have been rendered inaccessible by the general public
due to the erection of the fence. This type of feature must be
addressed in the application file. If you require assistance in
the preparation of a filing, do not hesitate to contact this
office. The contact person will be Molly Satterfield by calling
371-6821. Your earliest attention to this situation would be
appreciated.

I am writing to advise you of plans of the University of
Arkansas with respect to the renovation project for the
University of Arkansas at Little Rock Law School at the
Technology Campus. This letter shall not be considered an
amendment of the application on file with the Commission.
As you are aware, this matter was considered by the
Commission on November 28, 1989, after which a certificate of
appropriateness with conditions was issued which subsequently
was determined by the City Attorney to be beyond the
Commission's authority. I understand that the matter was
discussed at the Commission's meeting on January 4, 1990, but
that no further action was taken.
The timing for resolution of this issue has created
several problems for us and I wanted to take this opportunity
to make you aware of our intentions on several matters. First,
the University is aware of the interest in the relocation and
restoration of the cottage and garage situated on the southwest
corner of the property (referred to as the Bentley cottage).
The current location impedes the construction and renovation of
the law school project. However, we will make every attempt to
seek a responsible party to remove the structure at nominal
consideration subject only to any requirements of public
bidding and proposals which may be necessary. The University
also anticipates that this can be done consistent with its
construction schedule.

The University has attempted to balance its lighting plan
for the project to include security lighting around the parking
areas for students, faculty and visitors along with decorative
lighting along the front of the building and certain walkways.
The cost of the decorative lighting that we have planned is
considerably less than the cost of lighting at the Terry
Mansion. Also, we understand that the maintenance cost of
Terry Mansion lighting would be significantly greater than that
proposed by the University. Again, we believe that it is
necessary for the security of students and faculty to proceed
with the lighting plan as proposed. However, we will ask our
architect to review these lighting plans with you or other
interested parties in order that you may understand
specifically how we have balanced the needs of the campuses and
those of the community.
Finally, the University will make every effort to have the
David O. Dodd memorial appropriately identified and not blocked
from view.
To further assist the Commission in understanding the
University's plans and its cost considerations we have asked
Mr. George Wittenberg, a project architect, to attend the
meeting and answer any questions. He will not, however, have
any authority to amend the application as filed or to bind the
University.
I sincerely hope that this information will be helpful
to you and the Commission and I will appreciate your
consideration of this matter.

Please be advised of a meeting of the Little Rock Historic District
Commission on February 1, 1990 at 5:00 p.m. in the Board Room at City
Hall which is being held to review the action previously taken by the
Historic District Commission on UALR's Certificate of Appropriateness
Legal Counsel for the City has advised us that the Historic District
Commission's Conditional Certificate of Appropriateness is not valid
without the applicant's agreement to the conditions which were attached.
The Commission has further been advised that George Wittenberg the
architect on the project, has been unable to obtain agreement from the
University on your ability to comply with the conditions attached to the
Certificate of Appropriateness.
Therefore the Certificate of Appropriateness with Conditions is
withdrawn and your Certificate of Appropriateness as initially submitted
will be reconsidered at this meeting. The Commission desires further
review of the application and would ask for you to have a representative
attend this meeting so that a final decision on the Certificate can be
made. Should you have any questions, please don't hesitate to contact
me.

Our staff has reviewed the proposed plans for the new construction and
demolition at the University of Arkansas Technology Campus - UALR School of Law
and cannot approve them as drawn. We feel strongly that demolition of the
c. 1920s English Revival/Craftsman Cottage and the c. 1910 red brick medical
school classroom building would be a grave loss to the MacArthur Park Historic
District.
We hope that the plans could be altered to include rather than destroy the
above mentioned properties. Our office will be happy to assist in any way.

Dear Molly:
The Historic Preservation Committee of the board of the Quapaw Quarter
Association offers the following response to its recent review of the
plans submitted by the UALR School of Law for its property at llth and
McAlmont Streets:
a) The committee is concerned by the sudden concern to have these plans
reviewed since they have been "in the works" long before this time.
They also expressed regret that they were offered so little time to
address their concerns regarding this proposal, and seem to have been
offered conflicting statements on the law school's intent for each of
the buildings.
b) The committee, acting in behalf of our board of directors, advocates
that no demolition of any of the designated structures occurs; if this
preventive measure is not possible, then at least, we request that each
phase of the project be reviewed as funding is approved so that current
conditions be assessed. The brick, 1920's Craftsmen's -style cottage and
the circa 1910 north classroom in particular, are of concern to the
committee. The suggestion is, therefore, to move these structures.
c) In reviewing the plans for a number of parking lots, the committee determined
that, due to the large number of them being planned, the elimination of
up to two rows along McAlmont would allow for some greenspace between the
lot and the existing sidewalk.
d) A request is also being made to verify the historic marker (David O. Dodd)
in order to determine whether it marks the exact location of the hanging,
or whether it could be moved without interferring with the plans for the
law school's sign at llth and McAlmont.
e) The law school is reminded that any lighting for this historic area be
erected with the approval of the city, and in keeping with the design of
those installed at the Terry Mansion, also in this district.
Thank you for offering us the opportunity to share our organization's concerns
with the ccatmission. We trust that an amicable agreement can be reached, once

Dear Bill:
T have been advised in conversations with legal counsel for the
University of Arkansas that architect George Wittenberg who
appeared on behalf of the University did not amend the
University's application for a certificate of appropriateness to
conform with discussions held during the meeting dealing with the
BET building, the small chancellor's house on the southwest corner
of the property, and other related conditions.
Inasmuch as the application for a certificate was not actually
amended, it appears we have some confusion over whether the
Historic District Commission can require a property owner to move
a building or require the expenditure of funds for securing the
BEI building, absent the owner's consent.
It is my opinion that without the consent of the landowner the
Commission does not have the legal authority to enforce these
conditions. The language in both the Historic District statute
and the City Ordinance do not confer this type of unilateral
authority on the commission. These conditions can only be
considered as recommendations relative to a determination an
whether a certificate of appropriateness should or should not be
issued. [Ark. Code Ann. 14-172-209; LRCC 1988 Rev. Section
23-133(c)].

Inasmuch, as this confusion exists, I have indicated to counsel
for the University my recommendation that this issue be revisited
by the Commission for clarification. Likewise, this issue tolls
the statute of limitations for purposes of appeal to Chancery
Court.
It is my advice that this matter be handled at your earliest
convenience so that we may clarify these issues and properly
advise the applicant of the commission's ultimate determination.

MacArthur Park Historical District Commission
II A. The Law Center project will consist of a complete renovation of the
existing Graduate Institute of Technology Building and a major addition
of new construction.
The existing G.I.T. Building is located adjacent to MacArthur Park near
downtown Little Rock. The G.I.T. Building will be completely renovated
to provide approximately 75,000 square feet of administration, office,
and classroom spaces. The building will be gutted to the existing frame
and exterior skin and completely new interior construction added
including all new mechanical, electrical, and plumbing systems.
A major expansion and addition will be added to the building to provide
approximately 60,000 square feet of new library space. The library will
contain both the Law School Collection and Pulaski County Bar
Collections.
The site will be redesigned to provide parking and new landscaping.

As you may be aware, the University of Arkansas is in the process of substan-
tial renovations and improvements to the building at 1201 McAlmont Street
presently known as the Technology Campus of the University of Arkansas. Once
renovated and ready for occupancy, the building will house the University of
Arkansas at Little Rock School of Law together with the Pulaski County Law
Library.
The property is owned by the Board of Trustees of the University of Arkansas
and we are advised that the property is situated in the McArthur Park
Historic District. Since University of Arkansas is considered to be the
State of Arkansas as a public institution of higher education, it
traditionally has not been subject to municipal requirements relating to land
use and housing codes. However, we also recognize the laudible purpose of
the History Districts Act, Act 484 of 1963 and accordingly wish to advise you
of the nature and extent of the renovations and improvements which we propose
to undertake together with any plans for adjoining properties owned by the
University, and to make application for a certificate of appropriateness. We
recognize, however, that a certificate of appropriateness may not be required
since the University is not required to obtain a building permit, but
nevertheless we wish to make sure that your Commission has had full
opportunity to review this project. Further this request shall in no way be
deemed a waiver of the attribute of state sovereignty which attaches to the
University.

I am aware that you and the Quapaw Quarter Association
("QQA") have expressed an interest in preservation of the
structure which has been referred to as the Bentley House and
garage which is located on the site of the new UALR Law
Center. UALR has no known future need for these structures and
they are located in such a way that they interfere with the
plans that have been developed. It is our desire, however, to
assure that ample opportunity has been provided for their
preservation.
UALR intends for its contractor to commence construction
on the site soon and we would like to extend to the QQA
the opportunity to remove the house and garage and relocate
them for renovation. We are prepared to issue a purchase order
in the amount of $1.00 for a licensed contractor whom you
identify. The Contractor's cost and any other cost of removal
would be paid by the QQA or such person or organization as you
might arrange. The contractor should meet certain basic
requirements in addition to licensing such as carrying
appropriate workers' compensation and liability insurance. We
will be happy to identify any other standard requirements if
you wish. We assume that the contractor obtained by you will
possess the necessary qualifications for moving and relocating
a structure of this type.

The contractor should be identified to UALR within 30 days
of the date of this letter and the structure should be removed
not later than 90 days from the date of this letter. The
University would prefer to expedite this schedule if possible.
If you have not identified a contractor and made the necessary
financial arrangements within 30 days from the date of this
letter, we would appreciate knowing the progress you have made
and whether you believe it is still possible to identify a
contractor and have the structures removed within the period
indicated. While the University reserves the right to take
such action to demolish the structures as it deems necessary
for the progress of the project, it does not anticipate that
this will be necessary prior to 90 days from the date of this
letter.
I am writing you because of the interest you and your
organization have expressed in preserving the structures.
I understand that a separate fund supported by QQA has been
formed to preserve structures such as these. I also understand
that through your membership and contacts of your organization,
you may know of other persons or firms which might be
interested in relocating the structures for renovation. It is
obviously the purpose of the University in making this proposal
to you that removal of the house and garage be for the purpose
of relocation and renovation. It is for this reason that we
are furnishing your organization the opportunity to arrange for
the preservation of this house and garage. You should be
aware, however, that should other persons or firms interested
in preserving this house and garage contact the University we
must explore with them any proposals which they might make
which would result in the expeditious relocation of the
structures and their preservation. Our intention in
approaching you first is to give you a reasonable period of
time to make the necessary arrangements and we do not
anticipate making other arrangements as long as you are able to
show reasonable progress in being able to successfully remove
and relocate the structures. The University, however, is not
bound to give you a first refusal or deal exclusively with
you.

This is to confirm our telephone conversation of today concerning the progress our
association has made toward relocating the Bentley House on the UALR School of Law's
property at 12th and McAlmont Streets.
As I mentioned to you, we are working on getting the house moved within the 90 day
period you've allotted to us. However we may not be in a position to notify you
by March 12 of our specific plans.
We trust that we may rely on your granting us an extension of time beyond the 30
day deadline specified in your letter, recognizing we are hopeful that our ability
to move the structure can be realized.
Our committee will continue to work on this project, and will keep you appraised
of our progress. Should there be any changes regarding the availability of the
building, we will appreciate your immediate notification.

Dear Mr. Shelby:
As per your request, I am writing to inform you and the UALR
School of Law regarding our present situation in working to
find a prospective buyer to purchase and subsequently move
the Bentley House presently located on the law school property
at 12th and McAlmont Streets.
As we've discussed by phone on several occasions, the Quapaw
Quarter Association has received several inquiries from buyers
interested in the property. Unfortunately, due to the substantial
costs in moving the structure to a suitable lot, most inquiries
have not resulted in an immediate offer.
However, as recently as yesterday, our office was contacted by
the Museum of Science and History, which expressed interest
in moving the house to their property, which is much closer
to its original site, representing a cost savings from prices
which would have been incurred by previous parties. The museum
is in a preliminary stage of developing their budget for this
project; among their concerns, along with the moving costs, are
whether they receive permission from the city to locate the
structure adjacent to their building, and, more importantly,
whether they can obtain approval from their board of directors
for this expenditure. Since their board is not scheduled to
meet till June, an immediate answer from them is not forthcoming.
We, therefore, request that the law school extend our deadline
in order to allow us to pursue this interest from the museum.
If allotted an additional 30 days, we feel that, at that point,
the museum could give us an answer. We await your response.

Your letter of July 21, 1992, to Roy St. Clair has been referred to me for
response.
As an initial matter, the University of Arkansas has consistently taken the
position that it is not subject to the zoning or planning jurisdiction of the City of Little
Rock or of the Historic District Commission. Although the Historic District
Commission did grant a Certificate of Appropriateness for demolition of two buildings
situated on the property, you may recall that the Commission withdrew any conditions
on that Certificate. The University brought this matter to the Commission at that time
because the demolition of the structures was a significant and irrevocable act and
although the University did not believe that the Commission had jurisdiction, it wanted
the Commission to be fully aware of the plans for demolition.
The University determined that the security fence around the parking lot which
is the subject of your letter was necessary and appropriate for this property and the
protection of University employees, students and guests. I am advised that there was
a meeting in February, 1992, between University officials and various persons
interested in the McArthur Park district with respect to security and other matters
related to the University's plans to become a neighbor in the area. At that meeting

meeting objected at that time to the construction of the fence.
You also indicate that the David 0. Dodd monument has been rendered
inaccessible to the general public due to the erection of the fence. This is not the
case. The monument, located at the northwest corner of the property, may be
viewed through the fence by members of the public and those who wish to actually
inspect or touch the monument may simply walk down McAlmont to where the fence
ends and walk over to the monument. The entire front of the building is open to
promote its park setting. Nevertheless, the University will be happy to review this
situation with representatives from Daughters of the Confederacy and other interested
parties to see if they would prefer to have the fence relocated behind the monument.
By copy of this letter, I am requesting that officials of the United Daughters of
the Confederacy and the Historic District Commission take the opportunity to visit the
site. We would be interested in their opinion since our intention was to provide a
more secure setting for the monument without limiting access. If they share your
view, we will consider taking steps to alter the fence location around the monument.
Please call me if you have further questions with regard to this matter.

It has been determined to grant your request for an extension of the deadline

It has come to our attention recently that a building on the
former GIT campus is availablet❑ parties wishing to preserve it.
Since we are planning major exhibits that will necessitate
additional space and the building in question is located very
close to our facilities, we'.are interested in pursuing the
feasibility of adding it to our physical plant.
We would therefore like to request that we be given an
adequate amount of time to research the feasibility of adding
the building to our facilities. This will include gathering
enough data to allow our board to make an informed decision.
We feel that 90 days is the minimum amount of time that we will
need.

This communication is in response to your request by telephone that
we offer some determination as to the historically correct placement of
the marker commemorating the military execution of David Owen Dodd. The
marker presently is situated near the corner of the grounds of the old
University Hospital east of MacArthur Park.
David Owen Dodd was hanged on the parade ground of St. John's
College. The gallows was placed directly in front of the main college
building and about fifty feet from the front door.
The enclosed section of an 1888 map shows where the St. John's build-
ing stood. It was directly east of the Arsenal (MacArthur Park), and the
parade ground where the hanging took place was between the two. We have
enclosed a portion of an 1893 map which shows the configuration of the
streets after the St. John's College building was destroyed.
The site of St. John's is now in the Interstate 30 freeway, and the
actual spot where the Dodd gallows stood is likely in the access road.
Only a portion of the parade ground of St. John's survives; this is the
area bordering MacArthur Park on the east. In my opinion the placement of
the Dodd marker anywhere in that area should be satisfactory from the
standpoint of historical values.
