WHEREAS, the Developer owns certain real property located in the City of Little Rock, Pulaski County, Arkansas, that is more fully described on EXHIBIT A attached hereto (the "Property") and desires to create, establish, maintain and preserve a quality land development project to be known as "La Marche Place Villas"; WHEREAS, the Developer filed of record in the Office of the Recorder in and for Pulaski County, Arkansas as Instrument Number a certain document entitled Declaration of Covenants, Conditions, and Restrictions for La Marche Place Villas that set forth certain provisions governing the ownership and administration of the Property (the "Declaration"); WHEREAS, in connection with the filing of the Declaration, the Developer additionally filed of record in the Office of the Recorder in and for Pulaski County, Arkansas as Instrument Number 90 a certain Final Plat applicable to the Property ("Final Plat"); WHEREAS, the Developer now desires to file of record in the Office of the Recorder in and for Pulaski County, Arkansas a Revised Final Plat, a copy of which is attached hereto as EXHIBIT B, that will serve to modify and amend the Final Plat for the purpose of identifying and describing the Home Specific Access, Utility and Easements that are more fully illustrated thereon ("Revised Final Plat"); NOW, THEREFORE, in consideration of the foregoing and the promises and benefits set forth herein, and to provide the means and procedures to achieve them, the Developer hereby: 1. Certifies that the Developer is the owner of the Property; that the Developer has ordered the land to be surveyed and divided in the lots as shown on the Revised Final Plat; that the Developer has adopted as the name of the subdivision that name identified within the Declaration and reflected on the Revise Final Plat; and that all lots identified on the Revise Final Plat shall hereafter be transferred in deeds as lot numbers within the subdivision named on the Revised Final Plat and in the Declaration; 2. Files of record in the Office of the Recorder in and for Pulaski County, Arkansas the Revise Final Plat with the understanding that the provisions thereof and legal descriptions therein shall govern the manner in which the lots identified thereon are subsequently sold, conveyed and transferred; 3. Subjects the lots identified on the Revise Final Plat to the Home Specific Access, Utility and Drainage Easements as are illustrated thereon and more fully described therein; 4. Ratifies and reaffirms that the Property continues to remain subject to the Declaration, the terms and conditions of which are incorporated herein by this reference; 5. This Bill of Assurance along with the Declaration may be further modified and amended pursuant to the provisions the Declaration; and 6. The streets, alleys, parks and other public lands are dedicated to the public in accordance with the terms and conditions of the Revise Final Plat.
