PULASKI CO,AR FEE$20.00 y ORDINANCE NO. 22,633 ky • `�}j t4�''AN ORDINANCE AUTHORIZING THE RIGHT-OF-WAY ABANDONMENT OF A PORTION OF THE EAST 16TH STREET RIGHT- S OF-WAY (APPROXIMATELY 55 FEET IN WIDTH BY 181 FEET IN 6 LENGTH) LOCATED IMMEDIATELY WEST OF BOYCE STREET IN 7 THE CITY OF LITTLE ROCK, ARKANSAS, (G-23-496); AND FOR 8 OTHER PURPOSES. 9 10 WHEREAS,a petition was filed with the City Clerk requesting that the Board of Directors abandon a 11 portion of East 16th Street right-of-way (approximately 55 feet in width by 181 feet in length) located 12 immediately west of Boyce Street; and, 13 WHEREAS,pursuant to Resolution No. 16,739,the Board of Directors for the City approved the right- 14 of-way abandonment; and 15 WHEREAS, proper notice has been provided to all utility companies and no objections have been 16 received regarding the proposed abandonment; and, 17 WHEREAS, the Planning Commission has reviewed the proposed abandonment and has 18 recommended approval; and, 19 WHEREAS, the City finds the portion of the right-a-way to be abandoned is no longer needed for 20 public use and the abandonment is in the best interest of the City;and, 21 WHEREAS, a hearing to abandon a portion of the East 6th Street right-of-way shall be held at a 22 meeting of the Board of Directors of the City of Little Rock in City Hall,2nd Floor Board Room, 500 West 23 Markham Street, Little Rock, Arkansas at six o'clock in the evening on July 1, 2025, or as soon thereafter 24 as the matter can be heard on the agenda. 25 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 26 OF LITTLE ROCK,ARKANSAS. 27 Section 1. The City of Little Rock, Arkansas, hereby abandons the public right-of-way interest in a 28 portion of East 16th Street described as follows: 29 Legal Description: 30 A portion of the East 16th Street right-of-way located in the City of Little Rock, 31 Pulaski County, Arkansas, being approximately 55 feet in width by 181 feet in 32 length, situated immediately west of the intersection of East 16th Street and Boyce [Page 1 of 2] 1 Street,and more particularly described in the accompanying plat and survey(G-23- 2 496),which is incorporated herein by reference. 3 Section 2. All public utility easements located within the above-described right-of-way shall remain 4 in effect unless otherwise released by the appropriate utility provider(s). 5 Section 3. A copy of this ordinance, along with a certified copy of the accompanying plat, shall be 6 filed in the real estate records of the Pulaski County Circuit Clerk's Office. 7 Section 4. This ordinance shall not take effect until all requirements of the City's Planning and 8 Development Department and the City Attorney's Office have been satisfied, including but not limited to, 9 the filing of necessary documents and the payment of all applicable fees. 10 Section 5. A hearing to abandon a portion of the East 16th Street right-of-way shall be held at a meeting 11 of the Board of Directors of the City of Little Rock in City Hall,2nd Floor Board Room,500 West Markham 12 Street, Little Rock, Arkansas at six o'clock in the evening on July 1, 2025, or as soon thereafter as the 13 matter can be heard on the agenda 14 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 15 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 16 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 17 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 18 ordinance. 19 Section 7.
