The lands embraced in said plat shall be forever known as designed on said plat; and every deed of conveyance for said property shall use this designation. The Owner(s) of this plat shall take their titles subject to the right of public utilities and the public. On the final plat for Phase 2, the platted lots with alley access will include a restricted access easement. The easement is to be a minimum of 10-feet in width. This restricted access easement is to prohibit vehicular access along the right of way and there is to be no right of vehicle access permitted along the lots with alley access. The filing of this Bill of Assurance and the plat for record in the Office of the Circuit Clerk and ex-officio Recorder of Pulaski County shall be a valid and complete delivery and dedication of the easements shown on said plat. GENERAL PROVISIONS (a) Nothing shall be allowable on premises in any zone established which would in any way be offensive or obnoxious by reason of color, design, or the emission of odors, liquids, gases, dust, smoke, vibration or noise. Nor shall anything be placed, constructed or maintained that would in any way constitute an eye -sore or nuisance to adjacent property owners, residents, or to the community. (b) No building shall be erected, placed or altered on any lot until the construction plans and specifications and a plan showing the location of the structure have been approved by the architectural control committee as to the quality of workmanship and materials, harmony of external design with existing structures, and as to location with respect to topography and finish grade elevation. No fence or wall shall to erected, placed or altered on any lot nearer to any street than the minimum building setback line unless similarly approved. (b) The architectural control committee is composed of Russ Huckaby and Bob Francis. A majority of the committee may designate a representative to act for it. In the event of death or resignation of any member of the committee, the remaining members shall have full authority to a designate a successor. Neither the members of the committee, nor its designated representative shall be entitled to any compensation for services performed pursuant to this covenant. At any time, the then record owners of a majority of the lots shall have the power through a duly recorded written instrument to change the membership or the committee or to withdraw from the committee or restore to it any of its powers and duties. The committee's approval or disapproval as required in these covenants shall be in writing. In the event the committee, or its designated representative fails to approve or disapprove within thirty (30) days after plans and specifications have been submitted to it, or in any event, if no suit to enjoin the construction has been commenced prior to the completion thereof, approval will not be required and the related covenants shall be deemed to have been fully complied with. I have attempted to recreate the quantities given by Ashley Bice using the following assumptions: Big Rock Avenue will be extended 300' and be 35' wide Center Stone Drive will be 800' and be 26' wide. Materials used will conform to LRPW details where developer -provided quantities are unavailable. I would advise against accepting this estimate with the following concerns: ACHM quantities are 35% and 20% below the expected value for Big Rock and Center Stone, respectively. a No details for any street section, including Mr. Bice's, include 6in depth Class 7. Collector streets require gin depth of Class 7. Under the assumption the line item "Class 7 Base Course — 8" " was intended for this section, the tin difference does not account for the estimate being 40% below the expected value. a Concrete sidewalk is 80% below the expected value. ® Pedestrian table dimensions are not in the provided plans, which state tables will be constructed "in accordance with detail on standard detail sheet." A standard detail for a pedestrian table is not provided in the LRPW standard details April 2015 edition. Plans do not indicate if ramps will be provided for the pedestrian table. Clarification is needed. Phase II includes pre-existing storm drain infrastructure, which has not been televised or otherwise inspected. Inspection costs should be included. Also, page C4.6 of the provided plans indicates pipe runs parallel to Center Stone and will remain in situ. Page C5.1 indicates pipe will be below the street. Clarification is needed. Contractor has been advised that southernmost 18in RCP crossing Center Stone drive appears to have been installed with unacceptable deflection. Pipe deflection should be surveyed to determine if removal and replacement is required. From visual inspection (July 18, 2017), rough grading, final grading and subgrade compaction all appear incomplete. No line item is provided for these tasks or removal of fill material. Estimate for signage is not provided. Stop signs, pedestrian crossing signs, speed -bump signs and object markers should be included. ® Estimate for vegetation of disturbed area is not provided. I have no concerns for the unit costs. Unit costs given are those provided within our 2014 weighted averages; however, that may not reflect realized costs on location.
