He violated and did not meet the regulations of the City Ordinance, Section 23-132 (a) and © for the demolition of a fence. In order to secure the owner's obligation of fulfilling the LRHDC's regulation, I would like to ask that your division not issue a Certificate of Occupancy for the structure's five apartments until the owner meets the historic district's regulations and LRHDC approval is granted. He must construct a fence along the property lines on the north, south and west sides of the property; the fence must be wooden or of other opaque material, at least 65" in height and must be approved by this office and the LRHDC. The owner is defiant in not following the appropriate demolition procedures and in not constructing the required fence. Your cooperation on this effort would be greatly appreciated as the owner has violated a regulation of the city's historic district ordinance. Initially we felt the existing fence might fit well with the "New Orleans" appearance we were trying to achieve. Later, a decision was made to replace the 6 foot opaque/privacy fence on the North, South & West side with a 3 foot translucent/lattice fence for the following reasons: First ... It was structurally unsafe -rotten posts and boards. Second... After speaking with a few neighboring property owners and tenants, it was apparent that a tall privacy fence surrounding the property created the "perfect environment" for criminal activity and transient loitering. Enclosed you will find a `chronological Sequence of Events" along with supporting Exhibits concerning "The Fence" that has occurred over the past months. The property owners ( Randy Mourning/Molly Satterfield) on the north side want a 6 foot opaque/privacy fence (see Exhibit E) for tenant traffic flow and visual privacy. A 6 foot fence will not provide visual privacy (see Exhibit H) and furthermore would be contrary to the Historic Districts Design Guidelines (see Exhibit J). It is our position, along with the LR Crime Prevention Unit (see Exhibit G), that a tall opaque/privacy fence surrounding this property would once again create a "perfect environment" or "open invitation" for criminal activity. It would be unsafe for property owners and their tenants. Being so close to the building it would create dark corridors along both sides of the building. Additionally, it is not Historic. Since "lattice" material for fencing was denied, although prevalent throughout the Little Rock Historic Districts, we have selected from a list of approved fences in the Design Guidelines Handbook (see Exhibit J) a 3 foot translucent/picket fence which will address both issues of safety and tenant traffic flow. On May 4, 2000, you requested approval of a Certificate of Appropriateness (COA) to paint, install shutters, ornamental ironwork and an iron fence in the front yard. Your request was approved on condition that the ironwork and shutters be reviewed and authorized by staff, a copy of the minutes and design guidelines are attached for your information. On June 13, 2000, you submitted the required paperwork for the ornamental ironwork and the decorative shutters; your submission was approved by the LRHDC Chair and staff. On June 15, you telephoned and requested approval to remove the existing white board fence on the north, south and west sides of the apartments. Roll call was taken; as there was a quorum, the minutes were approved unanimously. The first Certificate of Appropriateness (COA) application for consideration was: Applicant: Glenn Kubeczka Address: 920 Rock Street Request: Apartment rehabilitation (new windows, shutters, ironwork and fence) The new owner of the property presented the request to repair the apartments by making the following changes: complete rehab of the interior, new roof, new exterior vinyl shutters, exterior painting and new ironwork (railings and fence). The ironwork will be attached to the front facade with horizontal decorative work along the top, middle and bottom; the vertical ironwork will cover the existing brick columns, which extend slightly from the surface. It will have a "New Orleans styled" appearance with the brick and ironwork. The fencing will along the sidewalk as a future improvement for the apartments. The design and style of the ironwork has not been decided but several possible designs were exhibited. Zoeller stated that he needed a better idea of the ironwork design, which is the primary feature improvement of the exterior facade. Details for the new exterior vinyl shutters for the windows were not available. Discussion focused on the need for additional information regarding the ironwork and shutters, and it was decided that shop drawings of both items must be presented for staff review. There was a motion that the COA request be approved contingent on final approval of shop drawings for the ironwork, decorative railing, fence and shutters. It was approved unanimously. September 2000 Little Rock Historic District Commission City Hall 500 West Markham Street Little Rock, Arkansas 72201 Regarding: Rock Terrace fence Dear Commission Members: We respectfully request that the original fence, that was removed between Rock Terrace and property located at 914 Rock Street, be reconstructed as soon as possible. The original fence, although in a deteriorating condition, offered considerable privacy and a much needed buffer between 914 Rock Street and the 5 unit apartment building (Rock Terrace) next door. The entrances to all 5 Rock Terrace apartments are located on this north side of the property - facing our side yard. The fence was a roximatel 6 feet in hei ht and o a ue made of horizontal wood boards painted white. There is an inadequate side yard setback at Rock Terrace, so the fence was the only buffer to all the noise and activity generated by a 5 unit apartment building. With entrances so close to the property line, a directive towards the street or towards the parking area is needed. We feel as though a fence similar to the original in opacity and height is necessary to protect the integrity of the surrounding properties. We understand that the fence was a requirement at the time the apartments were constructed. At the time of construction, there were no building setback re- quirements, the o ue 6' hi h fence served and was required for the buffer. The original fence was appropriate to the site and to the neighborhood, rovided rotection visuall as well as a noise buffer........ and, very importantly, had been there since the inc ption of the Little Rock Historic District Ordinance in 1976. Your presence at the LRHDC meeting on 7 September was requested in order to discuss the demolition of the perimeter fence on the north, south and west sides. You were granted administrative approval to demolish the fence as long as you constructed a new one that met the approval of the LRHDC; while you demolished the fence prior to approval, you were given verbal administrative approval with the good faith understanding that you would construct a new one. The 10 August letter stated that you have until 10 October to construct an approved fence comparable to the one you demolished. Comparable denotes one that is: equal to or near the height of the old fence (64"); of similar opacity; and installed along the north, south and west facades. If you honor your agreement to construct a fence comparable to the old fence, the design must be approved administratively. Historically, fences were commonplace in Little Rock, New Orleans and other cities; fences in an urban area permit a level of separation and privacy in otherwise densely populated neighborhoods. They were constructed of wood, brick, masonry and iron and defined private spaces and work areas. Lattice was used as screening on two -storied back porches and underpinnings and was not as utilitarian in its construction. if elect to construct a fence other than _5 what is comparable to the old fence, it will be E cessary to come before the LRHDC at its October meeting for a new COA .a`pplicati�n. A completed COA application must be submitted, along with a drawing and specifications; property owners within 150' of the property must be notified. As discussed previously, a privacy fence along the sides may be 6' (six feet) in height and constructed of wood. Lattice is utilized on the top of privacy fences as a decorative border, and there are several fences with this design in the historic district. Rock. You indicated that you were concerned with thefts and transients loitering behind the fenced in area on the North, South and West sides of the building. Officer Ray Ferrell met with you to discuss the fence that you are going to erect. You asked that we make a recommendation of what type of fence be installed according to CEPTED (Crime Prevention Through Environment Design). You have torn down a six-foot (6') high privacy fence in the recent past. CPTED recommends that a picket fence or wrought iron fence of at least three to six-foot in height be installed to deter any criminal activity. CPTED does not recommend that a six- foot (6') privacy fence be reinstalled. This type fence would allow for concealment of criminal activity. It is our desire at the Little Rock Police Department to assist the citizens of Little Rock in any way we can to help reduce the risk of being victimized by crime. We hope that this perimeter security survey will help you in your goals to make your residence a crime free place to live. Your presence at the LRHDC meeting on 7 September was requested in order to discuss the demolition of the perimeter fence on the north, south and west sides. You were granted administrative approval to demolish the fence as long as you constructed a new one that met the approval of the LRHDC; while you demolished the fence prior to approval, you were given verbal administrative approval with the good faith understanding that you would construct a new one. The 10 August letter stated that you have until 10 October to construct an approved fence comparable to the one you demolished. Comparable denotes one that is: equal to or near the height of the old fence (64"); of similar opacity; and installed along the north, south and west facades. If you honor your agreement to construct a fence comparable to the old fence, the design must be approved administratively. Historically, fences were commonplace in Little Rock, New Orleans and other cities; fences in an urban area permit a level of separation and privacy in otherwise densely populated neighborhoods. They were constructed of wood, brick, masonry and iron and defined private spaces and work areas. Lattice was used as screening on two -storied back porches and underpinnings and was not as utilitarian in its construction. If you elect to construct a fence other than what is comparable to the old fence, it will be necessary to come before the LRHDC at its 5 October meeting for a new COA application. A completed COA application must be submitted, along with a drawing and specifications; property owners within 150' of the property must be notified. Please review the instructions, which are attached to the enclosed application.
