WHEREAS, Kavanau h+aui Horizontal Pro ert Regime and H. F. Enterprises, L.L.C.
are the sole owners of the following described property: KAVANAUGH COURT
HORIZONTAL PROPERTY REGIME AND THE FAIRFAX TERRACE CONDOMINIUM
HORIZONTAL PROPERTY REGIME all in Lots 12 and 13 of Midland Hills Addition to the
City of Little Rack Pulaski Coqpg. Arkansas, and desire to replat said lots:
NOW, THEREFORE, WITNESSETH:
THAT we, the said Kavanaugh Court Horizontal Property Regime and H. F. Entegprises
L.L.C, hereinafter termed grantors, have caused said tract to be surveyed by Johnny R. Tweedle,
R.L.S. #1203, State of Arkansas, and a plat thereof made which is identified by the title DAVID
HALL REPLAT, City of Little Rock, Pulaski County, Arkansas, and the date May 25, 2005 and
by the signature of the said surveyor and the said grantor(s), and bears a Certificate of Approval
executed by the Little Rock Planning Commission and is on record in the Office of the Circuit
Clerk, and ex-officio Recorder of Pulaski County, Arkansas, in PLAT BOOK
, PAGE,3 5—y and the grantor(s) do hereby make this Bill of Assurance.
AND, the Grantor(s) hereby certify that they have replatted said real estate in accordance
with said plat for the sole purpose of amending the line between said Lots 12 and 13 to provide a
minimum two (2) foot setback of the existing deck, as approved by the Board of Adjustment on
September 27, 2004. All existing covenants and restrictions shall remain in full force and effect.
The lands embraced in said plat shall be forever known as designated on said plat; and
every deed of conveyance for said property shall use this designation.
All buildings constructed on said lots shall be constructed no nearer to the street
than the building line shown on the plat, and all buildings shall be constructed in conformance
with the Building Code and Zoning Ordinance of the City of Little Rock, Arkansas.
