4 ROCK MUNICIPAL PROPERTY OWNERS MULTIPURPOSE
5 IMPROVEMENT DISTRICT NO. 2025-002; (MOUNTAIN BROOK
6 RECREATION DISTRICT); TO DECLARE AN EMERGENCY; AND FOR
7 OTHER PURPOSES.

9 WHEREAS, a Petition to form City of Little Rock Municipal Property Owners' Multipurpose
10 Improvement District No. 2025-002 (Mountain Brook Recreation District) was filed with the Little Rock
11 City Clerk; and,
12 WHEREAS,the City Clerk has presented the petition to the Mayor; and,
13 WHEREAS, the Mayor has set June 17, 2025, at 6:00 PM or as soon afterwards as the item may be
14 reached on the regular call of the agenda, as the date and time for a Public Hearing before the Little Rock
15 Board of Directors for consideration of the Petition; and,
16 WHEREAS, the Little Rock Board of Directors has determined from an Abstractor's Certificate of
17 Property Ownership that those signing the petition constitute all the owners of the real property to be located
18 in said District.
19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK, ARKANSAS.
21 Section 1. The real property described as:
22 37.2556 ACRES BEING A PORTION OF THE NORTH 3/4 OF THE NE 1/4 OF SECTION
23 14,T-2-N, R-14-W, CITY OF LITTLEROCK, PULASKI COUNTY, ARKANSAS; MORE
24 PARTICULARLY DESCRIBED AS FOLLOWS:
25 COMMENCING AT A POINT LOCATED AT THE SOUTHEAST CORNER OF THE
26 N1/4 OF THE W'/,, NE'/4,NE'/+, SAID SECTION 14; SAID POINT ALSO BEING THE
27 POINT OF BEGINNING; THENCE N87°36'04"W, ALONG THE SOUTH LINE OF
28 THE N3/4 OF THE NE'/4 OF SAID SECTION 14,A DISTANCE OF 1,653.57'TO A POINT
29 ON THE WEST LINE OF SAID NE'/4; THENCE LEAVING SAID NORTH LINE
30 NO2°51'1S"E, ALONG SAID WEST LINE, A DISTANCE OF 96139' TO THE
31 NORTHWEST CORNER OF SAID NE'/4;THENCE S87°36'13"E,ALONG THE NORTH
32 LINE OF SAID NE'/4,A DISTANCE OF 1,653.68' TO A POINT LOCATED ON THE

1 EAST LINE OF THE W'/.,NE'/.,NE'/.,SAID SECTION 14;THENCE ALONG SAID
2 EAST LINE,S02°51'39"W-981.46';BACK TO THE POINT OF BEGINNING.
3 is hereby established as the City of Little Rock Municipal Property Owners' Multipurpose Improvement
4 District No. 2025-002 (Mountain Brook Recreation District)for the purpose of constructing and installing
5 facilities for waterworks, recreation, drainage, gas pipelines, underground trenches and excavations
6 necessary for the installation of electric and telephone distribution systems, sanitary sewers, streets,
7 including curbs and gutters, sidewalks, and maintaining the infrastructure and improvements within the
8 District,together with facilities related to any of the foregoing within said District.
9 Section 2. The following three (3) individuals nominated in the petition are hereby appointed as
10 Commissioners of said Improvement District:
11 (a) Scott Hurley;
12 (b) Russell W. James; and
13 (c) John Zachery DeYmaz.
14 Section 3. Severability. The various parts, sections and clauses of this ordinance are hereby declared
15 to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid
16 by court of competent jurisdiction,the remainder of this ordinance shall not be affected thereby.
17 Section 4. Repealer. All laws, ordinances, resolutions, or parts thereof in conflict with the provision
18 of this ordinance are hereby repealed to the extent of such conflict.
19 Section 5. Emergency Clause. The Board of Directors of the City of Little Rock, Arkansas, has
20 determined that with development in the area covered by the boundaries of the Improvement District laid
21 off in this ordinance requires, as critical to the public health,safety, and welfare, construction of additional
22 infrastructure; an emergency is, therefore, declared to exist, and this ordinance shall be in full force and
23 effect from and after the date of its passage.
