Dear Mr. Barre'
This letter is to inform you that the referenced addresses are located within the MacArthur Park
Historic District and the recently modified porch roof work is out of compliance with the
District's regulations. MacArthur Park Historic District is a local ordinance district and all
exterior changes must obtain a Certificate of Appropriateness before the construction can take
place. Our records indicate that the porch roof work at the above addresses does not have the
necessary Certificate of Appropriateness. Please contact this office to determine what steps will
need to be taken to correct this oversight.
Ownership information was obtained through the Pulaski County tax records.

This office received information that the exterior of the above noted historic
district property was recently altered without plan review or approval by the
MacArthur Park Historic District Commission. It is my understanding that, as the
current owner of this property, you were notified of your noncompliance by letter dated
September 4, 2003 from Little Rock Housing Administrative Coordinator Andre
Bernard and that you have contacted Mr. Bernard but have not yet submitted ' an
application in order to correct this oversight.
Please be advised that, by authority of Arkansas statute, no building or structure
shall be erected, altered, restored, moved or demolished within an historic district until
after an application for a certificate of appropriateness as to exterior architectural
features has been submitted to and approved by the Historic District Commission.
Arkansas Code Section 14-172-208. Each day that a violation continues to exist
constitutes a separate offense. Arkansas Code Section 14-172-204. By ordinance now
codified at Little Rock Revised Code Sections 23-129 though 23-133, the Little Rock
Board of Directors adopted these statutory provisions for the purpose of enforcement
within the MacArthur Park Historic District.

This letter is submitted as formal notice that you are in violation of Little Rock
Revised Code Section 23-132 for failure to obtain a Certificate of Appropriateness. I
encourage you to contact Andre Bernard in order to schedule a hearing before the
Historic District Commission so that the exterior changes to your property can be
approved or, if necessary, modified. I have not received any information indicating that
the exterior changes to these buildings are in conflict with the Historic District
Guidelines. (See enclosed manual.)
We will allow you a courtesy period of thirty (30) days from the date of this letter
to submit an application for a Certificate of Appropriateness before enforcement action
is taken. If you have any questions about this matter of noncompliance, please contact
me or have your attorney contact me as soon as possible.

Dear Mr. Bernard;
The property referenced consists of three buildings with 5 entrances and were built in
with flat roofs. We recently built over each existing roof with a hip roof to match the pitch
of the main building roof. The material used is standing seam copper. This work
constitutes the extent of the improvements relative to this application except that new
landscaping at the front of the buildings has been provided and a concealed saturation
sprinkling system has been installed, There is no visual evidence of a sprinkler system.
These apartments were built by my father in 1940 and have remained in the family ever
since.
