RE: Proposed replat in Block 305 of the Original City of Little Rock
Dear Mr. Pownall:
Thank you for your inquiry regarding the replat of Lots 1-R, 2-R, 4, 5 and 6 of Block 305 of the
original City of Little Rock. We have reviewed the proposed replat (attached) and have determined
that it will not result in the non -conformity of the proposed new parcels. The proposed replat
does not require any variance, waiver, or further review from the Capitol Zoning District
Commission.
As you know, the Commission has traditionally declined to exercise its authority over the
subdivision and platting of land in the Capitol Zoning District. The agency's administrative Rule
states in Section 2-104 (C):
... in areas where the Commission has chosen not to exercise its authority, such as platting and
subdivision ofproperty, the ordinances of the City of Little Rock are controlling.
And again in Section 2-111, it states:
... unless specifically dealt with as provisions of this Master Plan, all other regulations,
requirements and codes of the city of Little Rock shall continue to be in force in the Capitol
Zoning District
So while our agency does not object to your proposed replat, we must refer you to the City of
Little Rock's Department of Planning and Development to obtain approval.

That ARKANSAS HOSPITALITY ASSOCIATION AND GOODWILL INDUSTRIES OF
ARKANSAS, hereinafter called "Grantors", being the owners of Lots 1R, 2-R & 4-6,
Block 305, Original City, Little Rock, Pulaski County, Arkansas, hereby replat same as
Lots IAR & 5R, Block 305, Original City, Little Rock, Pulaski County, Arkansas, as
shown and represented on the attached replat, and henceforth description and conveyance
by such designation or part thereof, as shown and represented on said attached replat,
shall be a proper and sufficient description thereof.
Said Lots IAR & 5R, Block 305, Original City, Little Rock, Pulaski County, Arkansas,
as shown and represented on attached replat and any interest therein shall be held and
owned subject to and in conformity with all provisions, convenants and restrictions of the
Plat and Bill of Assurance for Lots 4-6, Block 205, Original City was filed for record in
the Office of the Recorder of Pulaski County, Arkansas on January 4, 2010, as Instrument
No. 2010000004 and the Plat and Bill of Assurance for Lots 1R & 2-R, Block 5, Original
City was filed for record in the Office of the Recorder of Pulaski County, Arkansas on
February 3, 1983 as Instrument No. 83-05848 and in Plat Book "A", Page 848,
Permanent easements for drainage, for laying and maintaining sewer pipes and mains and
for the installation and maintenance of utilities are created and reserved over, across and
through said lands as shown on attached plat.
Any business, trade, activity or undertaking not in keeping with the zoning use of said
land, herein platted, and each of them, is prohibited and shall not be carried on or
permitted on any part of said land; and, anything deemed a nuisance or to create undue
annoyances or which interferes with the zoning use and occupancy of said land shall be
prohibited thereon.
The convenants, restrictions, requirements and provisions of this instrument shall be
automatically extended for successive periods of ten years each on and after January 1,
2024, unless and unto amended or canceled as authorized herein.
Invalidation of any covenant, restriction, requirement of provision set forth herein or any
part thereof by an order, judgment or decree of any Court or otherwise shall not
invalidate or affect any of the other covenants and/or restrictions or any part thereof as set
forth herein but they shall remain in full force and effect.
