BILL OF ASSURANCE
KNOW ALL MEN BY THESE PRESENTS:
THAT, WHEREAS REGIONS BANK, an Alabama state banking corporation ("Grantor"), is
the sole owner of certain real property located in Pulaski County, Arkansas, with a legal description set
forth on Exhibit A attached hereto (the "Property"); and
WHEREAS, Grantor desires for the Property to be held, owned and conveyed subject to and in
conformity with the following covenants which, subject to being amended or canceled as hereinafter
provided shall be in and remain in full force and effect from the date the same are filed for record in the
Office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas.
NOW, THEREFORE, WITNESSETH:
Grantor has caused the Property to be surveyed by Paul M. White, Registered Land Surveyor
having Arkansas License Number RLS 1281, and a plat thereof made, which is identified by the title of
"Plat of Lot 1R, Block 6, Springdale Addition to the City of Little Rock, Arkansas" and dated January 7,
2015 (the "Plat"). This Bill of Assurance and the Plat, both of which have been signed by said Grantor,
are recorded in the Office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, in
Instrument Number a 1,S &0 -D 43 Grantor does hereby make this Bill of Assurance to govern
and control the Property described on the Plat.

Grantor hereby certifies that it is has laid off, platted, and/or subdivided, and does hereby lay off,
plat and/or subdivide the Property in accordance with the Plat. The Property, as shown on the Plat, shall
be forever known as "Lot 1R, Block 6, Springdale Addition to the City of Little Rock, Pulaski County,
Arkansas".
With the filing of this Bill of Assurance and the Plat in the Office of the Circuit Clerk and Ex-
Officio Recorder of Pulaski County, Arkansas, the rights -of -ways shown on the Plat are hereby dedicated
by Grantor to the City of Little Rock, Arkansas.
Hereafter, the conveyance and description of the Property by its lot number as shown on the Plat
shall be a proper and sufficient description thereof.
"Lot 1R, Block 6, Springdale Addition to the City of Little Rock, Pulaski County, Arkansas",
shall be conveyed by the Grantor and shall be acquired by any subsequent grantees thereof, subject to the
Plat and the terms of this Bill of Assurance.
That all buildings constructed on the Property shall be constructed no nearer to the street than the

Code and Zoning Ordinance of the City of Little Rock. Arkansas.
That the conveyance of the Property shall be subject to any applicable zoning classifications
and/or ordinances which may be in effect from time to time (including Ordinance No. 20,970 which was
recorded on December 4, 2014, in the Office of the Circuit Clerk of Pulaski County, Arkansas, as
Instrument Number 2014071719).
This Bill of Assurance shall be in full force and effect in perpetuity subject to the following
amendment and termination rights of the owner of the Property. This Bill of Assurance may be amended or
terminated at any time from the date hereof by the written agreement and consent of the owner of the Property.
The covenants, restrictions and provisions of this Bill of Assurance shall be deemed covenants running with the
land and shall remain in full force and effect for the term set forth above unless and until amended or
terminated as authorized hereinbefore. The parties are mindful of the decision in Rausch Coleman Homes.

LLC v. Brech, 2009 Ark. App. 225 (the "Decision") and do not wish for the Decision to limit the ability of the
parties to amend these covenants at any time and from time -to -time. The parties intend that these covenants
may be amended at any time from the date hereof throughout the term of this Bill of Assurance and expressly
intend and agree that these covenants may be amended prior to any expiration or termination date set forth
herein.
The invalidation of any one of these covenants or restrictions by judgment or court order shall in no
way affect any of the provisions, which shall remain in full force and effect.
